| the agenda. Mr. Chair, I move to instate public comment. | 00:07:12 | |
| There is a motion on the floor for reinstatement of public comment from commissioner saying second by Commissioner Buck. | 00:07:20 | |
| And that is to, I guess, amend the agenda. | 00:07:30 | |
| During the public comments section. | 00:07:35 | |
| Any discussion on this? | 00:07:38 | |
| Mr. James. Thank you, Mr. Chair. | 00:07:43 | |
| I've done nothing but thought about this for the last week. | 00:07:46 | |
| And have gone back and forth with myself in a principle. | 00:07:50 | |
| I am, of all people on this Board of County Commissioners, has certainly taken full advantage of my pushed Amendment rights. | 00:07:55 | |
| To make a statement. We are not statutorily bound to provide public comments in this meeting only on matters that are before us in | 00:08:00 | |
| a legislative, quasi judicial manner. | 00:08:05 | |
| But just because. | 00:08:11 | |
| It's legal. Don't make it right. I've said that a lot through my my lifetime in public service. | 00:08:13 | |
| I have sat as a planning commissioner, as a member of a town council, as a mayor and now as a second term county commissioner. | 00:08:20 | |
| And have by and large seen an absolute lack of involvement in public comments. | 00:08:27 | |
| Occasionally other from kind concerned citizens who come to me and talk to me about things that are not necessarily my purview. | 00:08:33 | |
| But I do think of those folks when I represent this county on matters of transportation. | 00:08:40 | |
| They're in the in the back of my head. | 00:08:45 | |
| To make an analogy last night. | 00:08:48 | |
| This morning actually at about 12:15. | 00:08:52 | |
| House Bill 24/12/92 came out of committee on party line votes. | 00:08:54 | |
| Extreme left. | 00:09:00 | |
| Democrats Epps and Hernandez introduced a piece of legislation. | 00:09:01 | |
| That more or less severely infringes our Second Amendment rights. | 00:09:06 | |
| And a lot of us were there testifying that it was wrong. | 00:09:12 | |
| And many of us will say, you know, I included, have a concealed carry permit signed by our sheriff. I am a responsible gun owner. | 00:09:15 | |
| I responsibly exercise my Second Amendment rights. | 00:09:21 | |
| And by and large, I am with the majority. By and large, we responsibly exercise our First Amendment rights. | 00:09:28 | |
| And I can say that in my entire time as public, as a public servant, I've seen people respectfully do that. | 00:09:36 | |
| Over the last couple of years, I've watched the political circus come to town. | 00:09:44 | |
| It has been a misuse. | 00:09:47 | |
| Of the 1st Amendment right, but it's not illegal. | 00:09:49 | |
| And for the same principle that we. | 00:09:52 | |
| Not deny people their Second Amendment right because the actions of a very, very, very small few we need. | 00:09:55 | |
| Deny people the exercise of their First Amendment right, whether it's legally bound or not. | 00:10:04 | |
| Because of the actions of a very very very small view. | 00:10:09 | |
| So therefore, I will be supportive of the motion to amend this agenda. | 00:10:13 | |
| And would ask that we put together a work session to talk about public comment as we move forward. | 00:10:19 | |
| All right. The only comments that I would have Mr. James is the the conversation we had yesterday that you think it's much better | 00:10:24 | |
| position to do town hall meetings and we're scheduled them now for every two weeks because it's a much more appropriate place to | 00:10:31 | |
| have public comment than a three minute, 3 minute comments during our business meeting. And I agree with you on that and I support | 00:10:39 | |
| you on that. That's why I don't think that it's necessary that we actually have those in our business meetings. | 00:10:46 | |
| I agree. I don't think it has to be an either or thing. | 00:10:54 | |
| Be an Ant thing. And that's just the position I've come to, Commissioner Franklin. | 00:10:57 | |
| All right. Any other discussion on this matter? | 00:11:04 | |
| All right. Hearing none, roll call vote please. | 00:11:08 | |
| No. | 00:11:13 | |
| I can't hear you. I'm sorry, No. Scott James. Yes. Roy saying Yes. Harry back. Yes, Kevin Ross. Yes. Let the record reflect that | 00:11:16 | |
| the amendment to the agenda has passed 4:00 to 1:00. | 00:11:22 | |
| Public comment will be reinstated. | 00:11:31 | |
| Mr. James. | 00:11:33 | |
| I believe that our charter says that a mask must pass by 2/3, meaning it must receive 4 positive votes. | 00:11:35 | |
| And it did for the one. | 00:11:41 | |
| Now give it 3:00 to 2:00. | 00:11:44 | |
| I thought I said yes. Did you say yes? Yeah, so that would be for the one in my towns. You're a better counter than I am. | 00:11:47 | |
| Mr. Chair, I moved to add a resolution to the agenda. I asked for this to be put on the agenda earlier, but to join the Douglas | 00:11:56 | |
| County Commissioners in the lawsuit against Bill 191124 and Hospital 2311 Hundred, which basically handcuffs our Sheriff from | 00:12:04 | |
| cooperating with ICE is central to this conversation about sanctuary counties. | 00:12:11 | |
| Marriage that want to have standing in this. This is what Douglas County is also doing, is marriage have standing. They're asking | 00:12:20 | |
| other web counties to join them in this lawsuit. I believe this is important because the answer we said yesterday that we will do | 00:12:24 | |
| nothing is not leadership. | 00:12:29 | |
| Asked for a yes vote to add this to the agenda. | 00:12:34 | |
| I don't know where you're saying the commissioner said we would do nothing. I believe we had a work session regarding our | 00:12:39 | |
| consideration of resolutions, proclamations or statements from the board yesterday and the board is continuing to work on that as | 00:12:44 | |
| we come to some sort of agreement on what the board will put forth, Commissioner saying so I don't think that's accurate in your | 00:12:50 | |
| statement at the board said or anywhere indicated they were doing nothing. There was a response. Illegals are dropped off. We will | 00:12:56 | |
| do nothing. | 00:13:02 | |
| That's in a public work session. | 00:13:08 | |
| So the only way the motion on the floor from Commissioner saying to add this resolution from Douglas County to our agenda. | 00:13:11 | |
| Do you have a comment, Mr. Freeman? The only thing that I was going to say is I I think it's I I will not be supporting this. Our | 00:13:20 | |
| County Attorney says we do not have standing and it will be dismissed. And I don't think it makes sense to spend low county tax | 00:13:25 | |
| member money on something that we know will not be successful. So I can't be supportive of this. | 00:13:31 | |
| And I felt like the work session was good, but I don't think we had a end. | 00:13:39 | |
| End all decision. I think it was something that we were going to pursue whether it was some form of a proclamation that we are not | 00:13:46 | |
| the sanctuary. So I don't think this is again I I'm. | 00:13:53 | |
| Given something that I. | 00:14:01 | |
| Need to agree on, but we haven't discussed so I just. I can't go there. Well, I have asked what their work session with the | 00:14:03 | |
| sheriff since that was the request by the four of you. So hopefully we'll get that scheduled soon Regarding this issue and the | 00:14:09 | |
| sanctuary county issue. And I appreciate you reaching out to you have a motion on the floor. Is there a second? The second should | 00:14:15 | |
| you're correct. Commissioner James thank you for correcting me. Is there a second on the floor to add this to the agenda? | 00:14:22 | |
| OK, this motion dies with no second any other amendments to today's agenda? | 00:14:29 | |
| All right. Approval of consent agenda. | 00:14:35 | |
| Any other any evidence of promotion? Thank you. Motion by Commissioner James for approval of consent agenda. | 00:14:39 | |
| Do I have a second? | 00:14:46 | |
| Second motion by Commissioner Freeman for approval. Second by Commissioner Freeman on the approval. Any further discussion, All | 00:14:48 | |

| The amount is for $12,000. There was additional money made available by CDPHE. We submitted a request for additional $12,000 for | 00:20:35 | |
| training purposes. So this amendment would provide that additional funding and allow our staff to take advantage of it through | 00:20:42 | |
| training. This was submitted to the Board on the past round dated February 26th of this year and I recommend that the Board | 00:20:48 | |

| Contract ID 7907 Regulatory online Training and testing agreement for Proctor and food safety certifications and authorized share | 00:21:20 | |
| to sign State Food Safety Jason. | 00:21:27 | |
| Thank you, Sir. This is a contract with state food safety. I just want to point out that's a private company. It's not a | 00:21:34 | |
| governmental organization. They provide training. In this case, it's training for certified food protection managers. Change. An | 00:21:40 | |
| upcoming change in state law is going to require that the individual in charge at all times for regulated food establishment be a | 00:21:46 | |
| certified food protection manager. | 00:21:52 | |
| That's going to create additional demand for this training. This contract would allow our department to act as a Proctor so | 00:21:59 | |
| individuals that need that training can go online, take the class and come to our department to have the exam proctored. This is | 00:22:06 | |
| an effort just to assist the regulated community and compliance. There's no funding associated with the agreement. It will take a | 00:22:12 | |
| bit of staff time on our part and negligible amount of staff time. | 00:22:19 | |
| But again, I think it's a good service to provide the regulated community to allow them to comply in an easier manner. This was | 00:22:26 | |
| submitted to the board on a passed around February 29th of this year, and I recommend that the board approve this agreement with | 00:22:32 | |
| state Food Safety. | 00:22:37 | |
| Any questions for Jason? | 00:22:44 | |
| Motion by Commissioner saying for approval of contract ID 7907, second by Commissioner, about further discussion. | 00:22:46 | |
| And then all those in favor signify by saying aye aye, all opposed. Same sign contract ID 7907 passes 5 to 0. | 00:22:53 | |
| Item number seven, consider Contract ID 7908 Authorization form for Certification of Access Managers, Medicare and Medicaid | 00:23:02 | |
| Services, CMS and authorized Chair to sign Centers for Medicare Medicaid Jason. So this item we seek the boards the chair | 00:23:09 | |
| signature on authorization form to allow our staff to. | 00:23:17 | |
| Register medical providers. Those are our nurses nurse practitioners with Centers for Medicare and Medicaid. This will allow us | 00:23:26 | |
| to. | 00:23:29 | |
| Bill, Medicare, Medicaid for allowable services, the limited amount of services that we provide. We're not expanding services | 00:23:35 | |
| through this agreement. It just allows us to. | 00:23:39 | |
| Capture or to bill for services providing of course those those receipts offset county funding, so. | 00:23:45 | |
| Again, this agreement allows if the Chair is the more increase this agreement, it allows our staff to register our providers with | 00:23:56 | |
| Medicare and Medicaid. This was submitted to the Board on the pass around dated February 22nd of this year and I recommend that | 00:24:02 | |
| the Board approve Chair to sign this authorization form. | 00:24:08 | |
| Excellent. Any questions for Jason? | 00:24:15 | |
| Motion by Commissioner saying the approval of contract ID 7908 second by Commissioner about further discussion. | 00:24:19 | |
| All right. Hearing none. All in favor. Signify by saying aye, all opposed. Same sign and contract. ID 7908 passes 5 to 0. Thank | 00:24:24 | |
| you. Thank you, Jason. Can you send a contract ID 7946 renewal #2 up to the proposed proposal of insurance for unmanned Aircraft | 00:24:31 | |
| systems drones and authorized chair to sign Arthur J Gallagher, Risk Management Services, LLC. Good morning, Michelle. Good | 00:24:38 | |
| morning, commissioners. Michelle Raymer, Human resources. | 00:24:45 | |
| We are requesting that the Commissioner Chair signed the authorization to bind this continuous drone coverage. | 00:24:53 | |
| For the upcoming term. | 00:25:01 | |
| Question. Yes, ma'am. So this is a company that specializes just in the ground insurance, yes. | 00:25:04 | |
| The UAS title that he had just mentioned on the is the company that is the offers the insurance coverage. What an amazing | 00:25:12 | |
| specialized world that is. I moved over. | 00:25:18 | |
| Motion by Commissioner saying second by Commissioner James for approval. Any further discussion. | 00:25:26 | |
| All right, hearing none, all those in favor signify by saying aye. All opposed. Save sign and contract ID 7946 passes 5 to 0. | 00:25:31 | |
| Thanks, Michelle. | 00:25:36 | |
| Item number 9 Consider temporary closure of County Road 72 between County Roads 31 and 33. Good morning, Amy. | 00:25:42 | |
| Good morning, commissioners. Amy Machi, Public Works, presenting on behalf of Connell Resources and N Weld County Water District. | 00:25:49 | |
| This is our final crossing. | 00:25:54 | |
| For the containers of the Eaton water line. | 00:26:00 | |
| For a 48 inch casing pipe. | 00:26:03 | |
| They're asking this closure to begin on March 25th and go through April 1st. | 00:26:06 | |
| Detour route is paved except for one mile gravel, which will be treated with water as needed for dust. | 00:26:12 | |
| Any questions for Amy? | 00:26:17 | |
| Move to proof second motion by Commissioner saying for approval of the temporary closure signed by Commissioner Buck for further | 00:26:18 | |
| discussion. | 00:26:22 | |
| Hearing none, all those in favor signify by saying aye, aye, all opposed. Same sign and a temporary closure of County Road 72 | 00:26:25 | |
| between County roads 31 and 33 passes unanimously. This brings us to public comment. Does anybody have public comment this | 00:26:31 | |
| morning? Mr. Teams, please go forward. | 00:26:36 | |
| If you don't mind, just state your name and address for the record, Sir. | 00:26:42 | |
| Mr. Keith, I'm so happy to see you. | 00:26:52 | |
| What's that? So happy to see you. Yeah, I would have been here last week, but we had that a nice little. | 00:26:54 | |
| Storm at my age and get little. | 00:27:02 | |
| Trying to bring a wimp. | 00:27:07 | |
| Anyway. | 00:27:11 | |
| Yeah. Anyway, my name is Steve Teats. I'm in Greeley. | 00:27:14 | |
| And. | 00:27:17 | |
| I I try to make it as short as possible here. OK, I'd like to talk about first of all, what I saw on Sunday out after church. | 00:27:20 | |
| One of the brothers took took me to where I need to go after church. | 00:27:32 | |
| The way we went, we saw. | 00:27:39 | |
| Three people walking down the street. | 00:27:42 | |
| And they had a lot of, well, their belongings. | 00:27:45 | |
| And they were homeless. And they aren't from this country. | 00:27:50 | |
| And. | 00:27:57 | |
| And we have resources that are in for our own very shallow and. | 00:27:59 | |
| And also to that. | 00:28:06 | |
| They're migrating from Denver. | 00:28:09 | |
| And this you mentioned the sanctuary county or state? | 00:28:13 | |
| I think we should and we can look at what's happening in Denver. We can California, Los Angeles, New York or whatever. | 00:28:19 | |
| And I think the House bill, whatever you mentioned. | 00:28:28 | |
| Something states gone. | 00:28:33 | |
| Wacko. | 00:28:36 | |
| Anyway, the person that was taking me made a comment too that. | 00:28:39 | |
| We can't even take care of them and how can we take care of others? | 00:28:45 | |
| So anyway. | 00:28:49 | |
| So that's my concern, as you know, anyway. | 00:28:52 | |
| And more and more people around residents around Greeley, Evans and whoever else in the state in this northern area. | 00:28:58 | |
| I know Greeley is attempting to do something. | 00:29:09 | |
| And. | 00:29:12 | |
| And I was at Greeley and I got out earlier, so I went to Evans 'cause I had something to do there as well, City Council. | 00:29:14 | |
| And afterwards I talked to somebody from Evans. | 00:29:23 | |
| No, I would just say in the city of Evans. | 00:29:29 | |
| And we got. | 00:29:31 | |
| Homelessness and all that. | 00:29:34 | |
| But anyway, it's getting out of hand more and more. It's very serious and I wish not just you guys but everybody around here take | 00:29:39 | |
| it seriously. And we do have some. | 00:29:45 | |
| Resources. | 00:29:53 | |
| And if we have to. | 00:29:54 | |
| Do something in fast. | 00:29:57 | |
| Also to I'm with a group called The World as Senior on Disabilities and we're still trying to work on having a nice conference for | 00:29:59 | |
| the conference. | 00:30:04 | |
| About the housing homeless. | 00:30:09 | |
| And also too that we would invite speakers. And I'm the guy that we haven't got it all together yet. But I'm just saying this is | 00:30:11 | |
| getting out of hand. Any worse #2 I don't know if I asked Commissioner James Last time I was here about the. | 00:30:19 | |
| Employ meeting. | 00:30:29 | |
| Of this month a March. Did you sum up for me for it was there was no one action items taken so to speak Steve it was all just the | 00:30:33 | |
| usual reports and but it was just a very very uneventful meeting no action taken. OK thank you and. | 00:30:42 | |
| And one other thing about we were speaking about. | 00:30:53 | |
| Public comment. It's very important. It's our Constitution rights. | 00:30:59 | |
| And I've this book called The Affair was papers are very interesting. | 00:31:04 | |
| And one more I see. | 00:31:10 | |
| That our government, not just. | 00:31:13 | |
| Local. Our federal government is even getting way further away, including our Congress. | 00:31:16 | |
| And we somehow and locally, if this the state, the county and the cities need to, I think they need to read that as well, the | 00:31:22 | |
| Constitution. | 00:31:27 | |
| Because it is. | 00:31:32 | |
| We should have, even though it's your business meeting, but also it's the affairs of the county. | 00:31:35 | |
| As well, and we should have a say into it because we pay a lot of taxes. | 00:31:42 | |
| Taxi, taxi, Taxi. We should be able to communicate. | 00:31:49 | |
| And and we're the ones that, according to our constitution, it's the people who are lost. We govern ourselves through | 00:31:55 | |
| representation if we can't. | 00:32:00 | |
| Have face to face conversation it is 3 minutes 5 minutes or whatever we should be able to have that and so I think that it it | 00:32:04 | |
| needs to be put back on because the City Council will we still have public comment and and also the MPO and various other places | 00:32:12 | |
| I've got. So I would like to back on and I would like to keep my vision of positive about the county commissioners even though we | 00:32:20 | |
| disagree in certain areas. | 00:32:28 | |
| Thank you. Thanks Mr. Teats. And if that's 927 last integer. | 00:32:36 |
