PUBLIC COMMENT |
Your first. Yes, Sir. Alright, please stand. Join me please. | 00:06:49
I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one nation under God, | 00:06:53
indivisible, with liberty and justice for all. | 00:06:59
Good morning. It's Monday, September 11th called the Board County Commissioners, Roll call please. | 00:07:08
Starting Kavanaugh's voicing payback Mike Freeman. | 00:07:13
Thank you, Mr. President, Minutes. Approval of Minutes of August 28, 2023 second. | 00:07:20
Been moved by Commissioner Brock Sack by Commissioner James to approve all in favor Aye opposed motion carries payments legendary | 00:07:25
members know OK consent agenda. | 00:07:30
Move to approve consent agenda second. Then moved by Commissioner James, second by Mr. Ross to approve the consent agenda. All in | 00:07:35
favor Aye, opposed motion carries presentations. We do have a couple of presentations formed from the Sheriff's Office. The first | 00:07:39
one is life saving awards. | 00:07:44
Come on up, Surprise. | 00:07:49
What? | 00:07:51 | |
Yes, thank you. Board each, each time we're gonna opportunity, opportunity to recognize the performance of the deputies at the | 00:07:54
welcoming Sheriff's Office. We want to do so in a public environment. We started sharing this process with you guys a couple of | 00:08:00
years ago. Over time we've transformed that just a little bit to where the the supervisor of those employees that are being | 00:08:07
awarded comes and makes the presentation. So without further ado, I'd like to bring certain Jerry Porter. | 00:08:13
Good morning, Commissioners. | 00:08:22
So it's my privilege today to introduce 2 deputies of the Sheriff's Office that have really shown some exemplary behavior while | 00:08:25
carrying out their duties this time, you know, responding to calls instead of inserting themselves like Commissioner Freeman. | 00:08:32
Just kidding. He happened to be at A at a crime scene today that I went to, so it was a little big on him. | 00:08:40
But the two deputies that we're talking about is Eric Rossi. | 00:08:49
And David Grijalva? David's been with the Sheriff's Office for about four years and deputy loss. He's been in law enforcement | 00:08:53
since 2006 and joined with us in 2014. | 00:08:58
On the 30th of June 2023, about 9:00 in the morning, Deputy Lossy was dispatched to a vehicle that had been carried away. | 00:09:04
With flood conditions. | 00:09:12
And everybody remembers when all the rain started hitting Weld County. It just happened to be really bad on Kennard 73. | 00:09:14
Along and here again ditch. | 00:09:22
So once you got there, unfortunately the the elderly man had passed. The flood conditions were too great. | 00:09:26
And he just didn't make the right decisions to to be able to get out of the car in time, even though citizens were really trying | 00:09:36
to help him. It was on channel at 16 and and 73. | 00:09:41
But while investigating that case of grounding and before actually, you know, working on that process, they had roadblocks, placed | 00:09:49
the road and bridge placed those roadblocks and unfortunately citizens started driving around that roadblock and thinking that | 00:09:56
they could forward that water that was running very quickly across 73 and 16. | 00:10:03
We had more vehicles that started getting carried away. | 00:10:12
So he was made aware Eric Rossi was made aware of another vehicle that had gotten carried away while he was trying to investigate | 00:10:17
the death case. The course had been taken to the North, so he was actually a little ways away. | 00:10:23
But despite the roadblocks, obviously we had these these vehicles running that and trying to afford the the waterway. | 00:10:31
So in this case, the vehicle was occupied by 46 year old man and his 14 year old daughter. Obviously we have emergency conditions | 00:10:40
here. We're now getting taken away and the vehicles getting filled up with water and if something doesn't happen pretty quickly, | 00:10:46
these folks could die The the. | 00:10:53
Pressure against a a door is pretty significant, and if somebody isn't training or actually knows what to do in flood conditions | 00:11:00
in a vehicle makes it really difficult that they lost, he didn't hesitate at all. He immediately deployed his rescue disk, which | 00:11:07
is a floating throwable device, on a on a rope. He threw it out to both of those folks inside that vehicle, and his quick reaction | 00:11:14
really kind of made the difference here with this car. | 00:11:20
And while he was working with this one, we had another vehicle that got carried away and in the second vehicle get the Guava. | 00:11:28
David Brava was also able to assist at the Rossi in this case and the second vehicle had tried to forward the flask flowing water | 00:11:34
as well. | 00:11:40 | |
Umm. | 00:11:47 | |
Just like the first two, it got carried away and it was. | 00:11:48
It actually had a couple other people with it. | 00:11:52
I'm the old driver, a 16 year old son and a six year old daughter. | 00:11:55
And two dogs, three dogs inside. So in this case, we actually had the rescue disk that had been used previously that was now tied | 00:11:59
up in another vehicle and he couldn't get it free. So that philosophy actually used ingenuity with us. And he got his spike | 00:12:06
strips. And spike strips are actually a series of three about. | 00:12:14
3 foot long. | 00:12:22 | |
Triangular tubes that are hollow. So he used that ingenuity, and in fact had to take his boots off to to wade into the water | 00:12:24
pretty far to try to get that spike strip out far enough. | 00:12:30
To save this next group of people, including a six year old daughter. | 00:12:37
Have both lossy rehabber were able to successfully rescue all of the occupants out of the vehicle. So it's for that reason that I | 00:12:41
think Deputy lossy. | 00:12:46
Deserves the ribbon of merit in the lifesaving ward, and Deputy David Grijalva also deserves a life saving more, so I'm happy to | 00:12:52
present them before you know. | 00:12:57
Yeah. | 00:13:09 | |
OK. | 00:13:17 | |
Thanks David for your service. | 00:13:18
There. | 00:13:21 | |
Absolutely. We all get it. We all gotta come down and take some photos unless you guys have anything you'd like to say. | 00:13:29
Alright. | 00:13:37 | |
Perfect. Thank you. | 00:13:39
You want to say it? Yeah, sure. Mr. Ross. Good. Thank you guys. I mean to act like that. True heroes and and moments of. | 00:13:43
Instantaneous decision making I think is is very. | 00:13:53
Impressive. | 00:13:56 | |
People's I'll just call it lack of brightness for continuing to drive around barriers and even though you guys are there clearly | 00:13:58
trying to to save other individuals who suffered the same consequences and people continue to do it and never ceases to amaze me. | 00:14:06
But that's why we have such amazing people working for the sheriff and in his office and and I'm just proud to know that you | 00:14:13
represent Weld County and say great job you save countless lives that day and and both of you. | 00:14:21
But I mean you deserve much more recommended air commendation than that but I think it's it's amazing and and thank you. | 00:14:28
Mr. See, Ohh, swift water rescue is is a difficult endeavor to begin with. So thank you so much for doing what you've done and and | 00:14:36
having the courage to go out there, literally go out there and innovate something that saves lives. That's. | 00:14:45
That's a tremendous thing. Not many people have to wear with all the do that and that kind of situation. So it just tells me how I | 00:14:54
kind of person you are both are. But also that our Sheriff's Office is very innovative as far as crafting those solutions to save | 00:15:01
lives, even the ones that people get themselves into due to bad judgment. So again, thank you so much. | 00:15:08
I'm sure some of those young girls will remember this the rest of their life and. | 00:15:16
Yeah, it it's something that stays with you always. | 00:15:22
Mr. Buck. Well, as we take today, looking at September 11th and all the law enforcement and fire departments and all the people | 00:15:26
that are. | 00:15:30 | |
Take care of us, can't thank you enough and we'll county you will always be respected. | 00:15:35
And you will always be appreciated and we will always protect. | 00:15:42
You are also in any way that we can, but thank you so much for putting yourself out there. Thank you. | 00:15:47
Mr. Gaines, you are a testament to not only your training but your commitment to service. Thank you. | 00:15:54
And I would say, you know, I agree with everything that's been said. Once again, it's great to live in a county where actually | 00:16:01
people support law enforcement. It's, you know, we've always been huge supporters in the Sheriff's Department. That won't change. | 00:16:07
Thank you guys for what you do, not only on this particular situation, but 24/7 every day for the citizens will OK. | 00:16:13
These are amazing. Thank you. And we'd like to come take a picture from Chris. | 00:16:19
Delete. | 00:16:24 | |
What sounds like? | 00:16:27

Right here. | 00:16:32 | |
Here. | 00:16:37 | |
He's trying to be like you. | 00:16:39
You know, we just take a look at reams. That's the way you'll be here in about 10 years, might be 10 minutes. | 00:16:43
OK. | 00:16:49 | |
Alright. | 00:16:51 | |
And 123. | 00:16:54 | |

OK, you will probably comment. I will close that and bring it back to the board and can't move to approve on second reading code | 00:29:06
Ordinance #2023-14. | 00:29:10
That's gonna move like Mr. James, I would like Mr. Ross to approve on second reading Code Ordinance 2023-14 any further | 00:29:15
discussion. | 00:29:18 | |
All in favor, aye. Opposed motion carries. Thank you. | 00:29:23
That concludes new business. We have one item under planning consider vacation of public facility division. | 00:29:27
PFD22-0004. | 00:29:33 | |
And recombine lots into original acres for Barclay Farm Property LLC Unit care of Richard Johnson. Good morning. Good morning. | 00:29:36
Good morning, Commissioners. Molly Wright, the Department of Planning Services for your consideration is the complete vacation of | 00:29:48
Public Facility Division, PFD 22-0004. | 00:29:53
Recorded April 5th, 2023. | 00:29:59
This parcel is located north of and adjacent to County Road 20, approximately quarter mile West. | 00:30:03
The County Road 23 vacating his parcel results in an approximately 40 acre unplatted parcel. | 00:30:08
The applicant submitted a vacation request letter and a draft vacation plot, along with other supporting documents to planning | 00:30:15
staff. | 00:30:19 | |
Our code requires. | 00:30:23
Criteria. | 00:30:24 | |
For the vacation request has been met. The Department of Planning Services has reviewed this request and recommends approval. The | 00:30:26
applicant is present and I'm happy to answer any questions. | 00:30:31
That's really questions. | 00:30:36
Kick the applicant. | 00:30:38
Come on up, please, Sir, just state your name and address for the record. Any comments you'd like to make? Rich Johnson, 5745 | 00:30:39
Waverley Ave. Firestone. | 00:30:44
And do you have any additional comments to what? No, I just, you know we went through the process to do this for the fire | 00:30:50
department and during the process they had an attorney that was representing them and they didn't do their due diligence. So we | 00:30:58
and they had gone ahead. I'm, I'm a real estate agent. I'm used to using the Colorado State of proof. | 00:31:05
Contract form for the attorney insisted on using the form that or a contract that she drafted for him. And so through the process | 00:31:13
the they never did the due diligence and we had some issues with the contract. We never really had a signed contract with the fire | 00:31:20
department. I I told them I said look we'll go ahead and I'll go ahead and finish the process of of getting the subdivision | 00:31:27
created and that then we'll just go ahead and turn it over to you and have the contract signed at that time. | 00:31:35
And so once that happened, they started and we had that, we had done an Environmental Audit phase two. | 00:31:42
I'll provide them with that information and I guess nobody really took the time to to to look at that. There was a high pressure | 00:31:48
oil line on the property. | 00:31:53
And the the fire department came back and said, you know, we just believe that that's going to be a dangerous for us to put a | 00:32:00
substation close to that. | 00:32:03
And that was after we've gone through the whole process of getting it ready for him, so. | 00:32:08
Little bit deep, goes unpunished. | 00:32:13
So that's where we're at, OK. | 00:32:17
Alright. The media public hearing on this which would then yes, go ahead and open, go ahead and open up. So I'll go ahead and open | 00:32:19
this up to the public. Is there anybody in the public that wishes to come forward and comment on this vacation of? | 00:32:25
Public Family, Public Family Division. | 00:32:32
OK. See no public comment. I'll bring it back to the board and any further discussion guys. OK. | 00:32:36
Mr. Chair moved to approve vacation of Public Facility Division PFD 22-0004 and recombine lots into the original acreage for | 00:32:42
Barclay Farm Property LLC. | 00:32:47
You're with your daughter. | 00:32:53
Move by Commissioner. Last second by Mr. Buck to approve. All in favor. Aye. Opposed. Motion carries. Thank you, guys. OK. Have a | 00:32:55
good day. Yes, Sir. OK. That concludes the. | 00:32:59
That concludes our business. We do have public comment. Is there anybody in the audience wish to come forward and discuss anything | 00:33:05
with the commissioners that is on our agenda and you have up to 3 minutes to do that. | 00:33:09
OK, see no public comment. We will. | 00:33:15
Adjourned at 947. Thank you. | 00:33:19 |
Your first. Yes, Sir. Alright, please stand. Join me please. | 00:06:49

indivisible, with liberty and justice for all.
Hey, Cortana. | 00:16:29
Right here. | 00:16:32 | |
Here. | 00:16:37 | |
He's trying to be like you. | 00:16:39
You know, we just take a look at reams. That's the way you'll be here in about 10 years, might be 10 minutes. | 00:16:43
OK. | 00:16:49 | |
Alright. | 00:16:51 | |
And 123. | 00:16:54 | |
Thank you. | 00:16:58 | |
Thank you so much. Great job. | 00:17:02
Ohh good. | 00:17:06 | |
That's why. | 00:17:11 | |

Our Family Services and Visitation center received notification that we would no longer be able to continue our lease agreement at | 00:22:06

Allegations. | 00:24:00
There is not a specific deadline or timeline, but the request is to approve the cooperative agreement template and then authorize | 00:24:02
the chair to sign the subsequent agreements because we will do this with all municipalities in Weld County. | 00:24:09
OK, that makes sense. Any questions? | 00:24:17

Public Facility Division, PFD 22-0004. | 00:29:53

This parcel is located north of and adjacent to County Road 20, approximately quarter mile West. | 00:30:03

applicant is present and I'm happy to answer any questions.
