Slash help, yeah. | 00:15:27
It's like, well, 5 county commissioners. | 00:15:28
Thank you, commissioners. We've got our, I think our whole department here, Madison, couple of employees who are out. I asked | 00:15:37
who's who's left? Answer the phone. So I assure you, we do have somebody. | 00:15:42
I just wanted to take a moment to appreciate the board recognition of of the group and what they do. Health education is, I guess | 00:15:48
maybe the best way to say it is an often underappreciated component of the health department because what they do on a daily basis | 00:15:53
isn't. | 00:15:59 | |
It's hard. It it it can't necessarily be measured. The impacts can't necessarily be measured immediately, right when we go inspect | 00:16:05
a restaurant or give an immunization, it's easy to count. | 00:16:11
Those actions the the health education components a bit different because. | 00:16:17
It's a bit hard to measure prevention, particularly when it may happen. | 00:16:23
When it may take years for that. | 00:16:27
About health education to. | 00:16:29
Um, you know, prevent someone from trying opioids or other drugs or? | 00:16:32
Getting addicted to tobacco or preventing type 2 diabetes this group. | 00:16:39
The actions, the activities that they do every day have a big impact on population, health and wealth county. | 00:16:46
The the educational impacts. | 00:16:54
You know, long term benefits are huge and I wanted to take the opportunity. I appreciate the recognition that the board, I wanted | 00:16:56
to take the opportunity to thank this group. | 00:17:00
I appreciate the work that you all do to serve the residents every day. Thank you. | 00:17:04
Thanks, Mr. Buck. As the coordinator for the health publication, well, I do absolutely want to thank all of you. When I look at | 00:17:12
such a healthy group of individuals here and I think in my mother and how she just kind of enforced all the vegetables and. | 00:17:18
All the fruits and you know, you take that role honestly and and it does. | 00:17:25
Extend the life and it helps people in so many ways. | 00:17:31
So I can't thank you enough for for doing all that you're doing. So appreciate it. | 00:17:35
Molly Rome, my mother in forest was you can't have dessert unless you clean your plates. And so therefore. | 00:17:41
Hang on, I want to dessert. | 00:17:47
It is important. | 00:17:49
Can you tell more everyday? | 00:17:54
I appreciate what you do for certain the. | 00:17:57
Even when you look at things from an economic standpoint. | 00:18:00
The investment in education, so we don't have to do the the the investment in treatment. | 00:18:03
We were certainly money as the head of society, so continue to encourage us. | 00:18:08
Regardless of what my Mama taught me. | 00:18:12
To to be healthy and Vicky Black County well, thank you for doing what you do. | 00:18:14
Congratulations and thank you. | 00:18:50
And I would agree that everything's been subjected. Thank you for what you guys do. Thank you guys for what you guys do everyday. | 00:18:52
You know what matters. It matters. It matters to the citizens of Weld County that we actually show that we care about what's going | 00:18:57
on with people's health. So thank you. | 00:19:01
And with that, we'll take a picture if we could. | 00:19:07
Hello. | 00:19:28 | |

Alright #3 Present and approve emergency bid 2300 one 97 County Road 74 and 33 intersection roundabout completion project | 00:22:08
Department of Public Works. | 00:22:13
Good morning, Rose Everett Purchasing department. | 00:22:20
Due to the numerous justifiable reasons, Well County terminated the construction service contract with Lawson Construction Company | 00:22:24
on September 19th, 2023. | 00:22:29
On September 26, 2023, a work session was held with the Board of Commissioners. | 00:22:35
Public Works staff and County Attorney staff to discuss the possible methods available to ensure completion of this construction | 00:22:40
project. | 00:22:44 | |
It was agreed at the meeting to attempt to hire the most qualified contractor we could find to complete the work. | 00:22:48
Thus minimizing the risk to the county and maximizing our ability to complete the work in a timely manner. | 00:22:55
The company identified at the meeting was W Clyde. | 00:23:02
Due to their proven track record of completing numerous similar projects with the county. | 00:23:06
A bid was received and opened October 6th, 2023 for contracted construction of the 33 slash 74 roundabout project completion. | 00:23:12
When did was received in the amount of $5,970,200.20. | 00:23:21
W Clyde Company, formerly known as IHC slash Scott. | 00:23:28
Of Englewood, Co. | 00:23:33
The submitted bid has been received, reviewed for errors and completeness. | 00:23:35
The big tabulation is attached for your information. | 00:23:40
It is the staff recommendation to award the construction contract to WW Clyde Company. | 00:23:44
For a total amount of $5,978,200.20. | 00:23:49
Public Works has worked successfully with the contractor in the past on similar projects. | 00:23:56
If this bid is approved by the BOC on October 16th. | 00:24:02
Construction is planned to commence soon thereafter. | 00:24:05
Any questions? | 00:24:11
Don't you have anything you'd like to add to this? I know, Commissioner, unless you have questions, I'm here to answer any | 00:24:13
questions you may have. Any questions. | 00:24:16
No, just a comment. I appreciate jumping in as quick as you did to try to rectify the situation, so I know. | 00:24:20
A lot of people are waiting with bated breath to see how quickly this will get done. And I know you. | 00:24:27
I'll do a great job. So appreciate your all your all that you're doing. Yeah, this is one of those. This is one of those things | 00:24:33
where. | 00:24:37 | |
It's it's not a good situation, but we just need to get this done. | 00:24:43
ASAP which is which is what this which is what this bid does. So. | 00:24:47
Very. | 00:24:52 | |
I additionally want to comment, you know. | 00:24:53
These aren't fun situations. I mean, we're having to return money back on on grants, STBG grants. | 00:24:56
To whether it's CMP or the feds. | 00:25:04
But ultimately, because of our thorough management on this project, we caught this one before it got away from a site. I do | 00:25:06
commend Public works on this. | 00:25:10
And the teams continuing to manage this bring the solution for us so that we can get this done. I know for the travelers of the | 00:25:14
region they'll be. | 00:25:17
Much appreciated, so thank you on that. | 00:25:21
OK. I will bring it back to the board for. | 00:25:25
Promotion. It's a present, right? | 00:25:28
OK, Mr. Chair, I move to approve. | 00:25:33
2nd. | 00:25:36 | |
Like Mr. Ross, second by Mr. Davis to approve on emergency emergency approval of which I think we all understand why that needs to | 00:25:37
be done on emergency approval. So with that all in favor, aye, opposed motion carries. | 00:25:43
And then we need to go back to the to the consent agenda because we needed that's ohh, sorry, explain. | 00:25:51
As far as you already approved it on consent agenda and that's the. | 00:25:58
Item number six under Miscellaneous. | 00:26:02
Which is contract 7514. | 00:26:06
That would be what is it was approved on consent agenda conditioned upon the bid being approved. OK, OK, now let me do an | 00:26:09
explanation as to the reason. | 00:26:14
For the that agreement. | 00:26:20
Is we're doing sole source because? | 00:26:22
Of the exigency in getting the project completed. | 00:26:26
And because of the fact that there was a breach of the contract. | 00:26:30
By the previous contractor. | 00:26:35
So those are the reasons and I think they're good reasons to do this because we have to get. | 00:26:38
Roundabout open. | 00:26:43
So, so we're good approving the consent agenda ahead of you're taking care of perfect. OK. | 00:26:46
Thank you, thank you, thank you. | 00:26:52
OK, we want a new business. Consider returning Federal Surface Transportation Block grant, SBG funds and. | 00:26:55
From Congress 34th and 33 intersection roundabout project back to normal range that's following plankton organization and | 00:27:03
authorize the clerk of the Board to submit electronically. | 00:27:08
And this goes back to the reasons that we just explained in this in this previous battle. Lizabeth, Go ahead. Good morning, | 00:27:15
commissioners. Elizabeth Welford, Public Works. | 00:27:19
Just for some documentation of the the history of how we got here, we were awarded a Surface Transportation Block Grant by the N | 00:27:24
Front Range Metropolitan Planning Organization. | 00:27:30
On March 8th of 2019 this was to for fiscal year 2023 dollars in the amount of 1,000,009 Ninety $1818.00 to be used for the County | 00:27:36
Road 7433 roundabout project. | 00:27:43
These funds are vetted through the Colorado Department of Transportation. This project was identified in C Dots Step, their | 00:27:50
Statewide Transportation Improvement Program. | 00:27:55
In addition. | 00:28:01 | |
On June 15th and 20 of 2022, per Resolution 20221668, the Commissioners did approve an intergovernmental agreement for these | 00:28:04
improvements with the Colorado Department of Transportation. | 00:28:10
And the N Front Range Metropolitan Planning Organization, the local match Fund dollars for those were also contributed by the Town | 00:28:17
of Eaton and the amount of 22,696 dollars. | 00:28:22
Based on conversations with the Town of Eaton, they want to continue their commitment to this project. | 00:28:27
And the efforts for that part and that local partnership, those dollars did help our project obviously score higher as part of the | 00:28:33
ranking process for receiving those funds. | 00:28:38
But they still felt there was value and and having that support for the project. So they want to maintain that IGA which basically | 00:28:44
says. | 00:28:48 | |
That they'll contribute funds upon completion of the intersection improvements, so we do not need to go back and revisit that | 00:28:51
intergovernmental agreement. | 00:28:55
On on December 21st, the Board did award to loss and construction company in the amount of 9,000,000 dollars, $210,800 for the. | 00:29:00
Intersection improvements. | 00:29:13
Obviously, based on what you just approved, the intent is to. | 00:29:15
Give essentially show that they are in breach of contract for this, for that contract and therefore. | 00:29:22
What the? | 00:29:33 | |
The Board on today or on September 19th I should say, did identify and provide written notice of termination of agreement for the | 00:29:35
construction services for the roundabout project. | 00:29:40
Do the material breaches and various terms and conditions offset contract by loss and construction? | 00:29:46
And so therefore, we are asking you today to. | 00:29:52
Return the Federal Surface Transportation Block Grant STG funds back to the North Front Range MPO and to allow the Clerk to the | 00:29:57
Board to send a copy of this resolution back to the North Front Range MPO. | 00:30:04
So that these funds can be incorporated back into their STB G pot pool of funds for this current color project. So that's | 00:30:13
occurring right now. | 00:30:17
OK. | 00:30:22 | |
Questions. | 00:30:23 | |
Mr. James. | 00:30:24 | |
The right thing to do with your stink. | 00:30:25
And so therefore give the money back, it's. | 00:30:28
It's understood, it's explained previously, but that's the frustrating part of all of this. | 00:30:30
But with that, to Mr. Chair, I move to approve the resolution. So if I move by Commissioner James, second by Commissioner Ross to | 00:30:35
approve all in favor, aye, opposed. | 00:30:38
Motion Carries #2 is considered returning Members Federal Surface Transportation Block Grant funds from from from from counter | 00:30:43
7433 intersection on that project back to the Colorado Department of Transportation Authorize the Clerk of the Board to submit | 00:30:51
Electronically and terminate Intergovernmental Agreement entered into under Resolution 2020 Dash 2433 dated August 8th, 20. | 00:30:59
20. | 00:31:08 | |
Elizabeth Radford Public Works. This resolution is needed. | 00:31:10
For record record keeping for our audit for the Colorado Department of Transportation, we did enter into an IGA and | 00:31:14
intergovernmental agreement for the improvements of this intersection of 74 and 33 roundabout. | 00:31:21
On August 8th, 2020 per resolution 2020 2453. | 00:31:28
And have since then expended costs related to this project. | 00:31:34
And so the point of this resolution is to identify the. | 00:31:40
505,505 hundred and five $903,000.61 that we have expended and received back from. | 00:31:45
As part of the grant funds from the Colorado Department of Transportation, again, they they federal dollars are vetted through | 00:31:56
that organization. | 00:32:00
And to. | 00:32:04 | |
We have to get back to work back to the N range, but we also have to return the funds that we've already received reimbursement | 00:32:07
from the Colorado Department of Transportation. And so this resolution is to document that we did receive those funds. | 00:32:13
I. | 00:32:20 | |

With the short for you. | 00:35:15
This particular ordinance is dealing with several little cleanup changes to. | 00:35:17
Um floodplain regulations are primarily dealing with all of the changes that CWCV. | 00:35:22
And FEMA went through post 2013 floods. I wasn't here on first reading and so I know that there weren't any proposed changes | 00:35:29
between first reading and 2nd. We don't have any here. But I also wanted to just go on record and and give a shout out to Diana | 00:35:37
who really did a phenomenal job putting all of this stuff together. It is very difficult sometime to keep track of everything that | 00:35:45
the feds and state do when it comes to changes like this and going through and monitoring to make sure that. | 00:35:52
You know we're not going above and being excessive with our floodplain regulations. | 00:36:00
And I think we accomplished that and making sure that we're still in compliance with the National Flood Insurance Program. So with | 00:36:06
that said. | 00:36:10 | |
We're happy to answer any questions. | 00:36:14

OK. That will close public comment and we will adjourn at 927. Thanks everybody. | 00:37:00 |

Then I will read this indirectly. | 00:13:39
Whereas the Working Department of Public Health and Environment, Health Education, Communication and Planning division. | 00:13:42
Plays an important role in the health. | 00:13:48

Come back here in a little bit more early signs there. | 00:19:35
Little closer if you can. A little closer you can. Thank you. | 00:19:40
Alright, I'll take. | 00:19:45

We're asking accounting obviously to provide a check in that amount to return back to the Colorado Department of Transportation so | 00:32:21
that they can. | 00:32:25
UM incorporated as part of the paperwork to FHWA to make sure that everything is cleaned up and. | 00:32:29
We are are good to go on meeting that contractual obligation and we will essentially be terminating our IGA with the Colorado | 00:32:37
Department of Transportation for this project. | 00:32:43
