| we should support them in this effort. You heard some of the testimony last Wednesday where people are just saying they're | 00:23:59 | |
| exhausted. That should not be the condition of our constituents, especially if we have the ability to help them in various ways. | 00:24:06 | |

| And also where the fees, like we have done before, the poor should not be our footstool. And these folks are elderly, a lot of | 00:24:22 | |
| them. And they're barely hanging on with some of the taxes and other things that are going on in Colorado right now. So they would | 00:24:29 | |
| like to enjoy the agricultural lifestyle that they have been accustomed to in the last 40 years. So I asked for yes vote. | 00:24:35 | |

| going on with some of our farmers and ranchers, some of the fights they've had to do against the federal government. And if we | 00:25:13 | |
| have the power to protect them in any way, I know how important that would be to her and the rest of the farmers that make that | 00:25:19 | |
| feed us, that have been a backbone of, well, become. | 00:25:25 | |
| Here as far as producing food and producing the culture that has made us free. So with that, I'm kind of stalling a little bit to | 00:25:32 | |

| It's critical to property rights, is critical to the economy of, well, county, of course, and it's something that you could | 00:26:02 | |
| actually provide as a template for other counties in the United States to use to push back federal when it exceeds its enumerated | 00:26:11 | |
| powers. I don't have the resolution draft in front of me, so I'm kind of going to go by. | 00:26:21 | |

| A post that I did way back in on May 20th, 2015 in respect to this very issue. That's almost nine years ago and you have probably | 00:26:44 | |

| This has cost our providers a tremendous amount of money fighting government on their own dime. The government whenever it comes | 00:27:09 | |

| They have the entire DOJ behind them. | 00:27:26 | |
| You as an individual have your own. You have to rely on your own resources. You payout of your own pocket for your own console. | 00:27:30 | |
| You lose money when you go to the capital to testify or when you come here to testify. There's a lot of production dollars that | 00:27:37 | |
| are lost in well County. | 00:27:43 | |
| Fighting federal overreach and this has to stop. It has to stop and it has to stop. | 00:27:50 | |
| Throughout the state of Colorado. | 00:27:58 | |
| The key key thing here in respect to water is that Colorado has no navigable water in the state, period. | 00:28:01 | |
| Federal only can control water that it owns. Federal has to buy water just like the rest of us. | 00:28:13 | |
| They just don't automatically get water, they have to purchase it just like you would irrigation, ditch companies, et cetera. | 00:28:22 | |
| And for them to come in and, for example, FEMA to expand floodplains and then just arbitrarily start dictating to little towns and | 00:28:31 | |
| irrigation ditch companies what they can and cannot do is in total violation. | 00:28:38 | |
| Of the law, period. It's in statute. | 00:28:46 | |
| And so all I'm asking you to do today is. | 00:28:50 | |
| I'm asking you to pass a resolution that will serve notice on federal that they have zero authority in the county of the world, | 00:28:55 | |
| the state of Colorado, when it comes to water in particular. | 00:29:03 | |
| So I second the motion. | 00:29:13 | |
| Thank you. And I would like to discuss a couple things on that. What I don't think I mean that you're saying it's it's a statement | 00:29:16 | |
| and I get it, it's a statement, but doesn't result anything because the well county doesn't have the authority to tell EPA to stay | 00:29:24 | |
| out. But I did speak to Senator Kirkmeyer this weekend and she addressed this specific issue with a bill that just was passed this | 00:29:31 | |
| year, House Bill 24/13/79. Have you had a chance to look at that? No, I haven't. | 00:29:39 | |
| I would suggest that you look at that. I can't support though this resolution because I do think it was addressed and again, she | 00:29:47 | |
| sponsored it and I had a great conversation with her. You might want to just reach out to Senator Barb Kirkmire and and and | 00:29:53 | |

| Told me it it and it it's it's I won't read Bill. Well, actually and and I I appreciate that thank you. But actually the county | 00:30:07 | |
| commissioners do have the authority. They do have the authority and I. | 00:30:14 | |
| I think that with the General Assembly is just going to get kicked down the road for another 50 years until federal is completely | 00:30:22 | |
| taken over all our little counties. | 00:30:27 | |
| In Colorado. | 00:30:32 | |
| And I will read what? | 00:30:34 | |
| Representative Kirkmeyer has put forth, but you Will County commissioners do have the authority it's in. It's in your state | 00:30:38 | |
| constitution to push back any federal overreach period. | 00:30:45 | |
| Bruce, would you like to address that statement? Yeah, we're in the Constitution. Does it say that in the state constitution, | 00:30:54 | |
| county commissioners, it defines what your authorities are and are not saying that that's unconstitutional. | 00:31:03 | |
| That might be the case in a court of record could say that. | 00:31:13 | |
| But to say that the board of county commissioners by resolution can say, OK, it's unconstitutional, it can't apply in Wall County, | 00:31:18 | |
| there is nothing in the state constitution that allows for that. | 00:31:26 | |
| Well, I I think it's an interpretation of our Constitution and I will read it again, but where the buck stops in every state is | 00:31:35 | |
| with the county commissioners. | 00:31:42 | |
| And so if the county commissioners are powerless over federal, then who does have the power over federal General Assembly? They | 00:31:49 | |
| don't care. They really don't. You know, I've been working on this for over 10 years and the General Assembly just doesn't care. | 00:31:55 | |
| They're in, they're in collusion. I'm sorry. | 00:32:01 | |
| I just want to make it clear I didn't move the resolution, but let me clarify a few things. Senator Chris Meyer's bill is about | 00:32:09 | |
| dredging utility, and so this resolution says nothing about dredging and filling, although we've got something here about | 00:32:13 | |
| dredging. | 00:32:18 | |
| And we should send a strong statement that is very wrong and the statement supporting you and what you're trying to do. And this | 00:32:57 | |
| is a first step. So again, I would urge a yes vote on this. | 00:33:02 | |
| So I've got a comment. I'm fairly familiar with water. So you got the Waters of the US Act going through Congress right now. It | 00:33:08 | |
| keeps getting punted, keeps getting punted. It hasn't been decided right, because they're trying to determine. | 00:33:15 | |
| Which way they go with and how far that reaches, and whether? | 00:33:23 | |
| That does include irrigation waters, things to that nature, right? What this was addressed at the state legislature this year, | 00:33:27 | |
| right? And and actually there was 2 water bills. Senator Kirk Meyer brought forth one. It actually died late in the session, I | 00:33:36 | |
| think the day before the last. But then she got on a Co sponsored 1379, I believe it is, which was the minority speakers. | 00:33:45 | |
| Water bill and they got it so that it did address this right. So the state through the state constitution because water is drafted | 00:33:55 | |
| into the state constitution. That's how important the founders of the state. | 00:34:01 | |
| Regarded water and so very few other places inside of the great United States did it get drafted into the Constitution like it did | 00:34:09 | |
| from the very start here in Colorado. | 00:34:16 | |
| Buddy, I appreciate your sentiment. I do agree we have to look after water, but this isn't a county. We don't have authority here | 00:34:24 | |
| and I'm very certain we don't have authority. I would disagree with that and but. | 00:34:33 | |
| This is my opinion, OK, Reading our charter, as far as my obligations and responsibilities as a commissioner, reading what the | 00:34:42 | |
| state constitution is set forth, I don't find it where it is our authority here, OK. The case that you brought forth to us, I | 00:34:48 | |

| That's in the town of Milliken itself. That's not in Weld County unincorporated. That was in well, that was in Milliken. | 00:35:01 | |
