proclamation first? All right. | 00:09:27
Memorial Day is a solemn day of remembrance to honor the memory of our fallen service members and ensure that their sacrifices are | 00:10:09
never forgotten. And whereas the National Moment of Remembrance encourages every American to take a moment, wherever they may be, | 00:10:16
at 3:00 PM local time on Memorial Day, for a moment of silence to remember and honor those who have made the ultimate sacrifice in | 00:10:24
service to our nation. Now, therefore, be a proclaimed by the Board of Well County Commissioners that Monday, May 27th, 2024. | 00:10:31
Be known as Memorial Day. We ask that well county residents come together to express their gratitude and pay tribute to those | 00:10:39
fallen heroes and their surviving families. Signed by all 5 county commissioners. Thank you so much Commissioners Jamie Robert, | 00:10:44
Department of Human Services. | 00:10:50
I would like to take a moment to express our heartfelt gratitude to our World County employees who are currently serving or our | 00:11:30
veterans. We are with you as you reflect on the sacrifices made by your fallen comrades. We also extend our sincere thanks to all | 00:11:36
veterans in our community. With a veteran population of 7.3% in Royal County, we are profoundly aware of the significant presence | 00:11:42
and contributions of veterans among us. Your sacrifices and contributions have not gone unnoticed, and we are deeply grateful for | 00:11:49
your service. | 00:11:55
Memorial Day serves as a powerful reminder of the unity and strength of our nation and our local community. Regardless of our | 00:12:02
differences, we come together to honor those who have fought for our collective freedom and security. I would love to share who's | 00:12:08
here today from for this proclamation. Please when I call your name, please stand up. We have CC Metroski, who is our deputy | 00:12:15
director for employment services. We have Jeff Smith, who's our employment and training operator, and also overseas, our veteran | 00:12:21
service office. | 00:12:28
Charlotte de Broglie is our adult employment and training supervisor. Chris Armstrong is our resource and quality generalist. And | 00:12:35
then we're very honored to have 3 veterans joining us today. | 00:12:41
Our veteran service officer so Tim Marquardt. | 00:12:49
Tom Gonzalez And then joining us from CDLE, the combined veteran employer representative is Rick Welcholz, who is also a veteran. | 00:12:53
So really just want to thank these folks for all the work that they do for veterans in our community, for really supporting | 00:13:01
Memorial Day and honoring the veterans that continue to serve and that have served in the past. So thank you very much. | 00:13:10
Thank you, Mr. Chair, and thanks for the proclamation. It is an honor just to be able to honor those who gave the ultimate | 00:13:25
sacrifice for this great nation. | 00:13:30
I am once again honored to oversee the Sam Audi of Edland Grove which is on Monday the 27th at 9:00 AM. Certainly invite folks to | 00:13:36
come out to the outdoor or just to their their local Memorial Day observance is worth the hour or two of your time over the three | 00:13:42
day weekend to remember why we have a three day weekend. | 00:13:48
And I want to thank those surviving members of the families of a soldier who gave the ultimate sacrifice. Excellent. Miss Muck, I | 00:13:54
do know there are several events that are going on, but I think for the last 20 years I have not missed that Monday morning in | 00:14:02
Lynn Grove as a lot of my family members are buried there, as well as the soldiers of my family. So I will absolutely take that | 00:14:10
moment, take that time to pray for all the surviving families and remember. | 00:14:18
Freedom is not free. | 00:14:27
Thank you, Mr. Friedman. So I just want to thank all of you out in the audience that are veterans. Luckily you're surviving | 00:14:29
veterans, but the veterans and and the ones that we've lost, the reason the United States of America is is the United States of | 00:14:36
America is because of our because of the people that fought to make this country what it is today. And so I just thank you and and | 00:14:43
obviously take some time to observe that on Memorial Day, just see. | 00:14:50
And I just want to also thank you as well. And, and you know, remember the sacrifice of the veterans who who gave it all for us | 00:14:58
and, and so that we can live in peace and prosperity, but also the Gold Star families, they have to live with that loss. | 00:15:07
It was very moving, especially to be in those ceremonies with the Gold Star Mothers and recognizing their sons and reading their | 00:15:20
story out loud meant the world to them at the statehouse. I do hope they keep that tradition and. | 00:15:27
Everyone makes it come alive for people the the the depth of the sacrifice and. | 00:15:34
These were these were men that could have had families, they could have had a future. They could have any sacrificed all of it for | 00:15:43
us so that we could have a future and we could have families and grandchildren. So again, I just think everyone in. | 00:15:49
It's it's an honor to be on this proclamation. | 00:15:57
I'd just like to extend a sincere thank you to all of our veterans, their families, their loved ones. It's it's an honor that you | 00:16:03
served us and I'm grateful for it. Had the pleasure of being at Arlington National Cemetery many years for this holiday and it | 00:16:10
really rings home the sacrifice that those individuals make on our behalf and. | 00:16:18
Seeing the ceremony soldier or the unknown soldier? Excuse me. | 00:16:27
And then seeing the flags at each and every grave. | 00:16:33

Item number 17 First reading of Code Ordinance 20/24/09 in the matter of repealing and re enacting with amendments. Chapter 21, | 00:38:35
Areas and Activities of state interest of the Weld County Code 1041 Roebuck Code changes. | 00:38:41
Morning, Jason. | 00:38:52
Good morning. | 00:38:55
Good morning, commissioners. Jason Maxey, director for the Well County Oil and Gas Energy Department, thank you for the | 00:39:00
opportunity to present to you this morning these proposed 1041 Rogler code changes at first reading #1 I'd like to start off by | 00:39:06
thanking my entire staff. Kelly, Jennifer, Stephanie. | 00:39:12
Elisa, Rebecca and Rob for all their help internally in all the meetings and discussions we've had to bring these code changes | 00:39:19
before you. In addition, I'd like to thank County Attorney Bruce Parker, Deputy County Attorney Kerry McDougal and Assistant | 00:39:25
County Attorney Matt Conroy with their assistance with these changes. | 00:39:31
And lastly, the collaboration with other departments including Public Works. So Curtis and Dwayne are planning being a whole bunch | 00:39:38
of people, Elizabeth, Don, Natalie, Laura, Jasmine and environment, Environmental health, excuse me, with Ryan Fernandez was not | 00:39:45
only helpful, but I think that you all would agree that whenever code changes that affect multiple departments happen that you | 00:39:53
know this is a necessary process. And so I appreciate their input into these code changes. | 00:40:00
Over many months with discussion at multiple quarterly oil and gas working group meetings, specific small and large group | 00:40:37
stakeholder meetings which happened on February 8th and February 22nd of this year. Sending the proposed code changes to the | 00:40:45
industry in at early April, which was also when the Board of County Commissioners got the code changes in preparation for our work | 00:40:53
session on April 29th and communicating when the code will be heard here at the commissioner meeting. | 00:41:00
Anybody have any questions for Jason? | 00:42:13
Did it clean up for AG rule and near Earth? Is that a cleanup or an AD? That is a cleanup commissioner. So currently we have a map | 00:42:17
Appendix 21B which is a map and that map technically should be updated on a yearly basis due to annexation's the municipalities | 00:42:24
may or may not do because that boundary can shift. The cleanup is taking that map that needs to be updated and simply putting the | 00:42:31
map what it represents. | 00:42:39
Into just language in the code and so we don't have to come back every year to update a map. It just automatically kind of grows | 00:42:46
per the definitions that are now inserted into there. So I would count that as a clean up item that would provide better clarity | 00:42:51
and consistency in the future. | 00:42:56
And then also the regulations regarding odor, I guess that's the other one I need to ask you and what how that falls along with | 00:43:02
what the state is requiring? | 00:43:08
How that follows what the state is requiring similar to the noise? Yeah. Are we more restrictive in the state or less restrictive? | 00:43:16
We are not more restrictive than the state for an odor plan. The language that is added in the in the code before you right now | 00:43:23
for well county simply provides clarity on when an odor plan may be needed. It is not a all the time requirement. So contrary to | 00:43:28
what the state requires where they require something all the time, we do not require it all the time. So we're providing clarity | 00:43:34
on when it might be needed. | 00:43:39
OK, let's just make it easier for oil and gas to umm. | 00:43:45
For long, yes. Development here in Weld County. Or does that make it harder? | 00:43:52
With more regulations, even if it's been self approved by the industry. | 00:43:57
I do not believe this makes it harder. | 00:44:03
I have some questions on that. So I'll probably be a no vote for today and I'll I'll ask some more questions. | 00:44:07
Understood. Any other questions for James? | 00:44:13
This book, I just want to thank you for all the collaboration you have done with all the industry. | 00:44:16
There are all the different departments and certainly your staff. I want to thank you so, so much for the thorough, thoughtful. | 00:44:23
Things that you've done to clean up the ordinance. So thank you. | 00:44:30
Mr. Freeman, the only comment that I would make is that these oil and gas permits, whether we're permitting them or not, the state | 00:44:34
still requires a permit and they require the order on everything. So there's no way that if we say sometimes you need it and | 00:44:39
sometimes you don't, makes it more restrictive on oil and gas department because they still have to meet the state standards, | 00:44:43
right? | 00:44:48 | |
All right, with no further questions from the Board at this moment, this is a public hearing. I will open this up to the public if | 00:45:56
anybody wishes to come forward and speak to any matters regarding Code Ordinance 2024, Dash 09. | 00:46:02
Now is your opportune time to come forward and do such. We just ask that you please come to the podium, state your name and | 00:46:09
address and keep your comments limited to three minutes. Does anybody wish to come forward from the public and make comments? | 00:46:15
OK, I'm going to go ahead and close public comment in regards to Code Ordinance 20/24/09 and I will bring it back to the board for | 00:46:23
consideration. Mr. move to approve on first reading Code Ordinance 2024 Dash 09. I got a motion from Commissioner James for | 00:46:31
approval of Code Ordinance 20/24/09 on first reading, second by Commissioner Freeman. Any further discussion? | 00:46:38
Hearing none. Roll call. Vote please. Mike Freeman, Yes. Scott James, Yes. What are you saying? Payback. Yes. Kevin Ross Yes. Let | 00:46:47
the record reflect that code Ordinance 2409 passes 4 to one on first reading with commissioner saying voting no. | 00:46:56

Does anybody wish to speak to the board? Public comment today. | 00:53:05
Good morning. Morning, Commissioners. Thank you for letting me speak. | 00:53:13
John Miles, B 7557 Grove County Road 100 and. | 00:53:18
I apologize. I wasn't here a little bit earlier, but I wondered if there had been any resolutions or any change with the EPA and | 00:53:26
affecting rubber Land nursery over Eastern Milliken, if there's been any action taken on that. | 00:53:34
John, there was a number vote against the resolution that I proposed on Monday. I'll be working on another one for next Monday | 00:53:42
because I think we should not let this rest we are if we declared a gun laws or unconstitutional based on the federal | 00:53:49
Constitution, we can do the same for the actions of the EPA and what they're doing. | 00:53:55
To our farmers and land owners and we should not stand out and let that happen. | 00:54:02
We're supporting this bill and most highly suspicious when I see that because it always ends up an overreach when you get to EPA | 00:54:45
more involved in wetlands and not less. And we see that going on right now with some of this trespassing and with some of these | 00:54:52
these lawsuits directed to exhaust people so they give up their private property rights. And we should not stand by and let that | 00:54:59
happen. I'm going to remind the board we need to be recognized before we speak, please. Donna, do you have any other questions? | 00:55:06
On my way down here, I, you know, live on Road 100 and I passed double J feed lot, some other feed lots, dairies. And what I'm | 00:55:14
concerned about I, I will follow up with Senator Kirkmeyer. What I'm concerned about if they get the, the like a channel getting | 00:55:21
its nose under the tent. | 00:55:28
I can see a lot of problems with. | 00:55:36
Water usage in feedlots, dairies, dust control. I used to when I work for associated vets, I go E at 11 at night, go past the cozy | 00:55:40
feed lot feed lot and I'm in AG and it the dust was bad in the the urine was bad. You know what I mean in the middle of summer, we | 00:55:48
all know why this feed lot of mopper feed lot was taken now because of the ground clouds. So again I'm. | 00:55:57
I'm really concerned that EPA is a dangerous organization for us. And I, I know you guys are all pretty much aware of that. And | 00:56:06
one of the things I'm really concerned about this water usage up in Oregon, they tried to shut down small. | 00:56:15
People that raising gardens and smaller operations because of water usage and and we all know whiskeys for drinking waters for | 00:56:28
fighting. So that's my other concern. One group for three minutes are up. John, I'm sorry we interrupted John. So he should be | 00:56:35
allowed to have his hopeful 3 minutes. | 00:56:42
Before speaking, Mr. Sherry, he should get us for three minutes. He was another. John, can you wrap it up here real quick first, | 00:56:49
if you have another comment, please? Thank you, Sir. I appreciate that. | 00:56:53
I'm still concerned about the three mile radius. I talked to Bob Schneider. Apparently he attended a meeting Monday afternoon. I | 00:57:01
didn't make it. I apologize, but he's confused about that. There's going to be other cities in Raleigh County that's going to have | 00:57:07
the three mile radius and. | 00:57:14
OK, I I have a lot of friends who are within 3 miles of all Percy Severance, Eaton and I just. | 00:57:22
I've tried to call and reach out to some people to just make sure they are kind of in the loop of what this is going to totally | 00:57:30
entail. And one question that I had was well, why doesn't current planning on zoning laws apply? We and we don't need the three | 00:57:36
mile radius. That was one they do apply. Go ahead commissioner. Free State statute says that every municipality in the state of | 00:57:43
Colorado has a three mile growth area. Doesn't change anything. You can't annex it without both the the the municipality and the | 00:57:49
landowner wanting to. | 00:57:55
Agree to that. | 00:58:03
It's just a long range growth area plan and it it it doesn't mean anything. It doesn't change the zone. It doesn't change if | 00:58:04
you're out in that three mile already. If you have something that you want to do, you still, it still goes through well county. It | 00:58:10
doesn't go through the municipality, whether that's eaten or whether that's old. It's just a three mile growth area that's | 00:58:15
required in state statute to put into your map. | 00:58:21
I hope that explains what that is. It's, it's, it's just a, it's just a growth area plan. | 00:58:30
For the future, right, It doesn't change. It doesn't change any of the regulations or rules or zonings of what's in that area. | 00:58:38
Just as planned. It does not say urban growth plan. That's the problem that we're having this. The staff has said in this meeting | 00:58:48
that they want these new CPUs that have more teeth like the old ones, the Igs like the Eaton clan. So they want to replicate the | 00:58:54
eating plan, which does say we will deny non urban uses, which is all the things that you do out there because you don't require | 00:59:00
public water or sewer. | 00:59:06
Troubling. | 00:59:13 | |
So that provision also says, to the extent possible, there's a caveat in there. And also that part of it is an and, and it does | 00:59:18
relate to the first part of the sentence. You're taking it out of context. It does not say what you think it says. And I that's | 00:59:26
true. I disagree with you, Sir. And they're doing it. The fact that some of these business owners are, oh, we are not. | 00:59:35
We have told you repeatedly in public hearings our attorney has corrected you multiple times, yet you continue to bring the | 00:59:44
falsehoods forward about what does CPA with the Town of Eaton does. | 00:59:51
I'm sorry. | 01:00:00 | |
There has been confusion regarding this. No problem. What's the County Attorney is saying is fact. He is legal, right? He has his | 01:00:01
legal degree. None of us on this board have our legal degree, OK. That and in that sentence is extremely important, okay. As he is | 01:00:08
explaining, it refers to the first part, meaning this is not giving the town of Eaton ultimate authority or any town that might | 01:00:16
adopt such ACPA. | 01:00:24
Right in this matter and in fact most of our municipalities already have Cpas with the county and they have their own three mile | 01:00:32
urban growth boundary maps that they recognized inside of their comp plans, right, so that they can do proper planning. That's all | 01:00:39
this is that Eaton did. | 01:00:45
Is a planning map planning tool so that they see things come forward. They can plan for them or make comments to them. That's | 01:00:52
that's the matter of the fact nothing is getting annexed. Nothing changes how people do business in that three mile boundary. It | 01:01:00
is pardon me, it does not change taxing on these entities. They are still in unincorporated well county. Now, John, let's say you | 01:01:07
live in that three mile boundary. | 01:01:14
You would have to choose to be annexed into that town. They can't just come in and annex you. The only way, the only way a town | 01:01:22
municipality could do that is should they surround you on all four sides, then they could in theory. | 01:01:31
Annex you right and and do it without your permission because you'd be considered enclave. Thank you, Mr. Freeman. Right. | 01:01:41
This is nothing. This was simply a planning tool by the City of Eden to do such. So that should answer that question. I appreciate | 01:01:51
that very much. My brother Bill is at 79 and 28 and he thinks he may be within 3 miles of Eaton and three miles of severance and | 01:01:58
I'll have to follow up on. | 01:02:04
Right. Just like I know exactly where your brother lives, right? Yeah, and and he may be in that overlap area. | 01:02:13
And be sure to be happy. Thank you. Have a great day, John. Appreciate it. Is there any other public comment today? | 01:02:56
Hey, with that, I will go ahead and close public comment. We will stand adjourned. It's 956 and we will return here at 10:10 for | 01:03:03
public hearings. | 01:03:08 |
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, | 00:06:39
indivisible, with liberty and justice for all. | 00:06:45

Brings us to proclamations #1 Memorial Day, May 27th, 2024. Good morning, Jamie. Good morning. Do you mind if I read the | 00:09:21
proclamation first? All right.

Good morning, Elizabeth, Good morning commissioners. Elizabeth, planning here to help support public works with your approval for | 00:28:05
a DOLA contract. This pass around was approved by 4 out of the five commissioners for consideration on the Board's agenda. | 00:28:12
To authorize $1,000,000 as part of our Six and 13 roundabout project. This is a contract that would expire April 30th of 2026. The | 00:28:21
county has already secured the right of way for this project. Utility relocations will occur this year. The intent being with an | 00:28:28
executed contract with Dole that you would be able to bid this project out towards the end of this year for selection of a | 00:28:35
contractor next year for construction in 2025. | 00:28:43
It's approximately an $11.7 million project. So this $1,000,000 is obviously helpful in in any form or fashion. So we would ask | 00:28:51
for your support to authorize the contract. | 00:28:56
All right, Anybody have any questions for Elizabeth, Mr. James? Thanks, Elizabeth. Your dogmatic work on the East brings a heck of | 00:29:02
a lot of money into this county and will take their million bucks. And with that we I move to approve with the Contract ID 8231 to | 00:29:10

Item number 8, to consider grant application for competency restoration support services for pre restore and preconnect programs | 00:29:47

Doug, but good morning. | 00:29:57
Doug earlier with a Department of Justice Services. So this matter first came before you as a pass around on May 2nd and | 00:30:04
unanimously approved for placement on your agenda today for final review and authorization to for me to allow me to submit the | 00:30:10
enclosed grant application. To give a brief recap, the application seeks funding approval by the state to the county to assist | 00:30:16
certain criminally charged adult defendants to divert and deflect them from going to the state hospital to complete inpatient | 00:30:22
competency. | 00:30:28 | |
Restoration and instead deliver these services on an outpatient basis. The application comes with the support of our local courts, | 00:30:34
DA and public defenders office and the local forensic navigators team. | 00:30:40
With granted funding, funds will be used to create enhanced pre child supervision of efforts. | 00:30:48
And unique option housing option of identified defendants at our departments work release facility just over the hill here. | 00:30:53
Umm, this will create significantly better public safety and cost savings measures and aid our courts, DA and public defender | 00:31:02
office and a forensic navigators to better handle this challenging defendant population. It should also produce cost savings at | 00:31:08
the main jail where these defendants would no longer have to wait in jail for an inpatient bed to become available at the state | 00:31:14
hospital, which can take literally months to occur. | 00:31:20
These participants will start their competency restoration on an outpatient basis under the collective monitoring of everyone that | 00:31:27
I've listed in our department. The request if if approved will increase FTE in our department by two positions which would be | 00:31:33
fully covered through these grant funds as well as cover indirect costs for ITHR and finance assistance. Our costs are are would | 00:31:40

It's 956 and we will return here at 10:10 for | 01:03:03
public hearings. | 01:03:08 |
