| Yes, all right. What's your name by Commissioner Singh. | 00:09:22 | |

| Five, Yeah, 5. Two down this way. | 00:09:38 | |
| Going to add a resolution to the agenda declaration that Weld County is not a sanctuary county for the federal immigration crisis, | 00:09:49 | |
| I'll go ahead and read that. Whereas the Board of County Commissioners of Old County Colorado, pursuant to state statute and | 00:09:55 | |
| Lowell County home World charter, is vested with the authority of administering the fairs of World County Colorado and whereas the | 00:10:01 | |
| Board has witnessed negative impacts of citizens on the current immigration crisis. | 00:10:06 | |
| And those cities designating themselves as sanctuary cities. | 00:10:13 | |
| And whereas a member Mayor Mike Johnson's office has 100 million, $180 million managing the immigration crisis in 2024 and | 00:10:16 | |
| migrants now reported to be camping outside of our world county, towns and cities which constrain our taxpayer resources. | 00:10:23 | |
| Already dedicated to helping those in need who live in Walden County, including veterans, elderly, citizen, children of all ages | 00:10:30 | |
| and the homeless. | 00:10:34 | |
| And where's the well? County Board of Commissioners will continue to prioritize the needs and safety of our citizens, and that | 00:10:38 | |
| mission has been jeopardized. But this governor's support and signature on sanctuary laws that hobbled sheriff's police and our | 00:10:42 | |
| justice system. | 00:10:45 | |
| Such as HB 19201124, HB 1930, HB 211194, HB 2311 hundred and where is the Biden administration has ended the Trump administration | 00:10:50 | |
| policies including detention and deportation of illegal immigrants and thus failed to execute the law to secure our country's | 00:10:57 | |
| borders and causes crisis overwhelm this nation our cities in the state of Colorado. | 00:11:04 | |
| And where it be resolved by the Board of County Commissioners of Lowell County, Colorado to declare that we are not a sanctuary | 00:11:12 | |
| county for the federal government failures normless use of taxpayer dollars resulting from this federal immigration crisis | 00:11:16 | |
| affecting Colorado. | 00:11:20 | |
| Which includes the misuse of taxpayer dollars regarding all departments on the authority of World County, including any other help | 00:11:25 | |
| with grants any cities or towns declaring themselves be sanctuary towns and cities. | 00:11:30 | |
| Nor sanctuary towns or cities is found to be operating in that capacity. Be it further resolved by the board we called on the | 00:11:35 | |
| federal government channel representatives in Congress is hereboarding for safety and sovereignty of our country, backstanding | 00:11:41 | |
| skier border wall barriers and reinstating Trump administration policies such as safe third countries, Title 32 tariffs and | 00:11:47 | |
| freezing coordinated countries unwilling to enforce their borders. | 00:11:52 | |
| The above and foregoing resolution. | 00:11:58 | |
| And this is adopted hopefully today on the 6th day of March 2024. Is that a motion? That is a motion, ma'am. Thank you. All right. | 00:12:01 | |
| There's a motion on the floor for including. | 00:12:07 | |
| Declaration from Commissioner saying motion is by Commissioner saying. | 00:12:15 | |
| Second, by Commissioner Brock, to put this on today's agenda, I believe we would place that. | 00:12:20 | |
| As #1212 right now on new business, is there any further discussion regarding that? | 00:12:26 | |
| All right. I'll go ahead and call the call. All those in favor of amending the agenda to include. | 00:12:36 | |
| The sanctuary county. | 00:12:43 | |
| Resolution signify by saying aye, aye, all opposed same sign. | 00:12:46 | |
| And that will now be included as item number 12 on today's new business on today's agenda. And Mr. Chairman, one more to add to | 00:12:51 | |
| the agenda. | 00:12:56 | |
| I wanted to give you the opportunity, since I believe you told some ladies at the early Republican women that you would pass a | 00:13:02 | |
| resolution on life sanctity of life rather than a proclamation. But I do have both here. Which one would you like me to move? | 00:13:08 | |
| I haven't told him anything. What are you trying to pin me into, commissioners, Once again, Can I just make one comment? Sure. So | 00:13:15 | |
| if you haven't had a chance to read the awards, you vote no. If you haven't had a chance to read anything, you vote no. And yet | 00:13:20 | |
| you bring something that none of us have seen. The County Attorney hasn't looked at it. Expect us to vote on it today. That's not | 00:13:25 | |
| going to happen. I'll pass that on. It's the same when the County Attorney Roach, it's the same one you've seen before. It's the | 00:13:30 | |
| same one. | 00:13:35 | |
| Exactly the same resolution as before. Well, that's not the. That's not for today. | 00:13:43 | |
| I'd rather just get it all done today, no? | 00:13:49 | |
| Add a resolution expressing the sanctity of life to have our child and calling the human those who are in the Roma human being. | 00:13:54 | |
| All right. There's motion from Commissioner saying that an additional resolution. Is there a second? | 00:14:00 | |
| All right, that fails with no second. | 00:14:07 | |

| All right, there's a motion on the floor for removal of item number 11, which is a considered expression of support for Royal | 00:14:23 | |
| County Sheriff's Office immigration detainers policy. Any further discussion on that motion has been moved by Commissioner | 00:14:29 | |

| Item number one, approve it B 240-0034 On call right away Acquisition, relocation and appraisal Services. Department of Public | 00:16:41 | |
| Works, Good morning Tony. Good morning Toby Taylor with Purchasing Public Works has conducted a quality based selection process to | 00:16:49 | |
| select a consultant to perform on call right away acquisition, relocation and appraisal services for calendar year 2024. The | 00:16:56 | |
| contract is a single year contract with options to renew in 2025 and in 2026. | 00:17:04 | |
| The Decision Ranking Summary is an Exhibit A of your attached to this memo. The first ranked proposal was submitted by Western | 00:17:13 | |
| States Land Services, also called Western States. Bell County has used the services of Western States multiple times in the past | 00:17:20 | |
| and they have been found to be representative of the county needs and have completed the projects on schedule. | 00:17:26 | |
| Therefore, Public Works is recommending the award of On Call Right Away Acquisition and appraisal Services to be contracted with | 00:17:34 | |
| Western States Land Services LLC for a not to exceed amount of $110,000. | 00:17:40 | |
| All right. Questions for Toby. Regarding the bid, I do have a question. What are the three bids from the vendors for the | 00:17:48 | |
| contractors? | 00:17:52 | |
| This was a process, so price was not evaluated until it was negotiated at the end per county code. | 00:17:57 | |
| OK. And if? | 00:18:07 | |
| So we don't do a good process no more. | 00:18:11 | |
| We have a bid process and a QBs process. The QBs process complies with federal requirements in which you look at quality versus | 00:18:15 | |
| price. | 00:18:20 | |
| What that means is once you find the bid, the bidder that meets the qualifications for the bid that we're looking for, then you | 00:18:27 | |
| get the numbers and pricing from the. | 00:18:31 | |
| Correct, Toby, correct. | 00:18:36 | |
| Excuse me. Is there any way we can get pricing even with what we have three contractors in the queue? That's not how QBs works. If | 00:18:40 | |
| we go for best price bidding, then that's when you're going with three competitive bids or trying to get multiple bids to compete | 00:18:46 | |
| when you're going QBs. That's exactly the reason why we go this way. | 00:18:53 | |
| To whether we can also have a bid process and have a QBSQBS pick one of the other. You pick one of the other in the process. | 00:19:01 | |
| Federal guidelines? There's no way to do both? Nope. OK. | 00:19:08 | |
| Second motion from Commissioner Freeman, second from Commissioner James, to approve bid D 240034 Any further discussion? | 00:19:13 | |
| And then all those in favor signify by saying aye, aye, all opposed. Same sign. | 00:19:22 | |
| B 240-0034 passes 5 to 0. | 00:19:27 | |
| Item number two approved, BID B 240-0046, Downtown Raleigh Complex and Northern Colorado Regional Forensic Laboratory Flooring | 00:19:32 | |
| Maintenance Facilities Department. | 00:19:37 | |
| The Facilities Department has requested the approval date for the Downtown and Crime Lab flooring maintenance be moved to | 00:19:43 | |
| Wednesday, March 13th, 2024 to allow time for further review of the submitted bids. | 00:19:49 | |
| OK. Any questions for Toby? | 00:19:57 | |
| Other than Wednesday is the 13th Toby, am I correct on it? | 00:20:02 | |
| OK. Next one move to continue to March 13, 2024, 9:00 AM. | 00:20:07 | |
| There's no sound floor from Commissioner James, seconded by Commissioner Freeman, to continue bid B 240-0046 to the 13th of March. | 00:20:14 | |
| Any further discussion? | 00:20:19 | |
| Hearing none, all those in favor signify by saying aye, aye, all opposed. Same sign. | 00:20:25 | |
| And bid B 240-0046 gets moved to March 13th at 9:00 AM, five to zero. | 00:20:30 | |
| Item number three Approved. Bid B, 240-0047. Department of Human Services, Buildings, AB and C Flooring Maintenance. | 00:20:37 | |
| Facilities Department. | 00:20:46 | |
| As advertisers bid is to perform carpet and floor care for the Human Services complex buildings, the low bid is for Metro | 00:20:48 | |
| Maintenance Inc and meat specifications. Therefore, facilities is recommending the award to Metro Maintenance Inc in the amount of | 00:20:53 | |
| $2513.00 per month. | 00:20:59 | |
| Any questions? | 00:21:07 | |
| Move to approve Second motion by Commissioner Freeman, second by Commissioner James for approval of bid B20 four 00047. Any | 00:21:08 | |
| further discussion. | 00:21:13 | |
| Hearing none, all those in favor signify by saying aye, aye, all opposed. Same sign. | 00:21:18 | |
| 52400047 passes 5 to 0. | 00:21:24 | |
| Item number four present BID B 240-0052 N Jail Security Grid Replacement Facilities Department. | 00:21:29 | |
| Two vendors have replied to the solicitation facilities, are reviewing those replies and anticipates bringing a recommendation for | 00:21:37 | |
| award to the Board on March 20th, 2024. | 00:21:42 | |
| Any questions for Toby regarding US? | 00:21:48 | |

| No further questions. This is Code Ordinance final reading for 2403. Is there anybody from the public that wishes to come forward | 00:30:58 | |
| and address? | 00:31:04 | |
| Code Ordinance 2024-03. If so, please come to the podium, state your name and address, and keep your comments to 3 minutes. | 00:31:11 | |
| Seeing that, I'll go ahead and close public comment for final reading of Code Ordinance 2024 O3 and I'll bring it back to the | 00:31:20 | |
| board. | 00:31:24 | |
| It should move to approve on final reading Code Ordinance 2024 Dash 03 second. | 00:31:28 | |
| Motion by Commissioner James to approve Court Ordinance 20/24/03 on final reading second by Commissioner Buck further discussion. | 00:31:33 | |
| Hearing none, all those in favor signify by saying aye, aye, all opposed. Same sign. | 00:31:41 | |
| And coordinates 20/24/03 passes unanimously on final reading. Thank you. Thank you, Jamie. | 00:31:47 | |
| Changes to item number 10. Consider expression of support for University of Northern Colorado College of Osteopathic Medicine and | 00:31:55 | |
| HD24-1231 state funding for higher education projects. | 00:32:01 | |
| If you would, thank you, Sir, I have requested this resolution of support. We have. We, being the Board of County Commissioners, | 00:32:10 | |
| has actively used resolutions to take positions on active legislation. In this case we are. | 00:32:16 | |
| HB24-1231. | 00:32:24 | |
| Course, we have already heard from President Andy Feinstein from the University of Northern Colorado was actively pursued this | 00:32:27 | |
| College of Osteopathic Medicine. It's expected to generate $1.5 billion in economic impact over the next several years. UNC would | 00:32:34 | |
| graduate 150 new doctors and put them into the workforce each year. Once they get up and fully cohorted, they, I believe, expect | 00:32:41 | |
| to admit their first class of cohorts within the next two years. | 00:32:47 | |
| It is a piece of legislation that's being carried from a bipartisan standpoint 1 by a former county commissioner. Current Senator | 00:32:56 | |
| Mark Kirkmeyer, Representative Mary Young are just a couple of the bipartisan Co sponsors on this piece of legislation. | 00:33:04 | |
| It has significant impact on the person's wealth, counting on the positive. And with that Mr. Chair, I would move that we approve | 00:33:11 | |
| this resolution. | 00:33:15 | |
| Second, the motion from Commissioner James for approval. | 00:33:20 | |
| Of the expression of support for the University of Northern Colorado College of Osteopathic Medicine and HB 241231, second by | 00:33:24 | |
| Commissioner Freeman. Any further discussion? | 00:33:30 | |
| I'm going to go ahead and make comments. I think this is a great opportunity for UNC City agreement, Weld County. You're really | 00:33:37 | |
| going to change the dynamics of this community by bringing in this type of college. They'll be one of only two or three. | 00:33:45 | |
| Medical colleges here in the state, and that's a very big deal. And I know President Feinstein has worked tirelessly on this as | 00:33:55 | |
| others have in the community, and I appreciate our legislators. | 00:34:01 | |
| Seeing the value in this not only for UNC, but with HP 24/12/31 there's multiple other higher Ed entities that are being able to | 00:34:08 | |
| get support that they need as well on their projects and so I'm going to be in full support of this as well. | 00:34:15 | |
| So there are no other comments. I'll bring that back to the board. We have a motion and a second. | 00:34:23 | |
| And with that I'll go ahead and call the call all those in favor of the expression support signify by saying aye, aye, all | 00:34:29 | |
| opposed, same thing. | 00:34:33 | |
| And that expression of support passes unanimously and we obviously wish you would see. | 00:34:37 | |
| The best first year, if you would. You're probably a couple of gentlemen from UNC this morning. | 00:34:42 | |
| OK. I was mistaken. I'm sorry, Commissioner James, thanks for pointing that out. | 00:34:50 | |
| Brings us to item number 11 that was amended. This is a resolution declaration that Weld County is not a sanctuary county for | 00:34:56 | |
| federal immigration crisis. | 00:35:00 | |
| If you're saying you wish to address anything on this. | 00:35:08 | |
| I just approved the declarations and said the already read into the record. | 00:35:11 | |
| Motion on the floor from Commissioner saying for approval of this resolution. | 00:35:19 | |
| Any second. | 00:35:25 | |
| Second, second by Commissioner Buck for the resolution, any further discussion. | 00:35:26 | |
| Mr. James. | 00:35:35 | |
| Thank you, Mr. Chair, I appreciate, Commissioner, same thing this forward, it expresses a concern by many in the Community. | 00:35:37 | |
| I think it is a bit in reaction to some false information that's on a website on the Centers for Immigration Studies website. They | 00:35:44 | |
| rather mistakenly branded well county or sanctuary county, no. | 00:35:49 | |
| Action ever has been taken by this Board of County commissioners to to designate, well, plenty of sanctuary county. It could not | 00:35:55 | |
| be farther from the truth. | 00:35:58 | |
| Their definition of sanctuary and mind you this isa.org. So therefore it comes with a particular bias. Their definition of of a | 00:36:03 | |
| sanctuary county is certainly not what what you and I would recognize as as a sanctuary county. No action has ever been taken by | 00:36:09 | |
| this board of County commissioners to designate World county. | 00:36:15 | |
| Therefore the the resolution in my opinion is is out of order. Let me indicate as as to why. | 00:36:22 | |
| We sit as you can go further and how I see my role as an elected representative. | 00:36:29 | |
| We elected a couple of fold. This is how I see my role. Want to be an elected representative of the people and help them petition | 00:36:36 | |
| government, IE there's a pothole on my Rd. I I wish to have something done in the Department of Human Services. I provide | 00:36:42 | |
| constituent services and elected representative, and that's what I I do. | 00:36:48 | |
| I'm also elected to be 1/5 of a governing body that it sits as a boy. County commissioners or county commissioners has certain | 00:36:55 | |
| powers, powers, and duties that are outlined in section 3-8 of our our county charter. We certainly can enact policy and enact | 00:37:00 | |
| legislation. | 00:37:06 | |
| You have heard this morning we move to approve. Is this is all done by a resolution? | 00:37:13 | |
| The primary instrument of action that this Board of county Commissioners has is is the resolution. | 00:37:19 | |
| That is how we take action, the resolution while heartfelt, and I certainly agree with the sentiment. | 00:37:24 | |
| Because we are being invaded by the southern border, we see it every day, but the resolution that is requested by by Commissioner | 00:37:32 | |
| saying simply declare something that we're not. | 00:37:37 | |
| But we're not a sanctuary county and and so why do we have to reinforce that, which we're not? | 00:37:43 | |
| Soon we'll have to reinforce everything that we're not, we're not in Oregon County. We're we're the sky is not purple. We are. If | 00:37:49 | |
| we are not taking action with the counties primary instruments instrument of action, which is a resolution, then why are we making | 00:37:55 | |
| a resolution? If it takes no action, it's inaction. | 00:38:01 | |
| I stand against. | 00:38:08 | |
| Twisting the primary instruments of of of this body's action. | 00:38:11 | |
| To take in action, it certainly makes a statement, it makes a political statement of that. | 00:38:15 | |
| It's a cinema that I agree with. But when the Board of County Commissioners uses its primary instrument of action, the resolution | 00:38:22 | |
| to take in action or to make a political statements, then that's fine when we agree with that political statement. But what | 00:38:27 | |
| happens when we don't agree with that political statement and they're using the instruments of government to make a political | 00:38:32 | |
| statement? | 00:38:37 | |
| I disagree with that. | 00:38:43 | |
| I believe that we all have platforms in which that we can make statements apply for them by speaking out as as one of five at this | 00:38:45 | |
| particular meeting in social media, in in in the realms that we make as as newly elected representatives we can make those | 00:38:51 | |
| statements. We are not a sanctuary county by any standard of any measure and I will continue to make that statement that I don't | 00:38:58 | |
| support those who choose to be sanctuary organizations because I I think it is wrong. | 00:39:05 | |
| Now, that being said, let's take a look at the action that we can take. | 00:39:13 | |
| What action does this board have by the consent of the government under the proper authority, which I'm big on? | 00:39:18 | |
| What actions can we take to stem the tide of illegal immigration? | 00:39:25 | |
| I think that we can equip our Sheriff's Department that interesting. Interestingly enough, we had a request a presentation by a | 00:39:29 | |
| chef for NC on Monday. | 00:39:33 | |
| To to to provide a request for more money to help him make his agency his Sheriff's Office, 1st in class in the state. | 00:39:39 | |
| It would be a proper designation by this board of county commissioners to a program. With that I mean the the request was 13 point | 00:39:48 | |
| million, $13.2 million / 4 years if I if I remember correctly. He can duly bring that request to the Board of County Commissioners | 00:39:53 | |
| would be considerate here in in a meeting. That is something that we can proactively do to make sure that we have a law | 00:39:59 | |
| enforcement agency that's tasked with protecting the the health and safety and welfare of the citizens of Weld County. That's | 00:40:05 | |
| something we can do. | 00:40:10 | |
| But I don't believe in using our primary action instrument, action resolution, to take in action. | 00:40:17 | |
| Because if we pass a resolution, that claims to be an action, but it's not when it's in action. | 00:40:23 | |
| Our, our, our, our residents will approach this and say, Commissioner, I saw somebody whom I believe to be here illegally. | 00:40:31 | |
| And you passed your resolution saying that we're not a sanctuary county. What are you going to do about it? | 00:40:37 | |
| And our response to a speech must be nothing, because we don't have the authority. | 00:40:42 | |
| A board in the elected body must. It must act in its proper authority. It's our proper authority to empower a Sheriff's Office | 00:40:48 | |
| with additional money to empower a Sheriff's Office with ordinances, like a camping van, that allows them to protect the citizens | 00:40:53 | |
| of Weld County. | 00:40:58 | |
| But to. | 00:41:04 | |
| To to take a resolution of inaction is something I can't stand behind. I appreciate the sentiment and I agree with many of you | 00:41:06 | |
| that are here that want something done on illegal immigration. But when a government tries to do something that is not granted to | 00:41:11 | |
| it in its its charters, its ordinances. | 00:41:17 | |
| The usurping of given authority by the consent of the governors, nothing but tyranny. | 00:41:25 | |
| And while we may agree with the sentiments to try to grab it some sort of authority that we don't have is is clearness, let's | 00:41:30 | |
| focus on that which we can can properly do. | 00:41:35 | |
| And and and do it And so as our sheriff comes to us and ask for more for more money which will have to come from our our | 00:41:40 | |
| contingency funds to ensure that our, our, our citizens are safe. That's a valid role of the of of this board, county | 00:41:45 | |
| commissioners. | 00:41:50 | |
| I don't believe it is a valid role. If if we're going to pass a resolution, an instrument of action that takes inaction, then what | 00:41:55 | |
| is it? If it's not action, it's it's a political statement. And while I may agree with it, there might be a time when I don't. And | 00:42:01 | |
| I believe that's an overstep of government, so therefore I will not be in support of the motion. | 00:42:06 | |
| James, like you comment, Mr. Freeman? | 00:42:14 | |
| A phone call to sheriff and they will be removed. I mean we passed that resolution. So I'm not, I mean last year I believe, let me | 00:42:59 | |
| actually put that on the books and that has been enforced and will continue to be enforced. That's the action that we can take as | 00:43:03 | |
| a board of county commissioners. | 00:43:08 | |
| This doesn't do anything other than say that we're something that we're not. | 00:43:13 | |
| I'd like to respond about this chair and so I will not be in support of the motion as well, Mr. said. | 00:43:18 | |
| Yeah, so we already equipped the Sheriff's Office and support the sheriff, So that's status quo. | 00:43:23 | |
| That's not leadership. Resolutions are supposed to be about action, and simply saying that we're not a sanctuary county isn't | 00:43:29 | |
| enough. | 00:43:32 | |
| Which means we need to take a strong stand. Money is policy. | 00:43:37 | |
| That is action by saying we will not misuse any funds from any department. | 00:43:43 | |
| Then we will have done what we will have done to ensure that we are non sanctuary county. | 00:43:48 | |
| Only when we ensure with our mouth and with our budget, which is action. | 00:43:54 | |
| Better departments are compliant, and that includes our Department of Health of Human Services. And furthermore, we have an | 00:43:59 | |
| apartment that's bent on giving environmental justice to people on the record. Our budget considerations include those who have | 00:44:06 | |
| declared themselves sanctuary cities, towns, or the facto sanctuary cities and towns. And as you are aware, the mayor, Denver, has | 00:44:12 | |
| been calling around to mayors asking them to help shelter these illegal immigrants up from Denver. | 00:44:19 | |
| So we have people actively trying to move this crisis up to Weld County. We need to act. | 00:44:26 | |
| We have a duty to protect the health, safety and law for our citizens. | 00:44:32 | |
| And we act the fact that through a budget in our department that is an action, that is the action we take. | 00:44:37 | |
| And the small town of Keansburg passed an anti sanctuary resolution. Should we have as much courage as the town of Kingsburg? | 00:44:44 | |
| And I've mentioned this before. I've been down to the border and both the Obama administration and the Trump administration to | 00:44:51 | |
| McAllen. | 00:44:54 | |
| And what a difference. | 00:44:59 | |
| What an incredible difference between the two. | 00:45:00 | |
| The Trump administration had the lowest amount of apprehensions in 45 years because of the policies. | 00:45:03 | |
| Mentioned in this resolution. | 00:45:10 | |
| We should support that with our mouths. | 00:45:13 | |
| But we should also support that as leaders. | 00:45:15 | |
| To have other leaders take up the mantle, and others are doing that right now, by the way, in some of our towns and cities, | 00:45:18 | |
| enacting some version of this resolution, and I applaud them for doing that. | 00:45:23 | |
| We need to say openly that this is wrong. What's going on in the state of Colorado. | 00:45:28 | |
| This effects. | 00:45:33 | |
| The safety, the health, the welfare of our citizens, and that's our job. | 00:45:35 | |
| That's our job to protect that. | 00:45:41 | |
| And the fact that this human trafficking crisis has exploded and I mentioned the Border Patrol pointed out to me this one child. | 00:45:43 | |
| Who was laying with a man that he probably wasn't related to, that he had passed over that border eight times. | 00:45:51 | |
| Because of our Congress. | 00:45:57 | |
| Created OK, as long as somebody's with a child, they passed through our borders without questions. | 00:45:59 | |
| That's terrible. | 00:46:06 | |
| And the fact we've got countries South. | 00:46:08 | |
| That do not take visas. | 00:46:11 | |
| You can just pass through and they do, with the intent of coming to the United States of America. | 00:46:14 | |
| That also must be stopped. | 00:46:19 | |
| The least we can do is. | 00:46:21 | |
| But we should be doing more. | 00:46:23 | |
| So with that. | 00:46:26 | |
| Again, I will urge my colleagues about yes in this resolution. | 00:46:28 | |
| Do you have anything done? | 00:46:33 | |
| Just quick question, I appreciate what you're saying. I do what you say, I just disagree with. | 00:46:35 | |
| How? We're trying to enact something again. We're taking inaction on. | 00:46:42 | |
| We're using an instrument of action to take in action. That being said, you did make. Are we misusing in your purview? Are we | 00:46:45 | |
| misusing county funds? And where? | 00:46:50 | |
| We shouldn't be, are we? Are we? I'm asking you, are we? | 00:46:57 | |
| Not. Well then let's continue not doing that and pass the resolution. So again, we're going to take in action. | 00:47:05 | |
| And I would and one other comment I would make you know if if the, if the. | 00:47:13 | |
| If the mayor of Denver is calling. | 00:47:22 | |
| Mayors in, well, County wanting them to help, That's also not in our jurisdiction. We have no. This doesn't have anything to do | 00:47:25 | |
| with what goes on in the city of Greeley, or the city of the town of Keansburg, or the town of Eaton or Windsor or anywhere else. | 00:47:31 | |
| This is only about unincorporated World County, and it is it is a resolution to take in action. | 00:47:38 | |
| I'm going to go ahead and weigh in. | 00:47:47 | |
| We are not a sanctuary county. This board has never taken any action to state that it is not now. Not passports, There is no. | 00:47:50 | |
| No vehicle out there inside of this county. And by vehicle I mean acting authority that is doing anything to make, well, county a | 00:48:03 | |
| sanctuary county. I agree with Commissioner James. | 00:48:08 | |
| Website is using information out of context. | 00:48:16 | |
| That may be out there stating that, well, county, in fact, pretty much every county in the state of Colorado is a sanctuary county | 00:48:21 | |
| because they're following their sheriff's departments, are following federal detention law when it comes to ICE and so. | 00:48:29 | |
| I I think that's a total misuse of this characterization. I believe there's a huge. | 00:48:38 | |
| Crisis when it comes to immigration in this country. I think it is sickening, Commissioner, saying I agree on many of your points. | 00:48:45 | |
| What's going on is is troublesome. It is frightening when it's having as far as an impact goes on our communities. | 00:48:52 | |
| And it could be resolved rather quickly. | 00:49:01 | |
| If folks in Washington had the political will to get it done, frankly the laws are already in place in Washington. They need to | 00:49:05 | |
| actually enforce the rule of law that they have and have the political stomach to do it. I don't think this is a partisan issue. I | 00:49:12 | |
| think this is something both parties agree on. I've had many talks with people not only on on the right side of the aisle, but | 00:49:19 | |
| also on the left side of the aisle. | 00:49:25 | |
| And and they're all in favor of fixing what is broken when it comes to to immigration again. When I was out in DCA few weeks ago, | 00:49:33 | |
| I urged our Congressional delegation. | 00:49:39 | |
| Have the political will get this fixed and the other Commissioners that were with Commissioner James and myself unanimously agreed | 00:49:45 | |
| with that. | 00:49:50 | |
| However, this is a resolution which is a document of action. | 00:49:56 | |
| We're simply not taking action in this resolution. I think it erodes the quality of what a resolution is for, It takes away from | 00:50:00 | |
| the purpose of it and therefore it's not the appropriate tool. I do agree with Commissioner James. We all have various. | 00:50:09 | |
| Media platforms that we can go on and take a political stance, should we choose any personal stance, should we choose. However, | 00:50:19 | |
| that's not using the instruments of government for our own political purposes. | 00:50:25 | |
| That's not the proper rule. And so therefore I am not in favor of a resolution that doesn't take any action as far as this board | 00:50:32 | |
| goes and and what I am able to ascertain from it. So with that, there is a motion on the floor from commissioner saying for | 00:50:39 | |
| approval, second from Commissioner Buck. I'll go ahead and call the call, we'll have a roll call. Bill, please. | 00:50:46 | |
| Mike Freeman. | 00:50:56 | |
| No, Scott. James. What are you saying? Perry back. Kevin Ross? No, That emotion dies 2:00 to 3:00. | 00:50:58 | |
| Commissioners Ross, Freeman and James voting no. | 00:51:11 | |
| That concludes new business. On to planning. | 00:51:15 | |
| Item number one, consider a request to withdraw application for site specific development plan and use by special review permit | 00:51:18 | |
| USR 12-0041 for an agricultural service establishment primarily engaged in performing agriculture, animal husbandry or | 00:51:26 | |
| horticultural services on a fee or contract basis. A mixed animal veterinary clinic in the A agriculture zone district and they | 00:51:34 | |
| send resolution #2012, Dash 2495. | 00:51:41 | |
| Dated September 19, 2012 Larry D Johnson Living Trust, Chris Good Morning, Chris Captain, Department of Planning Services. Mr. | 00:51:49 | |
| Parker with our office did a lot of work on this, went through and contacted applicants on some of our cases that hadn't been | 00:51:56 | |
| finalized. | 00:52:02 | |
| And these are cases where the applicants have requested to. | 00:52:09 | |
| Vacate or rescind the USR. I could go through each resolution if you'd like and explain the details. Or since there's nine of | 00:52:14 | |
| these. | 00:52:18 | |
| I think we have to take him case by case. | 00:52:25 | |
| Be appropriate here, Chris, and I mean you can just give us a minimal explanation on this where this is a withdrawal. | 00:52:28 | |
| Requesting to rescind it and that means they're not going to do it, so we would resend them so. | 00:52:37 | |
| Yeah, I'll do a quick one this. The first one, USR 120041 was located east of adjacent to County Road 3 and approximately. | 00:52:42 | |
| 2 1/3 miles north of County Road 40 1/2 It was originally for a mixed animal veterinary clinic. Staff has been to the site and | 00:52:53 | |
| verified that. | 00:52:58 | |
| The facilities no longer in operation and the original applicant is no longer the property owner. | 00:53:05 | |
| Excellent. Any questions for Chris? | 00:53:11 | |
| Move to approve the resolution. Second motion by Commissioner James for approval of resolution second by Commissioner by further | 00:53:14 | |
| discussion. | 00:53:17 | |
| None. All those in favor signify by saying aye aye, all opposed same sign and that is approved 5 to 0 to withdraw the application | 00:53:22 | |
| item. Number two, consider request to withdraw application for a site specific development plan and use my special review permit | 00:53:28 | |
| USR 12-0062 for use permitted by as a use by right accessory use or use by special review in the commercial or industrial zone | 00:53:35 | |
| districts. | 00:53:41 | |
| Manufacturing, fabrication, and painting of oil and gas and agricultural equipment provided that the property is not a lot in an | 00:53:48 | |
| approved or recorded subdivision plan or part of a map or plan filed prior to adoption of any regulations. | 00:53:56 | |
| Controlling Subdivisions in the A Agricultural Zone District and Rescind resolution that #2013-0144 dated January 16th, 2013 RF | 00:54:05 | |
| Holdings LLC. Chris. | 00:54:12 | |
| Good morning, Chris Gap and Department of Planning Services, RF Holdings LLC. This is located approximately 1/2 mile South of | 00:54:19 | |
| County Road 30 and approximately 1 mile east of Canterbury 43. | 00:54:25 | |
| They are no longer operating on site planning. Staff did conduct a site inspection and verify that the business is not | 00:54:31 | |
| operational. | 00:54:36 | |

| This concludes planning brings us to public comment. This is the time when anybody is allowed to come forth, share any concerns or | 01:03:54 | |
| comments you have with the County Commissioners. We ask that you please come to the podium up front here. State your name, your | 01:03:59 | |
| address for the record, and keep your comments to 3 minutes. | 01:04:04 | |
| On anything that's not on today's agenda. Thank you, Commissioner Freeman. Does anybody have any public comment? | 01:04:11 | |
| Come on up, man. | 01:04:19 | |
| Good morning. Good morning. | 01:04:22 | |
| My name is Lynn Tales and I live at 2160 144th Ave. in Greeley, Co. | 01:04:31 | |
| And I just want to remind you, we are walking in unchartered waters right now. | 01:04:36 | |
| You've already had a big discussion about this, so I'm going to share with you my story. Last Thursday evening at Union Colony | 01:04:41 | |
| Civic Center, Mayor Gates presented the state of Gray message to the citizens of the area. It was well received for the community. | 01:04:47 | |
| A burning question I wanted to have answered was are illegals coming and are in our area? Everyone I asked that work for the city | 01:04:54 | |
| of Greeley. Orwell County had no idea or wouldn't give an answer. | 01:05:01 | |
| One City of Greeley employee sitting next to me had the answer. Yes, they are here. | 01:05:08 | |
| Who is sending them? Who is allowing it to happen? | 01:05:15 | |
| Well, who is placing them in our area? | 01:05:19 | |
| We have been watching the past year what is happening in the sanctuary cities across the country. | 01:05:22 | |
| The cities are being destroyed. | 01:05:27 | |
| Denver is broken. Collapsing financially and leaving the illegals on their own. Denver has placed the city employees on extended | 01:05:30 | |
| layoffs. | 01:05:34 | |
| And they were to pay for the needs of the illegals. | 01:05:38 | |
| What are we doing to our own citizens? | 01:05:41 | |
| We're no longer a sovereign state. Maybe that is the point. | 01:05:44 | |
| This invasion of illegals as a planned and intentional move to destroy a country and bring it to great chaos. | 01:05:49 | |
| All you have to do is watch who is allowing it and encouraging the invasion. What do you plan to do to protect the citizens? | 01:05:55 | |
| As this is the role of our leaders. | 01:06:03 | |
| And your positions as county commissioners, you have the power, like the governor of the county. | 01:06:05 | |
| Royal County is recognized today as a safe place to live, according to the citizens in the community. | 01:06:11 | |
| Will it continue to be like that in two months? | 01:06:17 | |
| I chose to become a U.S. citizen and went through the naturalization process as a former citizen of Canada. | 01:06:20 | |
| There was order to the process and all the laws were followed by both protecting the US border. | 01:06:26 | |
| As a young person, my parents and I had to report our green cards until I chose to become a citizen. | 01:06:32 | |
| What are we experiencing? | 01:06:37 | |
| There's chaos, confusion, not to mention the sex trafficking of women and children, horrible drug trafficking, the cartels | 01:06:40 | |
| involvement and the utter disregard and respect for human life, our borders, our citizens and our communities. | 01:06:47 | |
| I plead with you to act on something to protect the citizens of Well County. | 01:06:54 | |
| I hope you are bold enough to protect us, the citizens of Royal County, and do something now before it is too late. | 01:07:01 | |
| May God give you over some of the courage to do so. Thank you. Thank you. | 01:07:08 | |
| Anybody else? | 01:07:18 | |
| Morning. | 01:07:22 | |
| Again, just remember to state your name and address for the record. | 01:07:24 | |
| My whole address or just the street address? Yeah. Thank you. Hi. Natalie Tennant. I live on Mount Andrew Drive in Severance, Co. | 01:07:28 | |
| Good morning. Good morning. | 01:07:38 | |
| I would like to thank Commissioner Singh for bringing this to my attention first, I would also like to thank Commissioner James | 01:07:41 | |
| for connecting with me and being informative for allowing for following up with me. I think you both for your time. | 01:07:48 | |
| As a concerned resident of all county, I'm here to express my strong support for prioritizing. | 01:07:57 | |
| Well-being in the interest of our local residents over the concerns of illegal immigrants and to urge you. | 01:08:03 | |
| Sorry, very passionate about this as well too. It's OK to urge you not to designate our county as a sanctuary county. | 01:08:09 | |
| I understand and I hear you all that you do not want this to be that, and I respect that. | 01:08:19 | |
| What you say and what we do are two different things though. OK, I understand that the topic of immigration can be polarizing. | 01:08:26 | |
| That is essential to address this issue in a manner that upholds the rule of law. | 01:08:31 | |
| And protects the rights and welfare of our community. By not becoming a sanctuary county, we can ensure that our limited | 01:08:38 | |
| resources. | 01:08:41 | |
| Are directed towards the safety and prosperity of our town residents. It's important to acknowledge that illegal immigration poses | 01:08:46 | |
| challenges to our county. | 01:08:50 | |
| Including potential strains on public service, job competition and public safety concerns. | 01:08:54 | |
| And taking a conservative approach and not providing sanctuary, we can send a clear message to the that White County values law | 01:09:01 | |
| abiding residents who contribute to our community. | 01:09:06 | |
| I respectfully request that you consider alternative strategies to address immigration concerns while maintaining the integrity of | 01:09:12 | |
| our county. | 01:09:16 | |
| Collaborating with federal agencies and enforcing existing immigration laws. | 01:09:20 | |
| Which we spoke on can help ensure that our community remains safe and welcoming. Welcoming place for legal residents. | 01:09:26 | |
| Furthermore, I encourage you to further evaluate the potential consequences of adaption of adapting. | 01:09:34 | |
| Century County status, which you've all stated that you do not want to do. So I thank you for that. | 01:09:40 | |
| This is also written before you all spoke today. | 01:09:47 | |
| In 3 minutes we'll come try. You're getting close to get it 45 seconds. | 01:09:50 | |
| Setting the impact on public safety, education, health care and economic stability is essential to make informed decisions that | 01:09:54 | |
| reflect conservative values and needs of our kind residents. | 01:09:59 | |
| I would like to say there's more, but I want to add a little personality to this. I wasn't going to, but I'm going to. | 01:10:06 | |
| My husband works in Denver. | 01:10:13 | |
| Every day. He is also a veteran. He served our country. I'm not using that as a crutch to get sympathy from for any of you to do | 01:10:15 | |
| anything. What I'm saying is he comes home to Wall County and he feels safer. | 01:10:22 | |
| Are not going to Denver. He wishes that his employment would allow him to not have to do that, or to allow us to, you know, go | 01:10:29 | |
| somewhere while camping where we do feel safer. I ask you to seriously consider. | 01:10:36 | |
| Taking some form of action for we the people that you're solidifying saying that while county is not going to become sanctuary. | 01:10:43 | |
| Thank you. Thank you. | 01:10:48 | |
| Everybody else have public comment this morning. | 01:10:54 | |
| Good morning, ma'am. | 01:11:00 | |
| State your name and address. Summit to town Colorado. I will try to control myself because I feel very passionate about this and | 01:11:06 | |
| I'm quite disgusted that you do not acknowledge the resolution for anti sanctuary status. | 01:11:14 | |
| As a form of action, as several other cities are already implementing. | 01:11:22 | |
| So to say first, that is not affirmative action. | 01:11:30 | |
| 2nd that you think the sale has the power to enforce a non camping band. | 01:11:33 | |
| To protect this county is ridiculous. | 01:11:40 | |
| They dropped by 4 buses. Anybody doesn't know this? Four buses are going as a golden crowd. | 01:11:44 | |
| What happened to those people? Where are they? Cable put a strain on one schools. Schools are basically data for children that | 01:11:51 | |
| don't speak English only. They'll be here, they'll be in the schools, they'll be overcrowding. The what is happening in other | 01:11:57 | |
| cities is the children are not receiving their education they deserve. | 01:12:03 | |
| Because of the situation. | 01:12:10 | |
| Second, what about sheltering when we show up? OK, they can't camp. What are you going to do with them? | 01:12:12 | |
| So it's gonna let you know we can't camp here. Never mind. | 01:12:21 | |
| They're dropping them off by the busloads. It's going to continue. Are you saying we never said for a century that has no power at | 01:12:24 | |
| all? | 01:12:28 | |
| It's going to financially impact everyone in this county. | 01:12:32 | |
| For many, many ways, it's going to have dire consequences if you do not stand up for the citizen of Weld County. | 01:12:36 | |
| Which effects? All of our entire state. I have children here, our grandchildren here. We spend plenty of money. | 01:12:44 | |
| They should be depend on what happens here. | 01:12:50 | |
| This is a severe problem. There are ones with dire consequences if you do not take action personally and for the citizens. | 01:12:55 | |
| Thank you. Thank you. | 01:13:03 | |
| Somebody else have public comment? | 01:13:09 | |
| Good morning. Just remember, state your name and address please. | 01:13:20 | |
| My name is Bobby showing 2885 42nd Ave. and it's not a platform or discussion piece. It's more of a question to you guys. My | 01:13:24 | |
| concern today was that I wanted to see us take a bold stance on the illegal immigration issue like we did with Covad. | 01:13:32 | |
| And I think everybody commended you. | 01:13:39 | |
| Over and over for the bird stance you took, that was the opposite of what Denver was doing in the county South of us. We were very | 01:13:42 | |
| anti enforcing of masks. We kept our businesses open and we really appreciated the commissioner standing behind us and taking that | 01:13:50 | |
| stance because it wasn't a popular opinion with Colorado in in poll. So my question today is why are we not doing the, you know, | 01:13:57 | |
| not taking action on the immigration when we weren't not taking action on the COVID? | 01:14:04 | |
| I guess I just don't understand the difference. So if we could maybe understand that there would be more people that understood | 01:14:12 | |
| why we're not taking an inaction with this revolution and making it and making it go away. That was really my question here, the | 01:14:17 | |
| difference. Thank you. Thank you. | 01:14:22 | |
| Any other public comment? | 01:14:31 | |
| Good morning. Please remember state your name and address. Good morning, Commissioners. For the record, Steven Grant. | 01:14:36 | |
| 2405 Dr. Evans Co. | 01:14:49 | |
| 22 year old, 22 year Greeley, resident senior pastor of Destiny Christian Center and also author of the book Fixing Immigration. | 01:14:53 | |
| In today's meeting, item number 10 was to pass a resolution expressing support for the University of Northern Colorado. It says | 01:15:02 | |
| nothing. It does nothing. | 01:15:08 | |
| You're disingenuous in your approach. Everything begins with words. Everything begins with resolve. | 01:15:14 | |
| Or else, what county will become the place where morals come to die? | 01:15:21 | |
| Now as such, Jesus Christ said, by your words you shall be justified, and by your words you shall be condemned. It all begins with | 01:15:26 | |
| words. | 01:15:30 | |
| And then moves to action. | 01:15:34 | |
| With that in mind, I have documentation as a pastor where I have been invited to meetings to take care of these refugees with | 01:15:37 | |
| Lutheran Family Services and other organizations that are operating right now. I have a an e-mail dated October 1st. | 01:15:45 | |
| Of 2023 dealing with that. They're here, they're coming. They will be quietly washed. | 01:15:54 | |
| Through all your Family Services and all of the things that are going on and for you to quietly say we're not going to do | 01:16:01 | |
| anything. | 01:16:05 | |
| As representatives of We the People is disingenuous. This is a different season. You see yourselves as an extension of state | 01:16:09 | |
| government, but your home rule, you're actually elected by us. We are we the People. It's not tyranny to impose and enforce the | 01:16:15 | |
| doctrine of the Western magistrates. | 01:16:22 | |
| It is actually integrated is that which created the Bank of Cardiff, the Declaration of Independence and other items. We as well | 01:16:28 | |
| county have a responsibility to stand against what is going on in the larger context of things, whether it is abortion, | 01:16:35 | |
| immigration, Human Services, public services. | 01:16:42 | |
| It's fun to spend other people's money, but it's always OPM opium. | 01:16:49 | |
| And we don't want you spending our money, our time, our taxes, and we don't want you. | 01:16:54 | |
| Saying in God we trust and then not living it. | 01:17:00 | |
| It's up behind you and you need to pay attention to that. I urge you to reconsider your actions today when it comes to this | 01:17:05 | |
| resolution. | 01:17:09 | |
| Thank you. Thank you. | 01:17:13 | |
| Good morning. | 01:17:19 | |
| I just take your name and address for the record. Thank you. OK. Bob Ricci, Greeley Co. | 01:17:24 | |
| I think we got a lot of lip service for Mr. Scott this morning. | 01:17:31 | |
| That try to make his appointment or his opinion that you guys can't do something. It's time for you guys to stand up. | 01:17:35 | |
| And take charge of this issue. | 01:17:44 | |
| And do something to protect your people in this county. | 01:17:47 | |
| And I don't see that. | 01:17:52 | |
| All you have to do is make resolution to take care of your US. | 01:17:54 | |
| But you don't care about us. Everything here, it seems to appear to me. You're worried about worrying about your fancy words, what | 01:17:58 | |
| you can spin just like any other politician. | 01:18:04 | |
| And it gets tiresome to sit back in the back and watch what you guys are doing to this county. | 01:18:11 | |
| Because you want to take a stance. We have two people in this up here that took a better stance to the guys that should have. | 01:18:18 | |
| And I appreciate what you've done for us. | 01:18:26 | |
| Because we got three that don't care about the substance of this county. | 01:18:28 | |
| And lives will be on. Their bloodshed will be on you. | 01:18:34 | |
| When things start happening. | 01:18:39 | |
| So what's going to happen? | 01:18:41 | |
| And you're the closet, everyone of you guys. | 01:18:45 | |
| Except for two. And I appreciate Miss Day and Lori for what they've done and thank you. | 01:18:50 | |
| Sorry, you forgot to take your address. Do you mind giving that for the record? | 01:18:59 | |
| And if anybody is speaking, we ask that you sign in to the sheet. It is a process. So we got to have record of who is speaking | 01:19:03 | |
| today. | 01:19:07 | |
| Any other public comment? | 01:19:12 | |
| Yes, ma'am. Come on up. | 01:19:14 | |
| Good morning. I'm Piano Evans, 4170 County Road 49. | 01:19:26 | |
| Hudson, Co. | 01:19:31 | |
| I just want to tell you that an incident I came across last week. | 01:19:34 | |
| Suddenly I think she's 74 year old. | 01:19:40 | |
| Woman was talking to me. I was in my friends business in Kingsburg and she was homeless, an experience she had at Q Soopers. | 01:19:43 | |
| In Brighton, which is 2 blocks away from White County on 50th. | 01:19:53 | |
| She was bringing out her groceries from the grocery store. | 01:20:01 | |
| And she was surrounded. | 01:20:04 | |
| By several. | 01:20:07 | |
| Illegals and they were taking the groceries out of her cart. | 01:20:11 | |
| That's a safety issue. It's not a moral issue. It's a safety issue for a 73 year old woman. | 01:20:16 | |
| And we're going to have more and more of that if we don't take a stand on it. | 01:20:22 | |
| That's that's all I wanted to let you know is that little story there and it was two blocks away from Royal County. | 01:20:26 | |
| It was right there at the county line. | 01:20:35 | |
| So we can walk over into Web county. | 01:20:37 | |
| Thank you. | 01:20:42 | |
| Everybody else had public comment this morning. | 01:20:45 | |
