| Private property rights and as well known to 10th Amendment reserves rights in States and to the people. | 00:14:22 | |
| And we have several court cases here that we can draw upon. But Colorado does not have navigable waters is defined in Article 3, | 00:14:30 | |
| section 2C112 and royalty at marine time jurisdiction. Yeah, we tend, we still have our farmers and ranchers being persecuted by | 00:14:37 | |
| the EPA and the federal government trying to literally exhaust them and wipe them out. One gentleman has lost over $60,000 trying | 00:14:44 | |

| on so they can defend themselves against this overreaching federal government and continue to do the farming and ranching that | 00:15:18 | |
| feeds us. | 00:15:23 | |

| motion from Commissioner James to extend the public hearing time to 30 minutes. Is there a second, second, second by Commissioner | 00:31:07 | |
| Buck? Any further discussion? | 00:31:12 | |
| 80632 if anybody wishes to come first, don't mind, just come on up the podium. State your name and address for the record. | 00:31:58 | |
| Thank you. | 00:32:05 | |
| Board of Commissioners, My name is Dusty Johnson. I'm running to be the next state representative for House District 63. My | 00:32:09 | |
| address is 16203 County Road 19, Fort Morgan Co 8/07/01 and if you want my cell phone it's 9703701154. House District 63 is 7 | 00:32:17 | |
| counties. It includes the northeast region which is Morgan, Logan, Phillips, Cedric, Washington and portions of Wells. Proud to | 00:32:26 | |
| say I have the most land mass in Wells County. We have the oil and gas rigs, the cattle. | 00:32:34 | |
| Also want to bring in common sense water planning. Water is huge every single year and we are losing it because we are not at the | 00:33:18 | |
| table to talk about it. I also do want to talk about healthcare and making sure we're accountable for coding and transparency for | 00:33:26 | |
| our patients and the public. So those are my 4 platforms but every issue matters out here. Every single house district as you are | 00:33:33 | |
| aware has 88,800 people. Every vote out of 300 members counts the same. We just need to make sure we have someone who's firm. | 00:33:41 | |
| Still 3 minutes. | 00:34:21 | |
| Still got about a minute left. Yeah, I know. It's so confusing because it's in that area. It was 646563. So I just say Northeast | 00:34:22 | |
| region because everything. | 00:34:27 | |
| Changes. So at least much of my understanding is your 5 districts, 3 districts in that large kind of stay the same for the folks | 00:34:32 | |
| in the areas. So again, local control makes sense and state government confuses things with numbers so we can make sure we get | 00:34:37 | |
| common sense. | 00:34:42 | |
| And I. | 00:34:49 | |
| Thank you. Good luck. Just. | 00:34:53 | |
| Thanks. Does anybody else wish to come forth and make public comment? | 00:34:55 | |
| Good morning. | 00:35:02 | |
| I just stand here. I can sit right now. You can sit there at the microphone, you can stand the podium, whichever you'd like. | 00:35:05 | |
| My voice in the back of the room. | 00:35:11 | |
| They still got a hearing online though so. | 00:35:13 | |
| Good morning. Is this on OK? | 00:35:15 | |
| First of all, I'd like to thank Laurie Thayne for continuing to present this incredible resolution before the commissioners, and I | 00:35:19 | |
| appreciate your time and listening to it, reading it, studying it. And what I ask is that you please, if you don't like this one, | 00:35:28 | |
| please come up with something that is going to protect our farmers and ranchers rights against federal government. | 00:35:38 | |
| Federal government is intruding with EPA, federal government is intruding with FEMA, federal government is intruding with the Army | 00:35:48 | |
| Corps of Engineers. And as Attorney Barker well knows, this has to stop. I have been talking with many people in other states | 00:35:56 | |
| about this and for example, Montana, Wyoming, Oregon, Utah have all are all following this now with great interest because this | 00:36:03 | |
| will serve as a template. | 00:36:11 | |
| For counties in the United States. | 00:36:19 | |
| Finally, clarify the boundaries of federal in states. | 00:36:21 | |
| It defines exactly what authorities federal does and does not have in the United States. And it would be really awesome if, for | 00:36:28 | |
| example, the, well, county commissioners came up with a a really easy to understand brochure for the public that shows the public | 00:36:36 | |
| exactly where federal's enumerated powers exist and don't exist. So that that tools them up and equips them to better fight | 00:36:44 | |
| federal. | 00:36:51 | |
| Federal is costing the state of Colorado. | 00:37:00 | |
| We need an audit. | 00:37:03 | |
| It'd be really interesting to find out exactly how much money is lost with our producers. | 00:37:05 | |
| In the downtime that they accrue, going to the Capitol and testifying, coming here and testifying, going to meetings just to | 00:37:13 | |
| protect the property. And that's your job. Your job is to protect our property. We shouldn't have to spend I I. | 00:37:21 | |
| I listened to a gentleman last night who has just recently in his retirement. He has now lost $60,000 in attorney fees trying to | 00:37:29 | |
| back off federal all by himself. And the Big Thompson S Platte Ditch Company has now accrued over $40,000 in attorneys fees trying | 00:37:36 | |
| to back off FEMA. | 00:37:44 | |
| So we're just asking for the county commissioners to take their oath very seriously and protect the residents of Weld County, | 00:37:53 | |
| Colorado, the number four largest producing county in the United States. | 00:37:59 | |
| Ronnie, we know you, but if you don't mind, for the record, would you state your name? I am so sorry. I apologize. I'll let you | 00:38:08 | |
| go. I was thinking about. | 00:38:11 | |
| With a million other things. But anyhow, thank you. I'm Ronnie Sylvester and. | 00:38:16 | |
| My husband is Chuck Sylvester and we farmed down in the what they call the Godfrey Bottom and LaSalle Colorado and we also have | 00:38:23 | |
| lost a lot of. | 00:38:28 | |
| Revenue trying to fight federal and also the state and county on, on things that we should never have to address. | 00:38:34 | |
| The reason why I missed this past Monday, and I do apologize for that, is because I'm the space. I'm retired. Farmers are out in | 00:38:45 | |
| the field busy. | 00:38:50 | |
| Planting and and so forth and so on. And so they asked me to please. | 00:38:56 | |
| You know, try to help them. That's the only reason why I'm here. | 00:39:02 | |
| Of Shanghai County, of course I believe in the Constitution as to do you, but say we pass this and say the EPA continues to | 00:39:48 | |
| overreach, which I agree they are. What is your expectation then of of this board of county commissioners? | 00:39:55 | |
| The county commissioners are the most powerful in the state as far as authority. You do have the right to tell any overreach. | 00:40:40 | |
| Remember the keyword is overreach. Anything outside of federal's enumerated powers. It's not like a blanket no, no, no. You know, | 00:40:48 | |
| you have to look at the enumerated powers, which I think again, if you came up with a really simple brochure for the public to | 00:40:56 | |
| understand and this communications, I agree with people absolutely. | 00:41:04 | |
| Exactly, and in respect to Dusty, who testified earlier, I'd be happy to visit with her about water. | 00:41:12 | |
| And could perhaps be the best place to do this is perhaps you and I know, I know, I know, I just connect offline. I would really | 00:41:19 | |
| enjoy it. You do have the authority and my my suggestion is that if if for example, a attorney Barker does not like this, that you | 00:41:26 | |
| all come up with something that will in fact protect. | 00:41:32 | |
| This county from federal outside of its enumerated powers. That's all I'm asking. | 00:41:40 | |
| Let's let's connect offline. I'd love to do that. | 00:41:48 | |
| Will connect to outside of this meeting. I I would really enjoy it. Oh OK, thank you. Have you managed to help the Big Thompson | 00:41:51 | |
| Godfrey ditch back off FEMA I again I'm not too sure my authority is but we'll have that conversation on why. Thank you I | 00:41:58 | |
| appreciate that anybody else have any questions Yes. So I just want to tell you that. | 00:42:05 | |
| I it says on here further results. So this is the action that this resolution says that the board of firms it will not enforce | 00:42:14 | |
| against any citizen any federal law is unconstitutionally infringing upon the right of the people while counting to keep or use | 00:42:20 | |
| your non navigable water. That is you're correct. That is something we can do, but we can also declare that the Constitution. | 00:42:27 | |
| Is our governing document and that they need to stay within the reach of the Constitution. So I think it's a comment upon us to | 00:42:33 | |
| one listen to you. I did ask for continuance on Monday so that you could come and speak for the rest of the farmers and ranchers. | 00:42:41 | |
| Unfortunately that was denied. But I'm glad you're speaking now and we should we're very least it's incumbent upon us to use our | 00:42:48 | |
| boy pulpit to remind the federal government and tell them this is not constitutional what you are doing to these people. | 00:42:56 | |
| And at least we can have that for you to stand upon that Weld County says this is unconstitutional. | 00:43:04 | |
| That gives you some support that you need and and perhaps your case needs. | 00:43:11 | |
| Because somebody needs to recognize that. And, and as you said, we're one of the most powerful voices in the state. We should be | 00:43:16 | |
| using that voice for you. This is unfair, it's unconstitutional, and it's going to break the backbone of agriculture, which we | 00:43:24 | |
| desperately need. We need an economy and we need it to to feed the people around us. So what you brought for us and helped with | 00:43:31 | |
| the writing of this resolution, it really does mirror a resolution that we passed for the Second Amendment Sanctuary. | 00:43:38 | |
| I wasn't aware there's a time limit because I thought we had 30 minutes standing at the moment, so I'm sorry that's you need to | 00:43:46 | |
| run the meeting by Roberts. | 00:43:51 | |
| I don't believe you are, but you'd like for me to shut up also. | 00:43:58 | |
| No, ma'am, I haven't asked you to sit. | 00:44:01 | |
| All right, so and I guess in closing, I will say. | 00:44:05 | |
| I think it's incredibly important to listen to because that is our job first. | 00:44:10 | |
| It's our job for us to listen to you. | 00:44:15 | |
| And then the second job of a patriot is to take action what you've done here by showing up today for the rest of your community. | 00:44:18 | |
| And to take action and any means we possibly can or that's a resolution of proclamation or showing up with you to court and say | 00:44:25 | |
| this is not constitutional, which I'm happy to do by the way. I appreciate that. Thank you very much. And I would like to put a | 00:44:31 | |
| little addendum on that. I did look over. | 00:44:36 | |
| Senator Kirk Myers dredging bill and it includes the EPA and whomever and federal government. It's almost kind of like a mother. | 00:44:43 | |
| May I, you know, please have your permission to go ahead and proceed with this. So it does not address this at all. They're | 00:44:49 | |
| totally unrelated, completely unrelated. | 00:44:55 | |
| So thank you, though, for referring me to Miss Kirk Myers, Bill, and thank you, Commissioner saying, for recognizing the | 00:45:01 | |
| importance of the well County constituents to speak. | 00:45:09 | |
| Thank you very much, Mr. No other questions. | 00:45:18 | |
| Thank you. | 00:45:23 | |
| Is anybody else in the public wish to make comment today? | 00:45:24 | |
| Good morning. Don't forget to mention your name and address for the records. | 00:45:37 | |
| Good morning. My name is Scott Shulman. I'm at 38539 County Road 33 in Eden, Colorado. And I didn't want, I see you stopped 27 | 00:45:40 | |
| minutes left. So I wanted to use up part of that for you, but I actually just wanted to come up and as a as a citizen. | 00:45:49 | |
| Say I completely agree with what commissioner saying is saying, and you know, I don't understand everything. I've read this | 00:46:00 | |
| multiple times. If it was me, I would want to dumb it down a little bit. | 00:46:05 | |
| Just so I understood better, but in my opinion and I deal with farmers and ranchers every day. I'm on the phone with them, I'm | 00:46:12 | |
| talking to them, I'm out and filled with them daily. And in my opinion, if you guys it is that the easy thing is to do for you | 00:46:18 | |
| guys to do nothing and sit back and say, yeah, that's. | 00:46:24 | |
| The status quo is good, but I think that sends the wrong message because if you come out and you say as a as the county, we | 00:46:30 | |
| believe that the federal government shouldn't overstep their boundary and shouldn't have that power to step in and take water from | 00:46:37 | |
| people because they just want to do so. I think if you come out and just make that statement, it says a lot to our farmers and | 00:46:44 | |
| ranchers in this county and it it. | 00:46:50 | |
| Let them know you're behind them. | 00:46:57 | |
| And if you don't come out and say you're behind them, then all of a sudden they say they must be against us. | 00:47:00 | |
| The county must be on the side of the federal government and they must accept that the government can come in and take their | 00:47:06 | |
| water. If you come out and say that we are behind the farmers, you know, I don't know where it goes. And I think Commissioner | 00:47:12 | |
| James had some great points and I hadn't even thought of just sitting there. But I think if you don't do anything, that sends a | 00:47:18 | |
| message just as much as if you do something. | 00:47:23 | |
| Yeah. So I couldn't agree more with you and regarding protecting the farmers the fastest. | 00:47:32 | |
| I don't believe we do have any authority, but if it's a matter of going to court with them. | 00:47:38 | |
| And being there to show that we do support them, that's. | 00:47:44 | |
| That's the. | 00:47:47 | |
| The rub I'm having, it's a private property, they have to show that they're injured and then they have a case. But until that, I, | 00:47:48 | |
| like I said, we will meet them in court to show that we do support them but. | 00:47:54 | |
| I don't believe it is that we do have any authority. And it's almost like, well, pounding our chest, but it's not, there's no | 00:48:00 | |
| resolution. There's no resolving that. That's the frustration that I'm having. But it's sending a message. It's not saying that | 00:48:06 | |
| we're going to go fight your court case for you. It's sending a message saying we, we understand, we believe that as a county, we | 00:48:13 | |
| don't think the federal government should be able to come in and take your water. | 00:48:19 | |
| Proclamation, same. We state something that we feel strongly, but it's to me a resolution. We're not able to resolve anything and | 00:48:27 | |
| it is as frustrating as all get out the. | 00:48:32 | |
| A proclamation would be even better than doing nothing in my opinion. But. | 00:48:38 | |
| I'll just say for the, for the record, we've, we've had the resolution proclamation. | 00:48:44 | |
| I standing next to Ronnie in court and being next to her, it is a great thing that we as a county have the power to do this to to | 00:49:24 | |
| say something and say this is not right and this is unconstitutional. | 00:49:31 | |
| Thank you so much, Scott. | 00:49:39 | |
| Anybody else from the public wish to make comment today? | 00:49:41 | |
| Since we still have 20 minutes left, I'll take a couple. My name is Edwin Wayne Grant, but he called me Eddie. I'm from Grey. I'm | 00:49:56 | |
| a native. 20/22/21 Tenth Avenue, 1314 23rd Ave. Court, 2411 27th Ave. Place is kind of interesting. It good as the federal | 00:50:02 | |
| government certain things to do. | 00:50:08 | |
| Article the Article 3, article one, Section 8 is the federal government certain things to do 24 like 20, two dozen, 25 things deal | 00:51:02 | |
| with dealing with the federal issues, deal with the coins, have the money. He has the alien tribes, 567 Indian tribes in North | 00:51:08 | |
| America. Well, you know, in the United States. So they have to deal with everything from A-Z. Fine, I get it. It's tough to deal | 00:51:15 | |
| with an animal reservation and all this kind of stuff, but they keep infringing on everybody else. It's like dealing with an 800 | 00:51:21 | |
| LB gorilla anymore. | 00:51:28 | |
| Thank you. | 00:51:34 | |
| Thank you. | 00:51:36 | |
| Anybody else wish to make public comment today? | 00:51:38 | |
| All right, seeing none, I'll go ahead and close public comment. And it is 939. We stand adjourned till 10:00 AM public hearings. | 00:51:42 |
