monitor motor vehicle monitoring for all Weld county employees that must operate either a county owned vehicle or a personal 00:12:18
vehicle. 00:12:25
That performs there as part of the regular job duties as the county works to reduce risk. They are also looking at the software to 00:12:32
provide on demand training opportunities for all drivers. One proposal was received. It was for $100,140.28 for a one year with an 00:12:41
annual maintenance of $96,768. The proposal was reviewed by Human Resources and a scoring of the RFP responses are in the 00:12:50

After receiving Samba Safeties Best and final offer, their cost is reduced to $89,148.28 for the initial software license. The 00:13:08

New business item number one consider contract. ID 8105 amendment #2 to task order contract for air quality program. An authorized 00:13:56
chair to sign and submit electronically. Good morning Jason, good morning Commissioner Jason Cheshire with the health department. 00:14:04
This is this contract is a renewal. The department has done air quality monitoring on behalf of CDPHE for 25 years. Plus 00:14:13
contractors will reimburse the county up to $97,134.13. 00:14:21
For contract related activities, essentially it pays for our staff to do industrial air quality monitoring, respond to complaints 00:14:30
and issue permits. The contract term is July 1st of this year through June 30th of next year and I recommend that the Board 00:14:36
approve the contract. Thank you, Jason. Any questions? 00:14:42
Second motion from Commissioner Bob for approval of contract. ID 8105. Second by Commissioner James. Any further discussion? 00:14:51
Hearing none, all those in favor signify by saying aye aye all opposed. Same sign and contract ID 8105 passes 5 to 0. Item number 00:15:00
two consider contract ID 8109. Education affiliation, Clinical training agreement for nursing student internship requirements and 00:15:07
authorized chair to sign Herzing University Limited. 00:15:14
Thank you, Sir. This is an agreement with Herston University to allow students to obtain clinical hours at our public health 00:15:22
clinic. We have a part time public health nurse that is seeking a nurse practitioners degree from Hertzing University which 00:15:30
prompted this. It will allow her to receive some of her clinical training hours at our health department. We hope to someday hire 00:15:38
that nurse as a full time nurse practitioner. So this supports her in that in her effort to obtain that higher level of education. 00:15:45
And I recommend that the board approve the contract or affiliation agreement. All right, move to approve second motion by 00:15:53
Commissioner Freeman, second by Commissioner buff. I think that's great. Glad we can help him out. Hopefully grow some internal 00:16:00
team there. With that, any further discussion hearing? None, all those in favor signify by saying aye aye. All opposed. Same sign 00:16:07
and contract. ID 8109 passes 5 to 0. Thank you, Jason. 00:16:13
Item number three consider special event permit and authorized chair to sign a woman's place. Good morning Matt. Good morning 00:16:21
commissioners. Matt Conroy, assistant County Attorney. This is a special events permit for A Woman's Place Incorporated which has 00:16:29
an address of PO Box 71 in Greeley, Co. The event manager is Heather Nakamura and the events is scheduled to be located at 22455 00:16:37
Kenny Road 49 in LaSalle. There is a USR at those properties so no limited events permit is needed. 00:16:45
Staff has no outstanding concerns with this request. It is currently scheduled if approved. Event is scheduled for May 31st 00:16:55
through June 2nd and we would recommend your approval and as this is a special event, you should open it up to the public for 00:17:00
commenting. 00:17:05
Excellent. Any questions for Matt before we open it up? 00:17:11
All right hearing none if there's anybody from the public that wishes to come and speak regarding the special event permit for a 00:17:15
woman's place now is your opportunity. Please come forward to the microphone state your name and address and I ask that you keep 00:17:21
your comments to three minutes and limited to this issue so. 00:17:27
Oh, good morning. Good morning. I'm Heather Nakamura. Have a seat, if you don't mind. And Speaking of the microphone, so that we 00:17:34
can get that on on the record. 00:17:37
Hi, Heather. Hi. Good morning. I'm Heather Nakamura. I'm on the Board of Directors or A Woman's Place and we are teaming up with 00:17:41
Bigfoot Turf for this event. 00:17:45
And the House is just excited to be able to raise more money as we are currently on a capital campaign to double our facilities. 00:17:51
Excellent, excellent. 00:17:55
Good morning. My name is Nick Nakamura, 2385 42nd Ave. Court here in Greeley representing Bigfoot Turf. The event in question is a 00:18:00
professional sporting event that we are hosting here in Weld County. I'm excited to put it on for the community. It's free to 00:18:07
attend. It's the world long drive. They just finished their Memphis event and their drives were under 400. We are expecting with 00:18:15
elevation to get to 500 and set tour records. Freeman will be there, by the way. 00:18:22
That's, that's awesome. Some friends and I were actually talking about this event yesterday. So it's you're getting some word of 00:18:33
mouth out there and I think people are excited about it so. 00:18:37
I want to thank you for all that you do for the community. Well, thank you. Any other comments you guys would like to make towards 00:18:43
this? 00:18:47
And just hope that you guys would approve this. We wanted to do beer styles last year, didn't workout as a private business, so we 00:18:51
picked a worthy nonprofit. Excellent. Thank you. All right, we'll go ahead and continue with public comment here. Thank you guys 00:18:56
for for making that comment. Is there anybody else here who wishes to make comments towards this special events permit? Please 00:19:01
come forward. 00:19:06
All right, seeing none, I'll go ahead and close public comment at this time. Bring it back to the board, Mr. Chairman, to approve 00:19:13
special event permit, authorized chair to sign woman's place, consider application for hotel and restaurant liquor license and 00:19:19
authorized chair to sign second. I got a motion from Commissioner saying for approval and authorization for the chair to sign 00:19:25
second by Commissioner Bach. Any further discussion? 00:19:30
Hearing none, all those in favor signify by saying aye aye, all opposed same sign and that special events permit passes 5 to 0. 00:19:37
Best of luck with your events. 00:19:42
Item number four consider application for hotel and restaurant county liquor license and authorized chair to sign rigos Mexican 00:19:47
restaurant LLC DBA regos Mexican restaurant map. Good morning commissioners again my Conway assistant County Attorney. This is a 00:19:55
new liquor license application for ligos Mexican restaurants which is at 711 O street in Greeley Co just not far from here. And 00:20:03
this is a second hearing as the board may recall previously nominated well commissioner freeman graciously volunteered to. 00:20:11
Do the inspection for this. 00:20:20
Staff has no concerns. I don't know if Commissioner Freeman wishes to make any additional comments about his section. Sure. Yeah. 00:20:22
So Chloe and I did that inspection here a couple of weeks ago and, you know, everything was everything was as it should be. They 00:20:29
had, I mean, they had it looked really good. Everything was exactly the way that the map showed. Everything was exactly in place. 00:20:35
And I'm excited to approve that because, you know, what's Mexican food without a Margarita, right? 00:20:41
I think we have to open this up, yeah, but I appreciate the enthusiasm. 00:20:49
Anything else you needed to add, Matt? No. All right. Since this is a public hearing, I'll open it up to the public. Does anyone 00:21:00
wish to make comments towards this liquor license? If so, please come forward to the microphone again, state your name and address 00:21:05
for the record, and keep your comments to three minutes. Good morning. 00:21:11
My name is Jennifer. I am the daughter of Rigo Ricos Mexican restaurant. We going it together. I just want to say thank you. We 00:21:19
really love this community and everyone's been so welcoming and everyone keeps asking for margaritas with their food. So we're 00:21:28
really happy that we can provide that and hopefully create more jobs as well as we're going to expand a little bit. So thank you. 00:21:37
Excellent, excellent. I I've been a frequenter of that restaurant. You guys do an excellent job. So glad to see this. Excellent. 00:21:47
Anything else you'd like to add? All right, we'll go ahead. Anybody else from the public wish to speak regarding this liquor 00:21:51
license? 00:21:56
Dorothy Eckert. 00:22:36
Properties located across from the Chase Building, these two buildings on the two lots. We do have a condition in here that there 00:22:39
be a demolition permit that would be granted by the City of Greeley prior to closing, so we will be doing that, applying for that 00:22:48
on behalf of the estate. Mrs. Eckert. 00:22:56
And so we all do that and get it closed up. 00:23:05
All right. Any questions for Bruce? 00:23:10
Move to approve the resolution Second. Motion by Commissioner James for approval of the resolution second by Commissioner Buck. 00:23:13
Any further discussion? 00:23:17
Hearing none, all those in favor signify by saying aye aye. All opposed. Same sign and the contract to buy and sell real estate at 00:23:21
825 and 827 Seven St. Greeley. 00:23:27
Passes 5 to 0. Item number six, Consider resolution regarding expression of support for zoning from R1 to Agriculture zoning for 00:23:32
all residents of East Greeley who assigned a petition in support. 00:23:39
This is sure. These residents have given us a petition as far back as December of 2023. I believe that folks are meeting at some 00:23:46
point. I am disappointed having to report that a lot of folks did not know of some of these community meetings, but I believe that 00:23:53
we should support them in this effort. You heard some of the testimony last Wednesday where people are just saying they're 00:23:59
exhausted. That should not be the condition of our constituents, especially if we have the ability to help them in various ways. 00:24:06
One is to be able to zone them. 00:24:12
As per that code section 24-2-10. 00:24:19
And also where the fees, like we have done before, the poor should not be our footstool. And these folks are elderly, a lot of 00:24:22
them. And they're barely hanging on with some of the taxes and other things that are going on in Colorado right now. So they would 00:24:29
like to enjoy the agricultural lifestyle that they have been accustomed to in the last 40 years. So I asked for yes vote. 00:24:35
Right. There's motion on the floor for approval of the expression of support by Commissioner saying, is there a second? 00:24:43
All right, that motion dies with no second. 00:24:50
Moving on item number seven, consider resolution regarding actions outside of federal government enumerated powers. 00:24:54
Mr. Chair, this was brought forward by one of our constituents. Ronnie Sevastrad asked that she'd come up and explain what is 00:25:06
going on with some of our farmers and ranchers, some of the fights they've had to do against the federal government. And if we 00:25:13
have the power to protect them in any way, I know how important that would be to her and the rest of the farmers that make that 00:25:19
feed us, that have been a backbone of, well, become. 00:25:25
Here as far as producing food and producing the culture that has made us free. So with that, I'm kind of stalling a little bit to 00:25:32
my Ronnie take over from here on out. Good morning. I'm Ronnie Sylvester. I live in LaSalle, Colorado. 00:25:40
This this is probably one of the most important. 00:25:49
Issues that you could possibly work on and pass. 00:25:55
It's critical to property rights, is critical to the economy of, well, county, of course, and it's something that you could 00:26:02
actually provide as a template for other counties in the United States to use to push back federal when it exceeds its enumerated 00:26:11
powers. I don't have the resolution draft in front of me, so I'm kind of going to go by. 00:26:21
Memory excuse me and I just provided the clerk with a. 00:26:31
Serendipitous with a. 00:26:40
A post that I did way back in on May 20th, 2015 in respect to this very issue. That's almost nine years ago and you have probably 00:26:44
have a copy in front of you right now. But anyway. 00:26:53
Photos Main overreach in Well County is in respect to our water. 00:27:03
This has cost our providers a tremendous amount of money fighting government on their own dime. The government whenever it comes 00:27:09
in with FEMA or the EPA or the USA or any of those types of things. 00:27:17
They have the entire DOJ behind them. 00:27:26
You as an individual have your own. You have to rely on your own resources. You payout of your own pocket for your own console. 00:27:30
You lose money when you go to the capital to testify or when you come here to testify. There's a lot of production dollars that 00:27:37
are lost in well County. 00:27:43
Fighting federal overreach and this has to stop. It has to stop and it has to stop. 00:27:50
Throughout the state of Colorado. 00:27:58
The key key thing here in respect to water is that Colorado has no navigable water in the state, period. 00:28:01
Federal only can control water that it owns. Federal has to buy water just like the rest of us. 00:28:13
They just don't automatically get water, they have to purchase it just like you would irrigation, ditch companies, et cetera. 00:28:22
And for them to come in and, for example, FEMA to expand floodplains and then just arbitrarily start dictating to little towns and 00:28:31
irrigation ditch companies what they can and cannot do is in total violation. 00:28:38
Of the law, period. It's in statute. 00:28:46
And so all I'm asking you to do today is. 00:28:50
I'm asking you to pass a resolution that will serve notice on federal that they have zero authority in the county of the world, 00:28:55
the state of Colorado, when it comes to water in particular. 00:29:03
So I second the motion. 00:29:13
Thank you. And I would like to discuss a couple things on that. What I don't think I mean that you're saying it's it's a statement 00:29:16
and I get it, it's a statement, but doesn't result anything because the well county doesn't have the authority to tell EPA to stay 00:29:24
out. But I did speak to Senator Kirkmeyer this weekend and she addressed this specific issue with a bill that just was passed this 00:29:31
year, House Bill 24/13/79. Have you had a chance to look at that? No, I haven't. 00:29:39
I would suggest that you look at that. I can't support though this resolution because I do think it was addressed and again, she 00:29:47
sponsored it and I had a great conversation with her. You might want to just reach out to Senator Barb Kirkmire and and and 00:29:53
because she. 00:29:59
Told me it it and it it's it's I won't read Bill. Well, actually and and I I appreciate that thank you. But actually the county 00:30:07
commissioners do have the authority. They do have the authority and I. 00:30:14
I think that with the General Assembly is just going to get kicked down the road for another 50 years until federal is completely 00:30:22
taken over all our little counties. 00:30:27
In Colorado. 00:30:32
And I will read what? 00:30:34
Representative Kirkmeyer has put forth, but you Will County commissioners do have the authority it's in. It's in your state 00:30:38
constitution to push back any federal overreach period. 00:30:45
Bruce, would you like to address that statement? Yeah, we're in the Constitution. Does it say that in the state constitution, 00:30:54
county commissioners, it defines what your authorities are and are not saying that that's unconstitutional. 00:31:03
That might be the case in a court of record could say that. 00:31:13
But to say that the board of county commissioners by resolution can say, OK, it's unconstitutional, it can't apply in Wall County, 00:31:18
there is nothing in the state constitution that allows for that. 00:31:26
Well, I I think it's an interpretation of our Constitution and I will read it again, but where the buck stops in every state is 00:31:35
with the county commissioners. 00:31:42
And so if the county commissioners are powerless over federal, then who does have the power over federal General Assembly? They 00:31:49
don't care. They really don't. You know, I've been working on this for over 10 years and the General Assembly just doesn't care. 00:31:55
They're in, they're in collusion. I'm sorry. 00:32:01
I just want to make it clear I didn't move the resolution, but let me clarify a few things. Senator Chris Meyer's bill is about 00:32:09
dredging utility, and so this resolution says nothing about dredging and filling, although we've got something here about 00:32:13
dredging. 00:32:18
And we should send a strong statement that is very wrong and the statement supporting you and what you're trying to do. And this 00:32:57
is a first step. So again, I would urge a yes vote on this. 00:33:02
So I've got a comment. I'm fairly familiar with water. So you got the Waters of the US Act going through Congress right now. It 00:33:08
keeps getting punted, keeps getting punted. It hasn't been decided right, because they're trying to determine. 00:33:15
Which way they go with and how far that reaches, and whether? 00:33:23
That does include irrigation waters, things to that nature, right? What this was addressed at the state legislature this year, 00:33:27
right? And and actually there was 2 water bills. Senator Kirk Meyer brought forth one. It actually died late in the session, I 00:33:36
think the day before the last. But then she got on a Co sponsored 1379, I believe it is, which was the minority speakers. 00:33:45
Water bill and they got it so that it did address this right. So the state through the state constitution because water is drafted 00:33:55
into the state constitution. That's how important the founders of the state. 00:34:01
Regarded water and so very few other places inside of the great United States did it get drafted into the Constitution like it did 00:34:09
from the very start here in Colorado. 00:34:16
Buddy, I appreciate your sentiment. I do agree we have to look after water, but this isn't a county. We don't have authority here 00:34:24
and I'm very certain we don't have authority. I would disagree with that and but. 00:34:33
This is my opinion, OK, Reading our charter, as far as my obligations and responsibilities as a commissioner, reading what the 00:34:42
state constitution is set forth, I don't find it where it is our authority here, OK. The case that you brought forth to us, I 00:34:48
think it was two weeks ago that you were here, whatnot. 00:34:54
That's in the town of Milliken itself. That's not in Weld County unincorporated. That was in well, that was in Milliken. 00:35:01
I don't think we have authority. 00:35:09
Now, do I think the United States is, is overreaching on how they're grabbing waters and declaring them navigable? Yeah, I do I, I 00:35:12
agree with that sentiment, but I don't agree with this resolution. So would you consider excuse me? And thank you, Commissioner 00:35:19
Shane, for bringing this forward. Thank you, Ronnie. I I appreciate this. Quite frankly, I agree with you and what's going on. But 00:35:27
I am a I'm a big one for. 00:35:35
Proper roles and I agree that the federal government is stepping outside their authority and doing this. But to do 2 wrongs make a 00:35:43
right? Can a board of county commissioners step outside their authority to do this? 00:35:49
I just read the now therefore be it resolved line. 00:35:56
By our coach ordinances, I don't have the authority to say something's unconstitutional that belongs to the court of law. I would 00:36:32
agree with that. The the word unconstitutional, I would agree with that. But maybe just take a step. 00:36:38
I just agree with your sentiment, but I do suggest that you look at this House Bill 1379 and it's. 00:37:19
It's probably not strong enough where you're at, but it's a step on putting notice right, the feds on notice. So I'll take I'll 00:37:28
take a look at it and I appreciate that. Thank you and I appreciate your listening to this, But please revisit the word navigable 00:37:36
because this is where federal is playing very fast and loose trying to. 00:37:43
Completely changed the statute in maritime, yes, to flow as opposed to commerce and that's really a critical point. That's an 00:37:52
important note. 1379 sees increase EPA presence, which is probably not something they're going for, I'm sorry. 00:38:01
Thank you. I appreciate that very much because. 00:38:47
The word unconstitutional was incorrect, but you do have authority and so I would ask Attorney Barker to please find where the 00:38:52
county commissioners do have authority and then exercise that authority because this has to stop. Thank you, Ronnie, thank you. 00:38:59
All right, Commissioner James, appreciate your sentiment there. So there's a motion on the floor and a second or consider a 00:39:07
resolution regarding outside of federal government's enumerated powers. 00:39:15
Roll call, roll please. 00:39:23
Mike Freeman No. Scott James, What are you saying? Terry Buck. 00:39:26
Kevin Austin No, Let the record reflect that resolution dies 1:00 to 4:00. 00:39:31
With Commissioners Freeman, Buck, James and Ross voting now. 00:39:37
New business continued. Item number 8, Second reading of Code Ordinance 2024, Dash 05, in the matter of repealing and reenacting 00:39:43

I. 00:40:56
Good morning. My name is Steve Teets. I'm in green. 00:41:08
I don't know all the details of this but I agree there shouldn't be because the illegals are taking the citizens. 00:41:13
When she tell you resources away, it doesn't matter what if it's for the elderly, disabled, seniors, veterans or whatever else. We 00:41:24
pay the taxes but but they get all kinds of things and that we're out in the cold also. I found out a few months ago. 00:41:34
That the state of Colorado has has a medical insurance for the illegals. They have either paid nothing or very little. While a lot 00:41:45
of us fight to have Medicaid or various other services that we need, not for luxury, but for what we need so we can survive. So I 00:41:54
think that we should have no appropriation for the illegals and send them back to their country. Thank you. 00:42:04
Thank you. Is there anybody else that wishes to make comment to this ordinance? 00:42:14
All right, see then I'll go ahead and close public comment on this matter and I will bring it back to the Board. Commissioner 00:42:22

A motion dies with no second. 00:42:52
All right, bringing it back to the Board for further discussion. Mr. Chair, I move to approve Court Ordinance 2024, Dash 05 00:42:56

Buck. Further discussion. 00:43:08
Hearing none, all those in favor signify by saying aye aye. All opposed. Same sign and second reading of code Ordinance 202405 00:43:15
passes on second reading 5 to 0. 00:43:22
Item number nine, First reading of Code Ordinance 2024, Dash 07, in the matter of Repealing and reenacting with Amendments, 00:43:30
Chapter 7, Emergency Medical Services of the Weld County Code. 00:43:35
Its German. This is the repeal of Chapter 7. 00:43:45
And mainly because the licensing will be done by the state of Colorado come July 1st. So what this would want to make this 00:43:50
effective as of June 30th, OK. 00:43:57
Anybody have any questions for Bruce? 00:44:05
OK with that, again, this is a public hearing. Does anybody wish to come forward, make any comments towards towards code ordinance 00:44:09
20/24/07? Please come forward to the podium. State your name and address. Keep your comments limited to this topic in the three 00:44:14
minutes please. 00:44:19
All right. I'm seeing that. I'm going to go ahead and close public comment on this matter and I will bring it back to the board. 00:44:26
Move to read on the 1st. 00:44:34
Secret ordinance Move to read on 1st Move to approve on first reading Code Ordinance 23 four dash 07 second. 00:44:37
Got a motion from Commissioner James to approve on first reading Code Ordinance 2024 Dash 07 second by Commissioner Buck. Further 00:44:43
discussion. Mr. James, I have a hard time saying so. With that, all those in favor signify by saying aye aye. All opposed. Same 00:44:52
sign and first reading of Code Ordinance 2024 Dash O7. No matter. Repealing and re enacting with women's Chapter 7 Emergency 00:45:00
Medical Services of well County code passes 5 to 0. That concludes new business and that brings us to planning. 00:45:09
We OK to keep rolling, Houston, or do you need a moment? 00:45:18
OK, item number one, consider certification a well county treasurer of zoning violation penalties as special assessment. Consuelo 00:45:21
Hernandez. This item was continued from November 20th of 2023. Good morning to you. 00:45:28
Good morning. 00:45:38
And good morning, Commissioners, Adria Sheer, Assistant County Attorney. And we are here today to determine whether we are going 00:45:41
to certify daily penalties for a property that is zoning violation has been occurring. The property is located at 3223 County Road 00:45:51
19 and that is in Fort Lepton. This is a continuance. A case arrest came before the board on November 20th, 2023. 00:46:02
At that time, the Board continue this case to give the property owner more time to come into compliance with the Wells County Code 00:46:13
and the property owner is here this morning. A recent inspection of the property on May 8th, 2024 was completed by Jordan Cook who 00:46:21
is here as well. The property does continue to be in violation of the Wells County Code due to multiple cargo containers. It is a 00:46:28
vacant parcel. 00:46:36
And this case has been pending since 2021 when the court ordered a $20 per day daily penalty beginning on July 12, 2021. And it is 00:46:45
up to the Board to determine whether a special assessment should be certified for the period outstanding of October 10th, 2022 and 00:46:55
up to but not including April 20th, 2023. This is a period of 558 days that the property has been in violation. 00:47:05
And $20 per day daily penalty is ordered by the court would be a total of $11,160.00 as a special assessment. 00:47:16
Please let us know if you have any questions. 00:47:29
Do you have any other part of the presentation? OK. Any questions for Adrian? 00:47:32
Are you Miss Consuelo? Yes. My name is Consuela Hernandez. Thank you. By calling Excuse me. So yes, I came to court and I I do 00:47:39
remember seeing the all of you here today and we talked about getting it in compliance. I told you that my dad had passed away 00:47:47
just a couple months before the the last court hearings. He was the one who was like taking care of all that he but he did put it 00:47:54
under my name. So his properties legal under my name. 00:48:01
But he kept me in the dark with a lot of things. And so this $20 a day thing, like I didn't know about it until the last court 00:48:09
hearing that we had. 00:48:13
And yeah, the goal was for me to get in compliance and to ideally get some permits on the box cars. Those box cars have been there 00:48:18
for a while. Yeah, one of them is empty. The other one, actually, I think two of them might be empty, but there is no trash on the 00:48:26
property. Like I know it's been classified as a commercial junkyard, but. 00:48:34
There's no trash. It's it's like, yeah, there's weeds. Like I can't really say it's 100% clean. 00:48:43
But in terms of like any items or stuff is just the grass and. 00:48:48
That slab of concrete. And so my thing was to get a permit on those box cars and last time I was up here in front of you all, I 00:48:52
asked that would be a possibility and that the answer was yes. However, when I did reach out to Jordan, I was told that I actually 00:48:59
can't get permits in the box cars unless of like there's a dwelling on the property. So that kind of created a big hiccup for me 00:49:05
and I. So that's my thing now is I'm trying to get I'm trying to be creative and work with the system because my ultimate goal is 00:49:12
to get it into compliance for. 00:49:19
Accounting. 00:49:26
Cargo boxes without. 00:50:00
Of dwelling on the property, that makes sense. 00:50:02
Somewhat. 00:50:06
I understand what you're asking, but I don't think that's it's like a it's new territory for me for sure. 00:50:09
I'm kind of at a standstill. I don't know what to do. I talked to Tom Parker about getting vouchers, but I really don't need any 00:50:17
vouchers because there's no like trash or junk on that yard. It's just those box cars and then that little RV there. I. 00:50:24
Yeah, but then like the last time I was here, my goal was to get permits, and then I was told I can't get permits on the box cars. 00:50:32
So it's like, what do I do? You got to just sell them. So it's not that easy to sell box cars, you know what I mean? 00:50:37
So I have a question. So when did you reach out to planning and find out that you couldn't do that? 00:50:44
I'm not asking for an exact date, but relative to when we had your hearing back in November, I think I called. I got in touch with 00:50:52
Jordan. 00:50:56
Was it prior to the end of the year? I think it might have been January of 2024. We have like one phone call about it. And tell me 00:51:04
about that. So since that phone call with Jordan where he said you couldn't get the permit because you didn't have a dwelling, 00:51:11
what other steps have you taken since then? I mean, I talked to Jordan recently and asked I needed to set up a meeting to see if 00:51:18
there was potentially somebody and zoning and planning kind of like Tom Parko that I can get in touch with. But. 00:51:26
That was maybe a couple weeks ago, yeah. And then I have, I've made a few calls to see what the process would look like for me to 00:51:34
sell the box cars. 00:51:40
But it is kind of a challenge. 00:51:47
Yeah, 'cause I'm only like. 00:51:51
I just don't know really what my dad was doing with all of that and it kind of came crashing down on me and I was really hoping 00:51:55
that I could get those permits that way I could, you know, I do either sell the property, but I can't even sell the property until 00:52:00
it gets into compliance first, so. 00:52:06
Thank you for answering the question. I appreciate that. 00:52:17
I have a question suggestion saying so. So you're looking to sell the property actively. I mean it's not. 00:52:21
My mom doesn't want to. She doesn't want to sell the property yet, but it's under my name. 00:52:30
She's worried about like losing her house and she's like one minute somewhere to live. Mom, you're not going to be fine. But I 00:52:36
mean, that would be my goal is to sell it. Yes, my mom wants to build a property on that house or on that piece of land there, but 00:52:43
we don't really have any plans for that. We we don't have like the money right now. 00:52:49
Well, just a suggestion, if you were going to sell the property, you can probably make some kind of agreement with the new owner 00:52:57
to have them remove the box cars. And if you're actively in that situation, we have helped property owners before that were 00:53:04
struggling to move things as they were selling the property. So it is just an idea. 00:53:10
And of course, if your mom built a residence on there, I'm sure we could. 00:53:18
Allow for some of those cargo containers and other uses if there's a primary dwelling so. So you'd have to make one decision or 00:53:24
the other on that one. 00:53:28
But it just is that a possibility of selling the property and making that kind of agreement? Yeah, it is. OK. How soon would you 00:53:35
pursue that? I mean it would need to be within the next, it's a three months. 00:53:42
We get some of those letters sometimes from people out of state, I mean, looking to buy land like companies and stuff. So I was 00:53:51
looking at something like that potentially. 00:53:57
Yeah, just as a matter of me. 00:54:04
Really doing my research and trying to make a bunch of calls and figuring out what I can do because I don't know too much about 00:54:09
that. I suggest this. This is just an idea and I don't know what the board thinks. I'm wondering if we don't continue this again. 00:54:15
We have a new planning director. She's an interim director right now. Elizabeth, would you raise your hands so it was Connie can 00:54:23
identify you? 00:54:27
Let's chat again with planning and let's see if there's anything we can do, giving you a continuance, why you still continue to 00:54:31
figure out your situation on your property, whether you're going to sell it, whether you've been thrust into a world that you 00:54:38
weren't expecting right with the passing of your father. But see if we can't consider these somehow. 00:54:44
Accessory units to add production, something to that nature that we could permit for. I don't know if that's a possibility. I'm 00:54:51
just throwing something out there. I'm not telling you that that can be done, but it's worth exploring. So let's take another 00:54:58
crack at this. And Elizabeth, will you talk to Connie so that. 00:55:05
She can maybe get some guidance there and in the team can work with you there. Maybe we can, maybe we can't. But that could give 00:55:13
you additional time as we try and figure this out and you can figure out if you can get those sold right or what you want to do 00:55:20
with the property too. Yeah, that would be greatly appreciated. Yeah. It feels like a big weight on my shoulder right now. So, you 00:55:27
know, just trying to do what I can to get this handled and that's a lot. But yeah, I I'd appreciate that. 00:55:34
So. 00:55:46
I'm I'm OK with the continuous, I wouldn't be willing to do more than 90 days. This property is in violation since 2021. So I'm 00:55:49
willing to, I'm willing to continue it for 90 days, but it needs to get resolved, guys. 00:55:56
So I would move to continue this item until September. 00:56:05
Can I have a date? 00:56:10
90 Days is August 19th, 2024. 00:56:14
Motion for continues to August 19th, 9:00 AM 20/24 set by Commissioner Freeman, second by Commissioner Buck. Any further 00:56:19
discussion? 00:56:24
Any, none, all those in favor signify by saying aye aye, all opposed, same sign and that 90 day continuance is granted. 00:56:31
Regarding this case for Consuelo Hernandez so. 00:56:41
Appreciate it. Why don't you reach out to planning and let's see if there is anything we can do helping you think outside the box 00:56:45
and help you make those decisions and those next 90 days. But I think we're pretty clear 90 days is where we're at. 00:56:51
Just to verify, the 19th at 9:00 AM of August, Yes, August 19th. OK. All right. Thank you. Thanks, Connie. 00:56:59
Item number 2. 00:57:08
Second reading of Code Ordinance 2024, Dash 08 in the matter of repealing and reenacting with amendments. Chapter 24, Subdivisions 00:57:10
of the Weld County Code. Rural land subdivisions, RLDF. 00:57:16
Move to read my title in one second. Motion by Commissioner Freeman to read by title only. Second by Commissioner James. Further 00:57:22
discussion regarding read by title only. Hearing none. All those in favor signify by saying aye aye. All opposed. Same sign and it 00:57:28
passes to read by title only. 5 to 0. Code Ordinance 2020. 00:57:34
Eight, in the manner of repealing and reenacting with amendments. Chapter 24, Subdivisions of the Royal County Code, Rural Land 00:57:41
Divisions, RLDF. 00:57:46
Thank you, Bruce. Good morning, Max. Good morning, Commissioners, Maximated Prime Client Services. 00:57:53
Portland County Commissioners approved first three ordinance 20/24/08 on May 6th, 2024. As a reminder, the purpose of this 00:57:58
ordinance is to amend Section 24-6-2813 of the World County Code. 00:58:04
Existing accesses are onto accounting, maintaining local road and no fewer than three lots are proposed. No changes are proposed 00:58:45
in the staff recommends approval of this ordinance. 00:58:50
Excuse me. I'm sorry, Max. 00:58:57
Anybody have any questions for staff? 00:58:59
All right, I'll go ahead. And this is a planning item with public hearing. I'll open this up for public comment. 00:59:03
Does anybody wish to make public comment towards this item being told Ordinance 2024 Dash 08? If so, please come forward to the 00:59:11
microphone, state your name and address for the record and keep your comments to three minutes please. 00:59:18
All right, I'll go ahead and close public comment and bring it back to the board as she moved to approve on second reading code 00:59:26
Ordinance 2024 Dash 08. 00:59:31
That motion from Commissioner James for approval of Code Ordinance 2024, Dash 08, second by Commissioner saying, is there further 00:59:37
discussion? 00:59:41
I'm going to make a comment here. 00:59:47
I don't like when we change code for one off instances. I said this during the first reading. I'm gonna continue to say it for the 00:59:50
second reading. I understand that this property was probably an unintended consequence of the original RLDF code language, but we 00:59:57
start slipping into slippery territories when we don't adhere to two codes, so it does bring me reservation. So that's my comment 01:00:04
towards this with that roll call vote please. 01:00:11
Mike Freeman, Scott James, What are you saying? Yes, let the record reflect second reading of Code Ordinance 202408 passes 4 to 01:00:21
one, with Commissioner Ross being the no vote that concludes planning. 01:00:29
And brings us to public comment. This is a time when anybody can come forth and speak to the Board of County Commissioners 01:00:39
regarding any topic that you wish. We ask you to keep your comments for three minutes. 01:00:45
And direct those to the board. If you can't make it today and would like to reach out to the board, you can do so by. 01:00:51
Emailing us at public comment at Weld Gov or at CTV at Weld Gov You can do it the old fashioned way by sending us the old snail 01:00:58
mail. Weld County Clerks Board PO Box 758-1150 O St. Greeley Co 806 three two is anybody wishes make public comment today. 01:01:08
Go ahead, come on up to the microphone and just come in whatever order you'd like. 01:01:18
Good morning and good morning. Cloudy morning is for the record, my name is Dictates and Gray. 01:01:29
And I mentioned this before, but. 01:01:40
What's causing a lot of problems is we're first taxes, taxes, taxes, fees, taxes for people. It doesn't matter what stage of. 01:01:45
Life and your. 01:01:55
What? What you're, what you get. 01:02:00
For spending money or whatever. 01:02:03
And this is what's causing a lot of the homelessness we have. 01:02:07
Prices, if it's fruit or whatever, out of sight, housing is out of sight and all that. 01:02:12
And if we with God said don't do something to slow it down or eventually with a miracle. 01:02:18
To otherwise to stop it or slow it down, there's going to be a lot more people homeless and we're getting weaker and weaker if 01:02:29
it's the nation, if it's the state, county or cities. 01:02:37
There's got to be housing and good jobs. It's not all that easy to get jobs, even though some people think so. 01:02:46
And there's a lot of areas in that, but I'm running on both sides. So I guess what I'm asking is that we got to be more serious 01:02:55
and, and have some solutions, ideas and implement them or we're going to be like maybe. 01:03:04
Venezuela, Africa, or someplace like that. 01:03:15
So also you mentioned about the water. 01:03:19
That water bills are real high what I understand even though I don't have a water bill but from friends or the community. 01:03:25
And and the taxes I mean really is going to put on the ballot through tax referendums or whatever you call them. And once the food 01:03:37
tax one is an open space tax and I forgot the third one. 01:03:45
And we're taxed enough as it is. 01:03:53
Property tax is high enough and some people are and I'm starting seeing how how signs people selling their houses for many 01:03:58
reasons, including the property tax. So what could it end up more and more people homeless and what solutions do we have to 01:04:05
prevent homelessness and to house people? Thank you. Thank you, Mr. Tease. 01:04:12
Other public comment. 01:04:22
Good morning. Good morning. 01:04:30
I'm Diana Seeley and this is my partner here, Billy Delancey, and we are with the Johnstown Meteorite Committee. 01:04:36
I'm going to just read you a little history real quick. On July 6/19/24, at approximately 420 PMA, meteorite fell from the sky and 01:04:45
landed in the road near the area that is now known as the Johnstown Cemetery, interrupting a funeral in progress. 01:04:53
The meteorites June field measured 2 miles wide. Excuse me, I got a cold, don't want to start coughing and 10 miles long extending 01:05:02
across farmland between Johnstown and Mead, 27 pieces in various sizes ranging from 51.8 lbs to small pebbles were recovered and 01:05:09
authenticated. 01:05:16
This meteorite is significant to the science community because it is rare that a meteorite is not only witnessed, but that an 01:05:24
observer could walk over and pick up the piece immediately. 01:05:29
Most meteorites fall in the ocean or in the remote locations on land. Currently, the largest pieces of the meteorite are displayed 01:05:36
in the Denver Museum of Nature and Science and the American Museum of Natural History in New York City. 01:05:43
We are here in person to invite you to help us celebrate the 100 year anniversary of the Johnstown meteorite on July 6th. 01:05:51
We also have some commemorative coins that we would like to share with you and we'll make sure that we can hand them. Would you be 01:06:00
the one that we would? 01:06:05
I'm going to read what some of the events are that we all have. Starting at 10:00 AM, there will be a memorial dedication ceremony 01:06:10
at Johnstown Cemetery. From noon to 7:00 PM, a Rock and Gem show will be held at the Roosevelt High School. And at 5:00 and again 01:06:17
at 7:00, presentations by local and national experts, including a real NASA astronaut, will be at the Roseville High School 01:06:23
auditorium. Excuse me. 01:06:30
And at dusk, Johnstown's first ever drone show will be held at the Roosevelt High School. Thank you for your time. And we really 01:06:38
hope that one or all of you can attend this celebration. So thank you. Thank you. Yes. Do you see how she gave me the side eye? 01:06:45
That God sent the meteor right during your funeral. 01:06:55
Thank you for your time. I will be there. I got, I got that going on too, so I understand. Thank you ladies. I appreciate you 01:07:00
sharing. 01:07:05
Does anybody else have public comment today? 01:07:12
You know, what we're going to share is the schedule. Thank you. And we'll make sure that we get that in our commissioner notes so 01:07:15
that we can we can have that. Thank you. 01:07:18
All right. Seeing no other public comment, I'll go ahead and close. Public comment and it is 9:59. We stand adjourned. 01:07:24
