cross-border. | 00:10:41
Moved to place the 10th Amendment Sanctuary on the agenda. | 00:10:47
But it basically says whereas pursuant to the color statue of county home rule charter and our authority and stating that the 10th | 00:10:52
Amendment to the United States Constitution is part of the rights. | 00:10:57
Because our farmers and ranchers for water rights that are undeniably there's a use by rights and we as a board of county | 00:11:37
commissioners have an obligation as a bully pulpit to say this is unconstitutional. We need to stand up for our farmers and | 00:11:42
ranchers. | 00:11:47 | |
And at this time, I would like Miss Sylvester to come up and describe why she's asking us to do this. Not appropriate. If this is | 00:11:53
this is your proof of the agenda. And I'll move the 10th Amendment Sanctuary to the agenda and ask for a second and a yes vote. | 00:12:02
There's a motion from commissioner saying to add her. | 00:12:11
10th Amendment Sanctuary County item to the agenda. Is there a second? | 00:12:15

All right, item number two, present and approve emergency bid B 24,098 2020 4 Steel bid, Structural H pile and Steel strainers, | 00:13:40
Department of Public Works. This bid is for structural steel H pile and still stringers. The low bid is from Technology | 00:13:47
International Incorporated. However, they submitted bid pricing that does not match the quantities that were listed in the | 00:13:54
requirements. The vendor was contacted and agreed this was an error in their submittal. | 00:14:02
Therefore, the error results in incomplete bid. Second low bidder is DBE Manufacturing and meets specifications. Therefore, Public | 00:14:09
Works is recommending the award to DBE Manufacturing in a cost of 100 at a cost of $150,732.40. | 00:14:18
In addition, because steel prices are rapidly changing, DBE can only hold the proposed pricing for 35 days from the bid opening, | 00:14:28
which was June 30th, 20 which is until June 30th, 2024. Because of this short timeline and the need to also establish a contract | 00:14:35
after award, Public Works is requesting emergency approval by waiving the 10 day period as permitted by Wells County Code. | 00:14:43
All right. Is there any questions for Toby regarding this present and approval of the emergency bid? | 00:14:52
Mr. James, Mr. Accepting and agreeing with the recent state of our staff for the emergency I move we approve emergency bid the | 00:14:59

And #3 consider emergency temporary closure of County Road 44 between county roads 45 and 47. Good morning, Amy, Good morning | 00:17:18
Commissioners. Amy Mushy Public Works presenting on behalf of Joe Max construction company and DCP Midstream. | 00:17:26
This section of Rd. was closed on June 6th and remain closed through June 11th. This is due to a section of the road that started | 00:17:35

Finished up and should be paid back tomorrow morning. | 00:17:49
Excellent. Any questions for Amy? | 00:17:54
To approve the resolution. Second, motion by Commissioner James for approval of the temporary emergency closure of County Road 44 | 00:17:56
between County Road 45 and 42nd 47. Excuse me, Second by Commissioner Buck, further discussion. | 00:18:02
Now favor signify by saying aye aye, all opposed same sign. And that emergency temporary closure does pass. Thank you very much. I | 00:18:10
#4 consider temporary closure of County Road 34 between County Road 29 and N Front St. | 00:18:18
Public Works Public Works is requesting this closure to begin on June 24th and go through July 26th. This is for a redeck of | 00:18:27
Bridge 3425-A Mag ride will be utilized on the gravel roads within the detour route. | 00:18:36
Variable message boards will be placed out in advance of the closure. Motion by Commissioner Freeman for approval of the temporary | 00:18:45
closure. County Road 34 between County Road 29 and N Front St. Second by Commissioner James. Any further discussion? | 00:18:52
None. All those in favor signify by saying aye aye. All opposed. Same sign. And that temporary closure of County Road 34 between | 00:19:00
Canada 29 and N Front St. passes 5 to 0. | 00:19:05
Item number 5 Consider extension of temporary closure of County Road 4 between County Roads 41 and 45. | 00:19:11
Public Works is requesting the original closure that was approved to be extended from 6:14. | 00:19:17
Through 6/21. | 00:19:26
Umm, the reason for the additional time is for the second bridge redeck. Umm, more stabilization and elevation due to some | 00:19:29
settling that wasn't realized in the beginning was needed in order to complete this bridge redeck. | 00:19:36
All right. Any further questions for me on this? | 00:19:45
Move to approve second motion by Commissioner Freeman for approval of the extension of the temporary closure County report between | 00:19:48
County Roads 4145 signed by Commissioner James. Further discussion. | 00:19:53
And all those in favor signify by saying aye aye, all opposed same sign. And that extension of temporary closure passes 5 to 0. | 00:19:59
Thank you and. | 00:20:03
Number six, consider them in the bylaws for 401K savings plan and 457 deferred compensation plan. Judiciary Committee and | 00:20:09
authorized Department of Finance to sign. Good morning Commissioner Cheryl Patelli, finance. This changes the members of the 401K | 00:20:15
and 457 committee. | 00:20:22
Since the Director of Finance and Administration position was split, we are now replacing that position on this committee with the | 00:20:28
Controller. | 00:20:32 | |
All right. Anybody any questions for Cheryl on those? | 00:20:38
Yes, the last page says that the the chair looks like I have to get back on that page committee chair where his or her delegate | 00:20:42
may revise bylaws anytime in his her sole discretion. That seems like a pretty broad power now that I'm reading that. | 00:20:50
Can we strike that? | 00:21:00
And have that replaced by the committee, a vote of the committee majority. I don't have a problem with that, OK. | 00:21:02
You guys agree to that? | 00:21:09
I'm not making a limit. Well, this is a pretty big plan. You don't want one person just making a decision at his rehearsal | 00:21:11
discretion. So if Cheryl has no problem, I'd like to amend this to have a majority of vote of the entire committee on that last, | 00:21:16
that very last line on page 4. | 00:21:22
I'm looking at the County Attorney. | 00:21:29
I mean, you could probably do that, but I would need to set that through. | 00:21:36
Our advisors on the retirement and on that plan, I don't know if it's a requirement. | 00:21:45
Mr. James. | 00:21:52 | |
I agree with the Commissioner Shane Settlement. I'd like to the County Attorney to have a couple of minutes to look at it. So | 00:21:54
therefore I move that we continue this matter until Wednesday, the 12th of June at 9:00 AM. Second, thank you very much. All | 00:21:59
right. | 00:22:04 | |
My motion for continuance till June, did you say 12th? Yeah, whatever Wednesday is to at 9:00 AM signed by Commissioner saying | 00:22:09
further discussion. | 00:22:15
None. All those in favor of the continuance till June 12th at 9:00 AM signify by saying aye aye. All opposed same sign and that | 00:22:22
item carries for continuance till June 12th 5 to 0. | 00:22:28
Item number seven, consider 4th amendment to office lease agreement 822 7th St. Greeley and authorized chair to sign JP Chase, JP | 00:22:36
Morgan Chase Bank National Association chairman. This is the 4th amendment to the lease for Chase Bank. | 00:22:45
At the Chase building occupying that space downstairs on the 1st floor, it would take it through the time frame of they would they | 00:22:54
would have the ability to have some consecutive five year terms that would go from 2024 through 20/29/2020, nine through 2034 and | 00:23:05
2034 through 2039 at the rates that are put in. | 00:23:15
On page I believe it's. | 00:23:26
Three, two or three, so under #10. | 00:23:28
This is consistent with the Second Amendment that was done prior to the. | 00:23:34
County buying the property. | 00:23:42
And so they were allowed to go through 2039 if they so choose. The rates that are there reflect. | 00:23:46
Pretty much almost exactly what was in that Second Amendment. | 00:23:57
Any further questions for Bruce? | 00:24:05
Move to approve the resolution. Motion by Commissioner James for approval of the resolution second by Commissioner Freeman. | 00:24:07
Further discussion. | 00:24:11
Hearing none, all those in favor signify by saying aye aye. All opposed. Same sign and the 4th amendment to the office lease | 00:24:16
agreement for JP Morgan Chase Bank National Association passes 5 to 0. Item number 8. Consider recommendation for appointment of | 00:24:24
Scott K James to Greeleywell County Housing Authority. Move to approve second motion by Commissioner Freeman to approve Scott | 00:24:31
James to the Greeley Well County Housing Authority. Second by Commissioner Buck. Further discussion. | 00:24:39
Some questions, Mr. Chair, I had questions and ask. The resolution does not say what the makeup of the rest of that board is. | 00:24:47
Do we know what to make of the rest of the board is? | 00:24:56
I sure do. I don't. Go ahead, Mr. James. Bylaws may indicate what the makeup is. We have 4 appointments, two appointments, two | 00:25:00
appointments. OK, well, kind of has two appointments to the agreeable Housing Authority. One individual had resigned. I believe | 00:25:05
that. | 00:25:11 | |
The really world Housing Authority present prevents tremendous opportunity than the affordable housing space. Nothing in the | 00:25:18
bylaws, nothing in our code or ordinance, it prohibits me from from serving on that board. As somebody who works in that space and | 00:25:24
closely with DHS everyday, I believe it's a prudent to talk with me quite frankly and so therefore it has for your support. | 00:25:29
Further questions? | 00:25:36
It wasn't whether you can or couldn't serve. My question is what the makeup of the board is. And I just am concerned, as I always | 00:25:39
am, if we can have more citizens participate in that space rather than the elected official. | 00:25:45
That would be my preference just because it's really serving them and then making it. I think I'd give preference to somebody who | 00:25:52
is in the community, in that space. So that's why I'm asking for the makeup of the board because honestly, I'm not sure at this | 00:25:59
moment. It's flipped over quite a bit who who's on the Welfare County Authority housing right now. | 00:26:05
They are Julie Anna, the deputy at city attorney. I'm sorry Deputy Greeley administrator had Joanna Kitten. | 00:26:12
So she would be another governmental type. So, so to speak. Everybody else is is individuals. Everybody else is citizens as you | 00:26:23
say and then the innovative citizens I believe and after conversations with agreement Housing Authority with a retirement Tom with | 00:26:30
quite frankly the. | 00:26:36
But what do they call that if they're in they're on the radar of of the feds. I I think it's appropriate as we go through the | 00:26:43
hiring of a new of a new executive director that Weld County have me and I am happy to step aside when we get that new executive | 00:26:51
director hired and when we get that board stabilized and and moving forward in the correct direction. You've made your definitely | 00:26:58
made a great case. I will be supporting this today. | 00:27:05
I will do the motioning and second OK. | 00:27:13
All right. Do we have a motion or second on this here we do any further discussion? | 00:27:18
All right hearing none all in favor signify by saying aye aye. All opposed. Same sign and Scott K James will be appointed to the | 00:27:24
Well County Housing Authority 5 to 0 and #9 consider resolution regarding declaration of disaster emergency and authorized chair | 00:27:31
to sign any necessary documents. Roy Roy. | 00:27:37
Morning Krishna's brother to sell with the office Emergency Management Commissioners. On May 28th there's a severe thunderstorm | 00:27:45
that came through pretty much central Will County. | 00:27:50
From developing, uh, too much, uh, focused in on the, the Greeley area and dropping about four inches of rain in a 2 1/2 hours | 00:27:58
within the last two weeks. The city of Greeley, Johnstown, militant area and the external properties outside of Greeley to the | 00:28:05
east have been filing the damage assessment reports. As of as of this morning, we have 279 properties that have been affected, | 00:28:13
personal properties, businesses or homes and 77 businesses or public infrastructure. | 00:28:20
That has been affected most of that's what the city of Greeley. We have a few, the county has a few roads that were damaged and | 00:28:28
some buildings that were flooded, but not to the extent of what Greeley has seen. With that, we're sitting right about $3.4 | 00:28:34
million in damage from the storm and the. | 00:28:39
The impact of that won't necessarily get us to a federal declaration for any public assistance, that being government facilities, | 00:28:47
but the impact of citizens is pretty steep. | 00:28:52
So the purpose of requesting the disaster declaration is really to support Greeley and the recovery efforts. | 00:28:58
The process is accounting has to sign a disaster declaration to start that support process. And so our request now is coming to | 00:29:05
coming before you this morning to sign the disaster declaration and that'll in part of that process. | 00:29:12
Activate our emergency operations plan and part of that is the recovery annex of that with support and who has role in that is | 00:29:23
Human Services and the health department. I talked to Director Ulrich and I think was on Friday or I'm sorry Wednesday, I guess it | 00:29:30
was after our after our work session and part of the disaster declaration by the board signing that will activate the emergency | 00:29:36
SNAP funds. | 00:29:43 | |
For citizens that may need that. So there's a lot of steps going forward in that. The other thing that we're requesting is that we | 00:29:51
seek assistance from the governor on any support or state support that they could provide on the recovery for citizens as well. | 00:29:57
Excellent word. Any questions for? | 00:30:05
Roy, regarding this matter, I'll move to approve the declaration for disaster emergency and authorized chair to sign any necessary | 00:30:09
documents. Second motion by commissioner saying for approval of the disaster emergency declaration, second by Commissioner Park, | 00:30:15
further discussion hearing none. All those in favor signify by saying aye aye, all opposed, same sign and that item carries 5 to | 00:30:21
0. Thank you, Roy, good luck. | 00:30:27
Item number 10 Second reading of Code Ordinance 2024, Dash 09, in the matter of repealing and reenacting with amendments. Chapter | 00:30:38
21, Areas and Activities of State Interest of the Royal County Code, 1041 World Code changes. | 00:30:45
You want to read by title only. Motion by Commissioner Freeman to read by title only. Second by Commissioner James for the | 00:30:54
discussion. | 00:30:57 | |
Your nose in favor signify by saying aye, aye opposed, same sign and second reading. A code ordinance 20/24/09 passes 5 to 0 for a | 00:31:01
reading by title 2024. | 00:31:07
09 and matter of repealing and reenacting with amendments Chapter 21, Areas and Activities of State Interest of the Royal County | 00:31:12
Code 1041 code changes. | 00:31:18
Good morning, commissioners. Thank you. Jason Maxey, Director for the Oil and Gas Energy Department, Thank you for your | 00:31:25
consideration of these proposed 1041 worldwide code changes at second reading. | 00:31:31
First reading was held on May 22nd and since then. | 00:31:37
Cash and loot payments, et cetera. | 00:32:15
And the last sentence that was added reads as such. For the record, the approval of a CIO, which stands for Cash and move, the | 00:32:18
approvement of a cash in new payment does not relieve the operator of dust control obligations for the high route or repair work | 00:32:24
for damage to county roads which is directly attributed to activities on the oil and gas location. | 00:32:31
Thanks, Jason. This board, have any questions for Jason? Mr. James? Jason, I'm sorry, I'm having difficulty following along in my | 00:33:14
in my notes. | 00:33:18 | |
Please, my question is, I agree with everything you just said. Is that reflected in a red line that's in here? It is OK. So | 00:33:23
therefore we we don't have to amend that which is presented. Isn't this my curiosity? | 00:33:30
Further questions for this is Miss St. and do you have some more concerns? I will reach out to you between the second and third | 00:33:39
reading. I've been a little busy lately, but I'll make sure that you get that done before third reading. So I'll be on my vote for | 00:33:44
today just because I have some concerns. Thank you. | 00:33:48
Any further questions for Jason, Mr. James? Mr. Chair, move we approve on. I'm sorry. | 00:33:54

minutes. | 00:36:17 | |
Good morning, Natalie Tennant, Mount Andrew, Dr. Severance Co. I Remembered. | 00:36:30
I just have to obviously come up here and thank all of you, quite a journey this has been, but it's opened up new doors and my | 00:36:37
mind as far as education on how government works. | 00:36:43
I can't thank you enough for working together with me in the community and doing the right thing in this. We thought this was | 00:36:53
going to be a tough battle in the beginning, but it's not because it was already written in Law counties code. So I just want to | 00:36:59
thank you guys for locking that up and doing this. My husband's in the audience and she's probably going to get upset with me, but | 00:37:05
he's going to be able to breathe in log counting knowing that his commissioners did this for him and our family. And I appreciate | 00:37:11
you all. Thank you very much. | 00:37:17
Anybody else wish to make public comment? | 00:37:23
Morning. Good morning, Commissioner Sergeant 1611139 LaSalle, Colorado 80645. I am a Parrot trooper and a farmer, and I'm also an | 00:37:35
oil and gas worker here in Wealth County. And I just want to commend you as an intelligence analyst on passing this ordinance. I | 00:37:41
don't think the State of Colorado understands a threat to our democracy. | 00:37:47
In this county, and I just want to commend you for passion, authorities to keep us safe, preserving our way of life and preserving | 00:38:24
our American values. Thank you. Thank you, Sir. | 00:38:28
Anybody else wish to make public comment today towards this matter? | 00:38:35
All right. I'll go ahead and close public comment and I'll bring it back to the board. | 00:38:40
Let's see. | 00:38:46 | |
So, Mr. Chair, one of the things that this ordinance is still missing is the fact that we need to make sure that we add language. | 00:38:49
So I propose an amendment that we add language to so we do not misuse taxpayer funds in all departments. Because as it turns out, | 00:38:56
we do have nine programs, eight of which we do spend county money on, programs that do not ask for ID. We've had several | 00:39:04
whistleblowers acknowledge that we have people who are legal taking advantage of those services. | 00:39:12
And Australia citizens and they said that you know, one of the questions I had back was well I've never received health care | 00:39:20
without an ID before. Some of that includes prenatal services. And it's already been discussed in several town halls that you know | 00:39:26
when when folks come here and, and have children that. | 00:39:32
You know, it, it, it kind of adds to that whole, you know, come here if you are here, not by legal integration. And as the | 00:39:39
gentleman just mentioned, over 40% of the immigration coming into this country are from countries outside of Mexico and outside of | 00:39:46
some of these Latin American countries. They're coming from Russia, they're coming from China, they're coming from places, as he | 00:39:53
said, do not have our best intent, do not intend on being. | 00:40:01
Or having those American ideals. So I think it's really, really important that we send a message that we truly are a non sanctuary | 00:40:09
county by closing that loophole that we currently have. And I urge that we adopt this amendment to include that we will not misuse | 00:40:17
any taxpayer funds because yes, we are paying for staff and supervisors in each of those programs that does take county funds. So | 00:40:24
I would urge a yes vote on the amendment. | 00:40:32
That was in the original resolution that I presented, and I'm happy, very happy to have started this conversation and get this | 00:41:13
rolling. But let's add this amendment. Let's add it today. It's been voted down to times. Now. Please add this amendment. Sorry. | 00:41:20
We will not misuse any taxpayer funds. Mr. St. has a motion for an amendment on the floor. Is there a second? | 00:41:27
Hearing none, that amendment dies with no second. I would bring it back to the board for consideration. I'll move to approve this | 00:41:37
ordinance, Mr. Chair, but I'm going to continue to educate the public on what's going on here because we are saying thank you very | 00:41:43
much for the motion. Is there a second? | 00:41:49
Second, Mr. Freeman has seconded, we have a motion and a second for final reading of Code Ordinance 2024, Dash 05. Motion by | 00:41:57
Commissioner saying second by Commissioner Freeman, further discussion. Now you can speak. Commissioner Buck. Thank you, Mr. | 00:42:03
Chair, and I'm just thrilled that this is happening. And I do see Bob, I see and I do see Natalie Tennant in the audience. I would | 00:42:10
love if the two of you could come up to me. This is what? | 00:42:17
Happens when you make a difference in your well county government. And I just want to appreciate the town hall effort that we did. | 00:42:24
It was incredible. Natalie, you did a great job of leading that discussion. Bob, you were instrumental right bar behind right | 00:42:31
along with her. But if you, the two of you could come up, I would like to present our challenge according to you. We want you to | 00:42:39
know that we've got your back and you have our backs in doing what's right for well Towning. | 00:42:46
So I would say let's reserve that opportunity for if this passes, Commissioner. | 00:42:54
So, but it has not yet. So is there further discussion regarding code ordinance 20/24/05? | 00:43:02
All right, hearing none, I will call the call. All those in favor of Code Ordinance 202405 signify by saying aye, aye, all | 00:43:10
opposed, same sign and Code Ordinance 202405 does pass 5 to 0. Commissioner Buck, if you'd like to present your challenge coin, | 00:43:17
that would be an opportunity. | 00:43:23
I'll get you. | 00:43:33 | |
And it was remarkable. | 00:43:39
Thank you. I appreciate you absolutely in there. Thank you. Thank you so much. | 00:43:53
Thank you, Mr. Chair, for the moment of personal privilege. You're welcome. Item number 12, First reading of Code Ordinance | 00:44:05
2024-12 in a matter of repealing and reenacting with amendments Chapter 2 Administration on the Weld County Code firearms. Mr. | 00:44:13
Chairman, this is a provision that deals with recently passed Senate Bill 24, Dash 131. | 00:44:21
And specifically you can see the provision that it talks about in it's on page one of the code ordinance that is before you. In | 00:44:30
fact it deals hasn't included in their section 1812105. | 00:44:39
.3 subparagraph 1B that says was permitted by a local government is described section 4B, which includes counties on the property | 00:44:49
or within a building in which so you can't provide or bring firearms. | 00:44:59
Onto those places that are worse that chambers of galleries or galleries of local governments governing body are located and | 00:45:10
meeting local governments governing body is being conducted or the official office of any elected member of local governments | 00:45:18
governing body or the chief executive officer the local government is located. So on page two what this does is it provides for | 00:45:26
the carrying of the firearm. | 00:45:35
Is permitted in the admin building which which you've got your offices and also your chambers which is this. | 00:45:44
Also, it says than any building where the board is conducting a meeting as defined in section 2464021 B of CRS, which is the Open | 00:45:54
Meetings Act. It also includes the definition of the term firearm, which the state statute refers to, but it's in section 181901, | 00:46:04
subparagraph 3, subparagraph H, which means. | 00:46:14
Any handgun automatic. | 00:46:25
Revolver, pistol, rifle shot down a rudder and smitter device capable or intended to be capable of discharging boards, cartridges, | 00:46:28
or other explosive charges. | 00:46:35
So. | 00:46:44 | |
In essence, what this does is it engage the prohibition that was in specifically so there was created in Senate Bill 131. | 00:46:45
Excellent work, Bruce. Any questions for Bruce? | 00:46:59
All right, this is a public hearing. Should anybody wish to make comment to coordinates 2024-12, now is your opportunity. Please | 00:47:04
come forward to the podium, state your name and address for the record, and keep your comments to three minutes, please. | 00:47:11
This is also why it's really good to have work sessions that have an entire board presence so we can work through this. | 00:47:52
I did not have a work session on asylum. I'm glad we speed this up just a little bit, but let's add that language. So we are truly | 00:47:57
a Second Amendment sanctuary county and all county property, including parking lots, for a lot of these altercations to happen so | 00:48:02
our employees and our citizens can protect themselves. | 00:48:07
I will second that I I think it's worthy of the discussion, but I'm I'm not sure. Well, I'll second it. | 00:48:18
All right, there's a motion from commissioner saying for an amendment. | 00:48:26
Second, by Commissioner Buck, Mr. James, hey, Mr. Chairman, Senate Bill 24, one, was it 131, whatever that abomination was, simply | 00:48:29
define spaces in that Senate bill. God grants his rights to the Constitution, protects him. Colorado legislature tried to take him | 00:48:37
away. They defined those quote UN quote sensitive spaces in Senate Bill 131. What our ordinance does is properly counters | 00:48:45
according to the Senate bill. | 00:48:53
It just simply negates their Senate bill. Our rights are protected. | 00:49:01
And they are not infringed, so to speak, by the Colorado legislature, as they defined in Senate Bill 131. Parking lots still carry | 00:49:08
all the things. | 00:49:12
This is just simply counters. Senate Bill 131, the amendment is not needed and I don't think valid. I would agree with what | 00:49:18
Commissioner James said. This is specific to that bill in specific areas. It's not included anywhere else. We don't need to be | 00:49:25
saying something that's already that. We already have those rights, so it's not needed. | 00:49:31
Miss Buck, did you have a comment? I would concur with Commissioner James because as it's spelled out in that Senate bill, this is | 00:49:37
the areas where they were prohibiting. We are countering those specific areas to which they were prohibiting. Therefore, I don't | 00:49:44
believe the amendments needed because our county code already takes care of those areas and it's not needed. | 00:49:50
With that missing. | 00:49:57
I'm gonna counter with this. When people recode a lot when it says is permitted, well, I understand the argument is important to | 00:50:00
say exactly what we mean. It's very, very important because we want to make sure that people understand that we are protecting | 00:50:08
rights everywhere. And I'm grateful to have helped leave the discussion. As far as expanding carrying rights for employees, | 00:50:15
obviously citizens already have those rights. I want to make sure it's clear to both. | 00:50:23
That anywhere in this county, if you step on the county grounds. | 00:50:30
You are allowed to carry and I don't think that's exactly clear in here. In fact, we might even be winning it. I do not want that | 00:50:35
danger of winning it just to this building or other buildings where we are having a meeting. There's a very good possibility we | 00:50:40
are limiting ourselves. | 00:50:45
Either earlier this year or last year, I forget me for forgetting, but we already authorized all our staff to carry and I mean, | 00:50:52
are you negating that ordinance? No one. I'm glad I pushed that ordinance through through some big. | 00:50:59
Everybody worked on SO. However, why do we need to pass an ordinance? | 00:51:06
That states something that's already codified within our code, and there's no need to change. That's duplicative and it's | 00:51:13
unnecessary. | 00:51:17
Expanding something is always better than limiting that's that's a tenant. | 00:51:24
Number one is you don't have an ordinance that prohibits people from carrying concealed carry weapons on any property. | 00:51:31
That is owned by the county. | 00:51:43
You could. There's two places in Colorado statutes that allow for that. One exception is courthouse, but that is governed by | 00:51:46
judicial, the 19th Judicial District, and operated as such. | 00:51:53
So you don't have an ordinance that does that. So they have the right to bring order weapons onto those properties. | 00:52:02
You don't prohibit it. The second thing is that that actually is a good point to deal with Senate Bill 131. | 00:52:13
That probably saying the Wall County Administration building and property located at 1150 O Street. | 00:52:24
That would probably be a good thing to do to add. Then the second thing would be into any building and property where the Board of | 00:52:33
Kennedy Commissioners is conducting a meeting. | 00:52:40
And that that I think would fit with the prohibition. It would again negate the prohibition that is set forth in Senate Bill 131. | 00:52:48
So I would recommend that actually you add. So it does say that while Kenny Administration building and property located 1150 L | 00:52:58
Street and #2 any building and property where the Board of Tenant Commissioners is conducting a meeting. | 00:53:09
I think the thing we need to be careful revenue and that's why you have to stay as to where we're having meetings like you are, | 00:53:19
Bruce. And we can't simply say any building. We are not allowed nor is the public allowed, nor is the sheriff's staff allowed to | 00:53:26
carry guns inside the jail. And that is county property. So you can't simply say any building. So that's why we have to counter | 00:53:34
what's specifically spelled out in this Senate bill and Miss Buck. | 00:53:41
Thank you, Mr. Chair. And that would be appropriate to amend in and 2nd, 3rd readings. I believe we can move forward. First of | 00:53:49
all, you have a motion on the floor to amend. I'll change my amendment to include what Attorney Barker just said. I'll have | 00:53:54
another. | 00:53:58 | |
So basically what he's saying is for number one and #2 well, Ken, administration, building and properties as properties are | 00:54:05
property, property, property and #2 in the building with the border, county commissioners are conducting meetings that charge | 00:54:11
defined in Section 24-6/4O21B CRS and property. So I'll make that amendment and then my amendment. Commissioner Sain is amended | 00:54:17
her amendment. | 00:54:24
Commissioner Buck that since you seconded, are you still OK with your second two Commissioner Saints amendment, amendment now | 00:54:31
since we're on first reading, this gives us an opportunity to have a work session, but this is what the this this issue, well this | 00:54:37
type of. | 00:54:43 | |
Umm, complications seem to always arise on the moment of instead of a discussion, and I'll leave it right there, but I will still | 00:54:50
2nd. | 00:54:56 | |
And did you have another comment? All right, we do have a second for Commissioner Sayings amendment which incorporates Attorney | 00:55:03
Parker's language of property under both items. Any further discussion on the amendment? | 00:55:12
If he says yeah, bring your weapons in, OK, you can do it. If he says no, you can't bring weapons in, he's the keeper of the jail | 00:55:55
and he says no, you can't do that, So he couldn't. | 00:56:02
All right, further discussion on the amendment, Mr. James. | 00:56:10
That we put this language into obviously the ordinance, and then we can have that conversation at a work session as we always do | 00:56:15
between 1st and 2nd readings. | 00:56:19
What do you do? Typically have our work sessions immediately after our first reading. That is correct, alright. | 00:56:25
So I probably need to open this back up for public comment because it's been a minute. We need to vote on the amendment. Thank you | 00:56:32
for your help there, Commissioner James. All right, all those roll call, please, on those in favor of the amendment to first | 00:56:38
reading of Code Ordinance 2024 District Mike Freeman. | 00:56:44
Hey, John Bruce's exclamation mark. I'll vote yes. Scott. Yes. What do you think? This expands right to yes. Payback. Yes. Kevin | 00:56:51
Ross. Yes. The amendment to Code Ordinance 2024-12, including the language property. | 00:56:59
On page two under A&B. | 00:57:07
Is accepted and I will bring it back to. Do I need to open it back up for public comment again, Scott, there's no harm in doing | 00:57:11
that. I figured there wasn't. I'll open it back up for public comment. If anybody wishes to speak to the discussion we've been | 00:57:17
having regarding Code Ordinance 2024-12, now is your opportunity. Please come forth to the podium, state your name and address. | 00:57:24
Keep your comments to 3 minutes. | 00:57:31
All right. I see no public comment again for this matter. I'll go ahead and close public comment and bring it back to the board | 00:57:41
for consideration. I have the Second Amendment, How about that Second Amendment? On the Second Amendment, here's. | 00:57:48
I'm just making sure continue on this thing. Yes, Sir. Here's what I'd like to do. Again, I want to push back on this notion that | 00:57:59
we always have work sessions. | 00:58:04
Between the first, that is the case. However, I think we should do it from now on when we put in a new quarter. That's refreshing | 00:58:10
so that we have those discussions. First, I would propose the amendment be to all county properties. | 00:58:16
And move out other jurisdictions. | 00:58:23
That the sheriff may be on control of or the 19th Judicial District. | 00:58:29
This thing has a limit on the floors or a second. | 00:58:35
That amendment dies with no second. Mr. James, should I move? We approve on proofs First reading Code Ordinance 2024-12, the | 00:58:41
motion by Commissioner James to approve on First reading Code Ordinance 2024-12, as amended. | 00:58:47
With a second by Commissioner, **** any further discussion. | 00:58:54
All right, hearing none, all those in favor signify by saying aye aye, all opposed same signs. And that item carries 5 to 0 on | 00:58:59
first reading. Item number 13, first reading of code ordinance 2024, Dash 11 in the matter of repealing and enacting with | 00:59:06
amendments, Chapter 2, administration of the well County Code per diem. | 00:59:13
Good morning, Cheryl Patelli, Finance. | 00:59:24
This amendment would change our current travel policy in the code to allow not only for actual meal expenses as as, but now, but | 00:59:27
also per deal an employee chooses per diem over the actual meal expenses. This per diem rate would be set by the US General | 00:59:35
Service Administration guidelines. | 00:59:42
Not right support. Have any questions for Cheryl? | 00:59:51
All right, I'll go ahead and open this up to the public. If the public has any comments they wish to make towards the first | 00:59:55
reading of Code Ordinance 2024 Dash 11, now is your opportunity. Please come forward to the podium. State your name and address | 01:00:00
for the record. Keep those comments to three minutes, please. | 01:00:05
All right, seeing none, I'm going to go ahead and close public comment, bring this matter back to the board. | 01:00:11
Mr. Mr. James, I move we approve on first first reading Code Ordinance 2024, Dash 11. | 01:00:17
That's great. Second, a motion for approval of Code Ordinance 2024, Dash 11 from Commissioner James. Second, my Commissioner | 01:00:23
saying further discussion. | 01:00:28
All right, hearing none. All those in favor signify by saying aye aye. All opposed. Same sign and turn 24-11 passes on first | 01:00:34
reading 5 to 0. That concludes new business. This brings us to public comment. | 01:00:42
Now is the public's time to come forth and state anything they wish to to the board. We ask. Keep your comments to three minutes. | 01:00:51
If you're unable to be here today and would like to e-mail us, you can do so at publiccomment@well.gov or CTV at weld.gov. Or you | 01:00:58
can do it the old-fashioned way with snail mail. Well, county clerk to the board, PO Box 7581150, OH St. Greeley, Co. | 01:01:05
80632 Does anybody from the public wish to make comment today? | 01:01:12
All right. We'll go ahead and close public comment and we'll adjourn our regular meeting and we'll take a 5 minute break here and | 01:01:18
then come back for public hearings. | 01:01:23 |
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, | 00:09:25
indivisible, with liberty and justice for all. | 00:09:31
Good morning and welcome everybody to today's regularly scheduled Board of County Commissioners meeting. Today is Monday, June | 00:09:42

And none all those in favor signify by saying aye aye. I'll oppose same sign and reading both code ordinances 2024 eleven and | 00:10:19
2024-12 will be led by audio. I'm MSC agenda Houston Ave. today's agenda today's agenda. | 00:10:28
10th Amendment, Sanctuary County. I'll be passing that out with a handout from Ronnie Sylvester as well. She can hand it out | 00:10:38
cross-border.
No. Second, is there any other amendments to today's agenda, Houston? | 00:12:23

Works is recommending the award to DBE Manufacturing in a cost of 100 at a cost of $150,732.40. | 00:14:18

which was June 30th, 20 which is until June 30th, 2024.

Commissioners. Amy Mushy Public Works presenting on behalf of Joe Max construction company and DCP Midstream. | 00:17:26
This section of Rd. was closed on June 6th and remain closed through June 11th. This is due to a section of the road that started | 00:17:35

I'm sorry. | 00:33:54
It's all right, I get screwed up too, so don't worry about it. This is a public hearing. I'll open it up to the public at this | 00:34:01

Moved me by Ted only. Second motion by Commissioner James to read by title only. Second by Commissioner Buck any discussion | 00:35:25
