| Works, in collaboration with the Planning Services Department. | 00:17:16 | |
| Is please present the final. | 00:17:23 | |
| Uh, changes to Chapter 8. Code changes. We had a meeting. | 00:17:26 | |
| On November. | 00:17:33 | |
| 13th. | 00:17:38 | |
| A work session to discuss these changes. The first reading was approved on December 4th and on December 20th, 2nd reading was | 00:17:40 | |
| approved. On December 19th. AG professionals had submitted a letter. | 00:17:46 | |
| And on January 3rd, Public Works and Planning sat down with eight professionals to go over a couple of comments they had those two | 00:17:53 | |
| comments we have addressed in the current reading. The first first one was in section 812-80. | 00:18:02 | |
| Under B and they just had concerns. | 00:18:12 | |
| Being very. | 00:18:16 | |
| Limiting in. | 00:18:18 | |
| The exceptions that would be able to be made, we were asking. We made the changes that the permit holder may need to provide | 00:18:23 | |
| additional documentation rather than just stating written documentation from an outside agency wouldn't be needed. | 00:18:30 | |
| They were. They were good with those changes. | 00:18:38 | |
| The second is under section 814-30D, Emergency Access. | 00:18:42 | |
| This one we? | 00:18:52 | |
| Once we looked at it. | 00:18:55 | |
| Make making sure that in the interest of public. | 00:18:58 | |
| That an emergency access is not ever intended to be a primary access, and that it would could be exempted from the spacing | 00:19:02 | |
| criteria, the minimum spacing criteria and shall be signed and some type of. | 00:19:10 | |
| Gating to prevent it from being a primary access. Both of these were. | 00:19:18 | |
| I got over with hag professionals and and I think we are good with these and that they were good with them as well. | 00:19:27 | |
| Before. | 00:19:35 | |
| I look to have the board approve this. I just want to say a big thank you to planning Services for working with Public works and | 00:19:38 | |
| for my public works department. But the biggest thank you goes out to Elizabeth Rawford and Don Anderson for all of the hard work | 00:19:45 | |
| they put in helping get this put together. And with that, I would recommend the board approve final reading. | 00:19:53 | |
| Thank you. Curtis, any questions? | 00:20:01 | |
| Yes. So we actually we had some changes and normally we have a work session that discusses. Doesn't sound like that occurred this | 00:20:03 | |
| time. | 00:20:06 | |
| No, that is correct. | 00:20:10 | |
| Any further questions, says the public hearing and opening up for public comment regarding coordinates 2023-16. Finally, and if | 00:20:13 | |
| anybody wishes to come forward make comments on that, please move. | 00:20:19 | |
| So now they haven't closed public hearing for that. Bring it back to the board any further questions for. | 00:20:25 | |
| I'll just go ahead and say thank you very much. Appreciate your guys''s times and effort on this. Appreciate you reaching out with | 00:20:33 | |
| our community partners on this as well and getting feedback. So thank you very much and with that and entertain a motion. | 00:20:39 | |
| You Should Move Approve Move to Approve on Final Reading Code Ordinance, 2023 Dash 16. | 00:20:45 | |
| Second got a motion from Commissioner James, second from Commissioner Freeman to approve final reading of Code Ordinance 23-16. Do | 00:20:51 | |
| any roll call vote? Are we OK? Give like A roll call vote. Please use them. | 00:20:57 | |
| Next payment Scott James Lori saying no pay back Kevin Ross Yes let the record reflect court ordinance 2023 passes on final | 00:21:05 | |
| reading for the long commissioner saying object. | 00:21:12 | |
| Thank you guys. | 00:21:19 | |
| Brings us to planning Item number one on planning first reading of Code Ordinance 2024-02 in the matter of Repealing and | 00:21:22 | |
| reenacting with Amendments Chapter 19 of the Coordinated Planning Agreements of the Well County Code Amendments to Appendix 19. | 00:21:30 | |
| Or even in Appendix 19 I for cursing. I request a severance on these two issues between cruising and Eaton, where those are two | 00:21:39 | |
| separate issues, I'd like to do it on them separately. | 00:21:45 | |
| Is that appropriate route in the same ordinance? | 00:21:52 | |
| It's in the same ordinance. Are you making a motion? I'm making a motion to suffer the ordinance into two separate votes. So if | 00:21:56 | |
| that can be done? | 00:22:00 | |
| So a second. OK, that motion dies with no second. | 00:22:06 | |
| With that, I'll bring that back to the action. | 00:22:11 | |
| Good morning, Commissioner, Long range planner. | 00:22:16 | |
| The board conducted a work session on this topic of the Eaton UGA last month, and the town has asked the county to update the map | 00:22:20 | |
| in Appendix 19 G to show the urban growth area. | 00:22:27 | |
| That the town adopted with its most recent comprehensive plan update in 2020. | 00:22:35 | |
| Eaton Plan was adopted in 19 Ninety 1999 by Ordinance 212. | 00:22:41 | |
| In January 2004, there was a minor amendment to make it renew automatically every year, and there was a small change to the map. | 00:22:48 | |
| In that year. | 00:22:59 | |
| The other piece of this ordinance is to remove the map in 19 I, which is the Kersey UGA map. We did not discuss this at the work | 00:23:02 | |
| session. This is a minor clean up item. It should have been removed when the courtesy agreement was updated in 2016. | 00:23:12 | |
| That that agreement no longer refers to the appendix or to the map in Appendix 19 I and doesn't refer to a map. It's just. | 00:23:24 | |
| Three mile buffer of the town limits and changes as the Town of Kersey annexes property. So that's just a clean up item that we | 00:23:33 | |
| wanted to include here since we're updating Chapter 19. | 00:23:39 | |
| We'd be happy to try and answer any questions, support any questions. | 00:23:47 | |
| All right, this is a public hearing. This time, I'd open up for public comment on Code Earnings 2024-02. | 00:23:53 | |
| Mr. Mayor, addresses don't mind, if you don't mind. | 00:24:05 | |
| Scott Moser, Mayor. What did you say, Kevin? I'm sorry, your address as well, 100 Walnut. | 00:24:08 | |
| Thank you. | 00:24:15 | |
| We're here for any questions you might have, but your primary reason we're here. We'd like to see that map get recorded, that one | 00:24:19 | |
| that was submitted in 2019. | 00:24:25 | |
| And then regarding the coordinated planning agreements. | 00:24:31 | |
| We're pretty we're excited about working with you guys on getting those updated. So whatever we can do. | 00:24:35 | |
| For hoping to make something special out of that. So Mr. Thank you. Thank you. | 00:24:44 | |
| So many other fully public comment. | 00:24:49 | |
| With that above and close public comment. | 00:24:51 | |
| I have a couple comments I don't mind to clean up on Thursday. Was just a little surprised to see it. But I do have questions. I | 00:24:55 | |
| did e-mail Tony almost immediately after a work session on December 11th, so I have more questions. Those weren't answered, but as | 00:25:02 | |
| of right now, this is something that was brought forth when you were the mayor, Mr. Chair. | 00:25:08 | |
| And you know with an IGA it basically requires us to say more to anything in the non urban area and we don't. That's an extra | 00:25:15 | |
| extra from what we have in Cpas. So I have some little concerns about our friends in agriculture that maybe started businesses for | 00:25:23 | |
| agriculture or gas or anything else. I think this sets a bad precedent to accept this without. | 00:25:30 | |
| This was not the staff recommendation. I don't think it is now either, but I think this really jeopardizes people in the in our | 00:25:39 | |
| county that will no longer have a voice to represent. That's my concern. So I'm going to be voting no today. | 00:25:46 | |
| OK, Freeman, yeah, we still let me comment that I would make is this really doesn't change anything in the CP, in the CPA that we | 00:25:54 | |
| have with him. This is just recording their updated map. That's what that's what's on the, that's what's on the agenda today is to | 00:26:01 | |
| record the map that they submitted in 2019. And with that I would move to approve on first reading code ordinance 2024-02. | 00:26:08 | |
| I got a motion from Commissioner Freeman, a second from Commissioner Bucky for the discussion. Yes, if it was just a map, I | 00:26:16 | |
| wouldn't have a problem with this. That's not what this is, so. | 00:26:21 | |
| Mike Freeman. Yes, Scott, James, what are you saying? Hey, back. Yes. Kevin Ross. Yes. Let the record reflect. First reading | 00:26:29 | |
| coordinates 2024-02 passes for the one with commissioner, same objecting with that that closes planning. Thank you very much, Jim | 00:26:36 | |
| and Max, Appreciate it. Thank you from the town of Eaton for being present here today. And with that, I'll open it up to public | 00:26:42 | |
| comment. | 00:26:48 | |
| Anybody have any comment they wish to express the Board of Commissioners? If so, we ask you to bring it forward and limit that | 00:26:55 | |
| time to 3 minutes please. | 00:26:58 | |
| All right. See, now I enclose public comment and we'll adjourn at 9:19 AM. | 00:27:04 |
