Thanks Joe. Concludes with those will move on to planning. We have one item here final reading of code that's 23-13. I'm not 00:07:20

The move by Commissioner James, second by Mr. Ross, to read by title only all in favor aye opposed motion carries Ordinance 2023 00:07:40

Chapter 29. Building Regulations of the World Tending Code Railing Gas Equivalent. 00:07:58
Telecommunication towers. 00:08:04
Alright, good morning, commissioners. Tom Parker, director of Department of Planning Services. 00:08:07
Good morning, commissioners. Jason Maxey, Director for the Welcoming Oil and Gas Energy Department. 00:08:11
Here to present on final reading here on these proposed changes, dealing with three specific chapters in the Weld County code and 00:08:15
oil and gas equipment and towers. We've had several conversations about the purpose behind the code changes and providing more 00:08:24
efficiency through this process, and we don't have any proposed changes and we'd be happy to answer any questions. 00:08:33
OK, one of the questions. 00:08:42
OK, this is a public hearing everybody. The public that wishes to come forward discuss Code Ordinance 2023, Dash 13. 00:08:44
OK. So you know probably could put, I will close that and bring it back to the board. 00:08:51
Please just please just state your name and address for the record. 00:09:26
And you could either the podium or whatever is easiest. Whatever. 00:09:29
Catherine Beeland, my husband. I live at 6251 County Road 20. 00:09:36
And that's the property outlined in blue. 00:09:40
The flagpole shaped property to the West of us is Amry 2513. 00:09:43
Rob and Lot A and those are owned by this and needed to Newton. 00:09:48
And and. 00:09:52
Yep. 00:09:55
How does that go? 00:09:56
Figure that out. 00:10:04
In 2019, this Commission requested a farming exemption in order to subdivide these two acre lots. 00:10:06
I need to sell to some hemp plumbers. 00:10:13
And so the planner at the time. 00:10:15
And said that the proposed access for those last crosses property not included in her recorded exemption and that she would need 00:10:18
to obtain a 30 foot easement agreement from the property owners which is ourself. 00:10:23
And. 00:10:30
And with that, Miss Kennison provided a 2001 easement agreement. 00:10:32
Which provides access to the property east of US. 00:10:36
Not to any of the properties to the West of us. 00:10:40
And. 00:10:46
So this document is on file as granting access to all of her acres across our private property. 00:10:53
And that document does not do that. 00:10:59
Next. 00:11:01
A few short months later, a second two acre lots as well as the 3rd 1.77 acre lot were administratively approved and those plants 00:11:03
were also filed as having access from our private property to all of those acres. 00:11:09
Not only for utilities but for easement access. 00:11:16
And the second and third lots were subsequently pulled into miss. 00:11:20
Conference USSR. 00:11:26
1174 from 1999 and they were, as a minor change, adding an additional lots as well as access from our private property. 00:11:28
You can see Miss Kennison has her own private road on the West of these three newly created lots, and she also has a maintenance 00:11:37
easement agreement on file with the county granting access to all of those acres to all of the owners of those acres. 00:11:43
Right of access for driver utilities was never granted indeed or in recorded exemption. 00:11:50
You know instrument of any kind from our property, it's, it's our private property. 00:11:57
And we were told lots two and three into the USSR that is now getting public access to a business from our private property. So 00:12:02
we're simply requesting that the board, Mr. Parker mentioned earlier that he's meeting to discuss this as well. But we're simply 00:12:10
asking the board to please take corrective action. You can go to the next one please, for the five plates that have been recorded 00:12:17
with erroneous information with access from our private property removing all access. 00:12:25
And the next one. 00:12:33
And just get those corrected and refilled please. 00:12:36
OK. 00:12:41
Really quick. 00:12:43
Thank you, Mr. Chair. I appreciate seeing you. I just chatted on the phone a couple of times. I'm glad that you connected with 00:12:45
Director Parco. I'm just curious as to to me in in phone conversation and and presentation. 00:12:52
A question of Council Miss Beland has a certainly a a valid concern. 00:12:58
I'm just curious as to the action. 00:13:05
Of this board? I mean, is it? 00:13:07
To me, she as she presents is true, but I don't know what action to take. But help me understand the course here. I'm not sure 00:13:11
that there's any action that you take. 00:13:15
No sense. So I mean I I need to sort through it and then figure it out. 00:13:20
But maybe there is some action you can take, maybe there is, don't know. 00:13:25
I'll go with him so. 00:13:30
So, so Bruce, in other words, what you're saying then is there's possibly something that as a country we can do and and and 00:13:34
possibly not, which would make it a civil issue. Well, I I think it's a civil issue regardless, but the question is, is there 00:13:40
anything that? 00:13:45
You as a board of county commissioners can require that would remedy the situation. 00:13:51
I don't know the answer to that right now. 00:13:57
According to Weld County Code Section 2411-40, I believe the commissioners do have the authority to. 00:14:00
Change those plants. Require those plants to be changed or not. 00:14:07
I I don't know. 00:14:12
Need to take a look at the facts, Look at the law. 00:14:14
Figure it out. OK, So what? So what we'll do is our County Attorney is now have that. He will. He will look at it. We'll figure 00:14:16
out what the answer is and will be back in touch with what you know. 00:14:22
We will let you know what we can do. 00:14:27
OK. 00:14:29
Thank you so much. Thank you. Thank you. 00:14:30
OK, any other public input this morning? 00:14:34
OK, seeing none, I will go ahead and close public input. 00:14:39
Public comment and we will adjourn at 916. Thanks everybody. 00:14:43
